Proceedings on Proposal No . 1589 commenced upon receipt by the Boundary Commission on a resolution and property owner consents from the City of Tigard on March 26 , 1980 requesting that certain property be an- nexed to to the city. The resolution and property owner consents meet the requirements for initiating a proposal set forth in ORS 199 . 490 , particularly Section (2) . Upon receipt of the petition the Boundary Commission published and posted notice of the public hearing in accordance with ORS 199 . 463 and conducted a public hearing on the proposal on May 1 , 1980 . The Commission also caused a study to be made on this proposal which considered economic , demographic and sociological trends and projections and physical development of the land. FINDINGS On the basis of the public hearing and the study the Boundary Commission found that : 1 . The territory to be annexed is contiguous to the city and contains 1 . 86 acres , 1 single family residence , 1 industrial structure , an estimated population of 3 persons and is evaluated at $79 ,500 . 2 . The property owner desires the availability of city services to facilitate eventual expansion of his business . 3. The proposed action is in accord with LCDC Goals#l , 2 , 3 , 11 and 14 to the extent to which they apply to the Boundary Commission actions . Other LCDC Goals were examined and found not to be ap- plicable to this action. The territory to be annexed is within the adopted Metro Urban Growth Boundary which has been approved by LCDC. The area is classified as Urban on the County Framework Plan and zoned MA-1 , Limited Manufacturing , in the county. The territory to be annexed is located on the south edge of the city on the west edge of SW 74th Ave . , north of Durham Road. and south of Bonita Road. The property owner desires city services . Eventually he desires to further develop his property. Additionally, the city wishes to eventually annex all of the Fanno Creek flood plain in this area which is not now in the city so it can better manage the flood plain. Land Use and Planning : LCDC Goal #1 . The appropriate Washington County Community Planning Organization was notified of this action. LCDC Goal #2 . This area is identified ae i.ban en th County Framewor`c Plan is zoned MA-1 (Limited Manufacturing-Production District). The site is partially developed with this use in the form of a machine shop. City Plannipa. The city's plan identifies this as suitable for an Industrial Park. ---,annexed, the city will rezone the property to the comparable, city zone, M4-PD, el %r: 'itu.attilapark, Planned Development). The city has a flood plain ordinance which is part of their Sensitive Lanes Ordinance This ordiance includes flood plains and lands with excessive slopes. The city would like to have all of the Fenno Creek flood plain under its jurisdiction so it can better manage the resource. In the northern part of the city the flood plain has been acquired through dedication to the city by the various property owners and developed with trails under the city's Greenway Plan. A similar use would likely result in the area of the current proposal when enough of the area in the flood plain is in the city. Services and Utilities. The property owner presently receives sewer service through a local improvement district of the Unified Sewerage Agency, The bulk of the area in that L.I.D. has since been annexed to the city and maintenance passes from U.S.A. to the city. Adequate water is currently provided to the site from a deep well. The property owner would like to hook up to the Tigard Water District water system when it is extended to their area. Currently, the nearest district line is a 12- inch line in Durham Road. City police protection and other city services (except fire) are available to the site upon annexation. Fire protection is already provided to the area by the Tualatin R.F.P.D. which includes the entire city within its bo :daries. Findings. Based on its investigation the staff found that: 1.
