Tigard Planning Commission. April 6, 1976 s ryy. 7 ZoA 3- Agenda Item 5.4 a CE { ZONING ORDINANCE AMENDMENT NT a A request by the City of Tigard, amending the landscaping ., standards of the Zoning Ordinance (Title 18 Section 18 58 050) gar". requiring that security be posted with .the City equal to 110% rx,,r of the cost of the proposed landscaping as determined by the y 5 City Planning Director before the 'issuance of any building t rig permits. ar STAFF FINDINGS <s a 1. The Building Official has requested the Planning Dept. :1J'..-s-":! staff to have the Planning Commission review means of insuring the installation of required landscaping. The purpose of this request is to lessen the work load for the Building Dept. Presently it is the responsibility of the Building Official to determine that required landscaping has been installed before issuance of an occupancy permit. The Building Official is concerned about the amount of time spent in this area As an alternative, he has suggested lty5 allowing the posting of a bond covering the amount of the landscaping required. In this way, the lack of completed landscaping would not be an issue for his consideration when, issuing an occupancy permits tPf, The present code does allow a building to be occupied before landscaping is installed, provided a bond is posted, assuring Fti^ that installation will be made within six months. 2 Other jurisdictions were contacted regarding this matter and the staff has concluded that the present method is both kip the most effective and involves the least staff time. The City of Beaverton, for example, has had considerable rF! legal red tape to deal with when, attempting to collect on txti- landscape bonds., fM, f 7 tds xy. ra { >nS .. - .,.. ,XCkA!z ,-4 ... V!!T., '."3ftR•....,.. x- :, .. , Y"a*45" Zc+ ..P3' "'#M+ ! -'. x .! a k Fa..
