2. City of Tigard Ordinance 77-20 (February 28) 1977) directs

III . CONCLUSIONARY FINDINGS
1. There exists a public need to apply City of Tigard zoning to
all parcels of land in the city in order to ease the adminis--
r., tration of land use regulations.

2. The proposed R-7 zoning district is compatible with the sur-
rounding zoning and conforms to the 'Urban Low Density Resi-
dential" policies of the Tigard Community Plan , 1971, in that
it limits the maximum overall density to four dwelling units/
acre, and with the attachment of appropriate conditions, the
adequate provision of safe street access 'to serve the proposed
development can be assured.
3. The R-7 zoning is the most appropriate "designation due to
there being no apparent development constraints and the need
to efficiently utilize buildable lands in the urban area. t ' ,
IV. STAFF RECOMMENDATION:
Based on the staff observations and conclusionary findings, the
staff recommends approval of the request subject to the following ,
conditions

Gentlemen:

We propose effecting an R-7 zoning with conditional use to build two
1 duplexes and two single family dwellings . Our reasons for this request
are as follows : "
1. The property Contains 1.29 acre or 56307 sq. ft . , which would
allow development of Si x single family lots at R-7 density. For
this reason, we are requesting a conditional use as part of the
zone change request to allow a total of six dwelling units on the •
' property--two duplex lots of 11, 160 sq. ft . and 11, 178 sq. ft .
respectively, and two single family dwelling lots of 14,274 sq. ft .
and 14291 sq. ft . respectively.
2. We are advised that Washington County needs 25 feet off the
frontage to make a 90 foot roadway on Durham Road. We are willing
to give this 25 feet to the County. However , giving 25 feet,
'
together with the fact that the pvoperty line is the center of
Datham Road as it now exist , makes a total of 45 Feet off the
ifn
216 ft frontage or 9726.75 sq. ft. loss of area. Therefore , out
proposal is the only economically feasible way we can utilize the
; balance of the land area .
3. We have contacted owners of adjoining properties as well as
, their engineers who are working on subdivision plans based OA
zoning. The manner in which these subdivisions are being platted
do not offer any possibility for connecting out small parcel with-
out usurping a large portion of our property for street purposes,
Furthermore, we understand that development of these adjoining
'
properties is projected at least a year in the future .
4. Even though we are requesting R7 zoning, we believe that the
larger lot sizes are more in keeping with the Tigard area in
. general, that the proposed arrangement will not adversely effect
Summerfield across the way, and does not cnnflict with plans for
•
subdivisions of adjoining properties,
5, Our proposed zone change request to rt,-7 is ift conformance with
the adopted comprehensive plan for the City of Tigard.
6. Having given prolonged and serious thought , as well as having
had lengthy discussions with our engineer , we know of to alternative
to our proposal which would not result in a severe hardship and
economic deprivation.
