The only real question was whether tire retreading should be a conditional or a permitted use in the M-4 tone. One of the Planning Commission members e)cpressed a concern about the compatibility of a tire retreading plant if it were , to be located in an M.,...4 gone located near a residential zone. Although ;,,,,,•,,,,,,. 1 am sure this concern was genuine, a tire retreading operation is far less offensive than many of the uses permitted in the 1V1-4 zone. , 'lit, 4 Further, if tire retreading is made a conditional use, It would be incumbent upon anyone seeking to put in such a business to prove public need, that the parcel in question is the best available parcel, and all of the other criteria involved in land use change cases, The fact of the matter is that one seeking to put in a tire retreading business might not be able to meet these criteria for the simple reason that the plant could ,'',!t•,:' probably be just as well located anywhere in the metropolitan area. To make it a conditional use would not only frustrate Butler's Tire & litattery Cc. , Inc, , inasmuch as it had been hoping to locate in Tigard and complete construction during this building season, but it would also frustrate the purpose of the zoning ordinance. The solution to the con, .,.1. cern of compatibility does not lie in making tire retreading a conditional use, but rather in design review, and this is already provided for in the M-4 zone. Our client is anxious to locate a retreading and warehouse facility in the City of Tigard on real property located on S.W. 72nd Ave. „ai '` `� and owned by H.A. Andersen and Joseph M Fought. However, we have ,',, a problem in that thep roperty is zoned M-4, and the Tigard City Zoning 44'` Ordinance does not allow a retreading business in the M-4 zone r Apparently, a retreading business may be located in the City s of Tigard rd only with a conditional use in a C-3 zone. This seems rather i incongruous i -� IS a commercial zone geared primarily to � g r ',' sales of goods and services.. On the other hand, M-4 is an industrial �� park zone and allows primarillight manufacturing type uses it seems a h tus this is a much more compatible zone in which to allow a tire et retreading business, It is true that once manufactured, the retreaded „t; tires must be sold, and some of them may be sold on the same site `where ” : they are manufactured but these sales are secondary to the manufacturing. , I Similar sales must be made by many, if not most, manufacturing businesses. Since we feel it iS more appropriate to locate a retreading business , C-3 uses, Butlers Tire & Battery Co. , Inc. t�, among M-4 uses, rather than respectfully requests that the City of Tigard enact an ordinance amending the C-0 and 1V1-4 zones to provide that tire shops and retreading operations ' be located in M-4 zones rather than 0-3 zones.
