+i. THE CITY OF TIGARD ORDAINS AS FOLLOWS:
rzK Section 1 : The following Interim Stormwater Detention Ordinance, in
conformance with prescribed procedures, was heard in public
hearing by the Tigard Planning Commission on March 14, 1978, and the
d�hx ` Planning Commission thereafter recommended to the City Council that the
zoning ordinance be amended as set forth below.

The purpose of this ordinance is to reduce the harmful

z`t ` effects of stormwater runoff on streambeds, banks, park-
lands, private properties and other areas in the City of Tigard by ''''
requiring the installation of on-site 'stormwater detention facilities`
as properties are developed within the City
Section 3 : Applicability

The provisions of this ordinance shall apply to any world for

which a subdivision Plat , a site development plan anc3/or build-
ing t.l A Ks permit is required and shall apply to any work requiring a permit
for which other changes in the land use are made which change the run s
off characteristics. The provisions of this ordinance shall apply in all
uses under the Zoning and Subdivision Ordinances of the City.
Section 4: Manual of Operation
The Director of Public Works shall prepare and set forth in '`
�{ the form of a manual, guidelines for compliance with the
1..f:( standards of this ordinance The manual will assist those persons who are

required to comply with the Provisions of the Stormwater Detention
Ordinance and may be secured from the City of Tigard and shall be �E
followed unless otherwise specified. The Planning Director shall act
as the agent for control and final approval of submitted plats and site

development plans, 'subject to appeal to the Planning Commission. The

(a)Whenever any work for which a subdivision plat , site develop-
ment plan or a building permit is required is; undertaken on

i f . undertaking the work shall provide stormwater storage sufficient to store
the difference between_ the runoff from a 25 year storm on the site as
s fully developed and the runoff produced by a five (5) year storm from the
site in its undeveloped state until such time as the required storage has
try been fully utilized.

(b)Whenever any said work is undertaken on a site which is located t
within the One-Hundred (100) year flood plain, the person

of .the City s flood plain ordinance', and .in no case shall anything in this

a negative impact upon or impairment of the intended effectiveness of
the City's flood plain ordinance (Chapter 18. 57) . The City Council is vested
with the authority to interpret and rule therein. x
5-3 Maintenance
} All plans submitted for stormwater detention systems shall

The Planning Commission at their November 29 1977'hearing directed staff
to prepare an ordinance to control s tormwa ter runoff which contributes to ,°
local flooding and'drainage problems As the Commission is aware, the City' ry
has budgeted a comprehensive drainage study for the current fiscal Year,
and it is now expected that work on this will begin in several "weeks,
Pending completion .of that study and City adoption of its recommendations,
some temporary means of controlling runoff is desirable. Policy 2 of the
„1 Environmental Design and Open..Space Plan also calls for enactment of in-
terim control measures.
The attached ordinance was drafted by John Hagman, of the Public Works
Department, based on a similar- ordinance adopted by Washington County tn
August of 1975 The critical standard would limit runoff on a developed
site to be no greater than would occur on the undeveloped site from a
5 year storm (207 probability in any year). On-site storage would not-

be required to handle runoff from larger storms than those of 25 year
(: frequency k1,1.7. probability in any year)
The Planning Department recommends adoption of the proposed ordinance in

" = All plans submitted for stormwater detention systems shall
describe an adequate procedure of normal maintenance for
the detention system. Any failure of the stormwater system,
due to inadequate normal or capital maintenance, shall be
the responsibility of the owner of the property on which the t

detention system is located. It shall also be the property
owner's responsibility to remedy any negligence in maint-
enance 4y
that results in the failure of the system. Periodic
