The first one I did not show up in my sent file, so I am sending you another email. (I apologize for the duplication in the event that you received the first one.) Below is a copy of the underwriter's email that we received last Thursday. Pictures, that were taken by - an independent adjuster, of your building are attached for your review. After seeing the photos, my first impression has been altered. In my conversation with the underwriter last week, it sounded as if the stairs were falling apart. But since a trip and fall claim has been presented against you, the carrier is being cautious, and hence calling for repairs. It appears to me that the initial step on the first page, item #4, (of the attached report) can be repaired to even it out. There isn't a whole lot of room between the stairs and the street for any major construction. If you were to replace all the stairs, are there any plans for a sidewalk in the area? If so, I would think the sidewalk would wipe out the bottom portion of your stairs, along with your cost. The inspector refers to the North side and South Side, but all areas of concern are at the front entrance which is 5 feet from Hwy99W (from the bottom step to the roadway). Above each photo describes the concerns and measurements of some steps reveal settling and unevenness. The steps do not conform (per Uniform Building Code)to current standard of 7 inches in height and 11 inches in width. They also do not have adequate railings for safety. There is also a photo of the sidewalk which is uneven, increasing the risk of trip and fall hazard. Although they have been repaired the steps over the years, in order to meet code and prevent further loss, they will need to involve.a contractor as the steps may need to be replaced. The non - renewal is set for 10/1/2011. If conditions are remedied and Standard code requirements are met, we can reevaluate our renewal decision as long as all other underwriting eligibility criteria is met (no lapses, no addt'I losses during the year, etc...). I agree the sidewalk at the bottom of the southwest stairs is broken and, to some extent, could be considered a safety hazard. But not the steps and not the sidewalk on the opposite side. Is this a final irrevocable decision or is there room for negotiation? I'd be more than happy to meet you or someone from Gelfand Insurance at the Grange one of these days to review the situation together if you think its negotiable. If not, let's get a competitive quote from another carrier (or two). According to the underwriter, the stairs on the North side of your building will have to be replaced. The stairs are sagging and uneven, which presents a "tripping" hazard for anyone using the stairs. When the stairs have been replaced with the surface ground leveled, if there are more that 2 steps, you will have to install a rail to meet code. (3 steps = rail) The underwriter stated that the sidewalk, which is uneven as well, can be repaired to smooth out the surface. Both issues will have to be resolved before Grange Insurance will renew your policy on 10 -01 -2011. If you should have any further questions, please call us.
