BASIC FACTS : 1 . Section 17 .2S .110 of the Tigard Municipal Code states as zi follows "A cul-de-sac shall be as short as possible and shall in no event be more than six hundred feet long. All ( is cul-de-sacs shall terminate with a right-of-way radius of fifty feet. The length of the cul-de-sac shall be measured along the center line of the roadway from the near side of .1 the intersecting street to .the farthest point of the cul-de cul-de- sac . (October 1971) z 2. The Tigard Community Plan states as a local street standard "cul-de-sacs 40 foot radius minimum turn-round and 400' maximum length" (1968) 3. The 1975 Baker vs. City of Milwaukie,` Oregon Supreme :Court case clearly establishes the comprehensive plan as the con- trolling' land use document; superior to its implementing or.din ances, i .e. zoning subdivision, etc 3Y{; 1w• II FINDINGS 1'. 1. The rationale for limiting the length of a cul-de-sac is primarily for public safety; to provide easier, quicker and more efficient delivery of public services especially emer- gency services, i.e. fire, police, ambulance. 2. The results of shorter cul-de-sacs are more cul-de-sacs more through local streets - more equitable distribution of traffic throughout; e= the neighborhood and the community 3. Cul-de-sacs create desirable and safe places to live primarily due to the lack of "through traffic" . '' <rt: THE CITY OF TIGARD ORDAINS AS FOLLOWS: .; -x, Section 1: Finding that pursuant to Chapter 227 ORS and Ordinance No. 68-48 ri (City of Tigard Subdivision Ordinance of 1968) the hereinafter x r; stated amendment to said ordinance, pursuant to prescribed procedures, were V submitted to public hearing held by the Tigard Planning Commission on March 1, 1977, and to the City Council thereafter recommended that said subdivision ordinance be amended' as hereinafter set forth.
