STREET DEDICATION
KNOW ALL MEN BY THESE PRESENTS, that we, GIDEON F. THOMPSON and JOAN THOMPSON,
husband and wife, hereinafter called grantors, for the sum of $1,260.00 to be paid
by the CITY OF TIGARD, a municipal corporation of the State of Oregon, to grantors
within the time hereinafter stated, hereby give, grant and dedicate to the CITY OF
TIGARD and to the public a perpetual right -of -way and easement for public road,
public street, and public utility purposes on, over, across, under, along and within
the following described real property in the City of Tigard, Washington County,
Oregon, to -wit:
The North 10 feet of that portion of Lot 27, TIGARDVILLE HEIGHTS,
Washington County, Oregon, described as follows:
Beginning at a point on the North line of said Lot 27, at the
Northeast corner of that certain tract conveyed to Robert L. Borchert
et ux. by deed recorded February 20, 1951 in Book 317, Page 347, Deed
Records; thence South 0 0 7'30" West along the East line of said Borchert
tract to the Southeast corner thereof; thence North 89 52' East along
the North line of that certain tract conveyed to Lloyd E. Kennedy et
ux. by deed recorded April 4, 1949 in Book 294, Page 57, Deed Records,
84 feet, more or less, to a point on the West line of that certain
tract conveyed to R.W. Reinemer et ux. by deed recorded July 12, 1949
in Book 297, Page 43; thence North along the West line of said Reimer
tract to a point on the North line of said Lot 27; thence West along
the North line, 84 feet, more or less, to the point of beginning.
This dedication deed is executed and delivered to the CITY OF TIGARD as a
named grantee, and in addition to payment of the monetary consideration stated above,
the City of Tigard shall perform or cause to have performed each of the following
not later than December 15, 1982:
1. The City of Tigard shall construct or cause to be constructed at its
sole expense a chain link fence along the line conunon to the remainder lanr Of •
grantors and the north 10 feet of said Lot 27, including two double hinged gates
with steel posts embedded in concrete, approximately four feet in height, one on
either side of the driveway,. together with 10 feet curb cut an 10 foot gate 4• foot
high at N.L. corner of lot t'o allow access to back of lot..J �
2. The City of Tigard shall either perform or cause to be performed the
relocation and reinstallation of water meter, water service line, natural gas
service line, telephone lines, and each and every other utility line in anywise
interrupted or affected by the construction to be conducted by the City of Tigard
within the 10' area hereinabove described.
3. The City of Tigard shall constructor cause to be constructed at its
sole expense the blacktop driveway and ramp serving grantors' remainder lands lying
adjacent to the 10 foot area herein described:.
4. The monetary consideration for this street dedication, to -wit: $1260.00,
shall be drawn payable to Gideon Thompson and Joan Thompson and delivered in hand
or posted to be received by Anderson, Dittman & Anderson, attorneys for grantors,
at 8865 S.W. Center Street, P.O. Box 23006, Tigard, Oregon, prior to entry by the
city upon the 10 foot strip above described,not later than December 15, 1982.
Grantors are the fee simple title holders of the area herein described,
subject to a pre- existing deed of trust bearing date November 25, 1977, recorded
in._Boo.k_1219 atP.age_902, Deed Records of Washington County, naming The First

National Bank of Oregon (now First Interstate Bank of Oregon) as beneficiary. This
grant.shall'have no legal force and effect unless and until the said trust deed
beneficiary shall have concurred herein.
