Absent: None, 3. APPROVAL OF MINUTES • A. The minutes of the December 18th„ 1973 meeting were approved as submitted by unanimous vote of all Commissioners present. 4. PUBLIC HEARING - Zone Change 4.1 Zone Change - ZC 6-73 (Mayernik) A request: by Michael & Lucy Mayernik to change existtng parcels from R6.79 Single Family and C-2, General Commercial zoning dAlEignetions to 4 C-39 General Commercial zone. Applicant proposes to construct a restaurant on the site located on the northeast quadrant of the S.W. Pacific Highway and S.W. 69th intersection. The site comprises 1.01 acres. (Tax Map 1S1 36AD9 Tax Lot 4300), A. Staff Findings The staff presented a list of 14 findings evaluating the request • according to the Fasano requirements and the suitability of the site for a proposed restaurant. B, Testimony & Cross Examination - Public Hearing opened. 1. Terry HoUck, the applicant's Attorney, spoke for the request providing the ollowiag points of justifications a. That the request conforms to the Tigard community Plan which shows the subject property for cotninercial use. • b. The parcel now zoned for single family is inappropriately zoned based upon the Tigard Community Plan designation and the existing development pattern. c. The staff's concern for traffic problems generated by this change in one is not justified in thal: the left hand turning lane and the proposed signalization of the S.W. 69th ittersectiOn were got considered in the repOrt. % ,4 t 0 d. Phe staff's finding that no access should be permitted from Pacific Highway onto the site is unreasonable in that the turning lane is provided for left hand turns and other properties along the highway have been granted direct atcess. e. The applicant realizes that the majority of difficulties arising from development of this site is related to the existing strip zoning and its proximity to a residential area. The applicant therefore is willing to use all nece,ssary means to avoid conflicts with adjacent residential zoned properties. f. The majority of traffic from the site will be channeled to S.W. 69th Avenue to meet the Tigard Community Plan's concern for using access streets where possible. g. The property is presently being leveled to bring its topography into conformance with the adjacent TexFAeo property which has .! previously been brought to the level of Pacific Highway. h. Statements in staff .anding number 8 are inconsistent with the conclusion that the proof for a community need for a King's Table type restaurant has not been met. i. In reference to the staff's concern for light emanating from the site, the proposed use has closing hours of 9s00 P.M. and is elosed on Sundays. The King's Table management realizes problems resulting from litter And pledges to keep the site as clean as possible, but points out that litter is a problem resulting from em actions of people not the management. While the King's Table management admits that odors will be emanated from the restaurant, they intend ot'l. disbursing them away from the residential area. J. A letter was ptesetted from Mr. Calton, the owner of Tax Lot 42009 adjacent to the property in question, ,stating that he does not object to the looati.on of the King's Table Restaurant on the Mayornik property. • •• k. Mr. Rouok stated th,!a, there is a degree of uncertainty as to whether the actual user of the property, if the zone is changed as requested, will be an International King's Table Restaurant. This is because the sale of the property is conditional upon the granting of a building and 'sewer permit by the City of Tigard. It appears, at the present time, there may be some difficulty it obtaining the necessary sewer permit. 2. Cross ExaMitation So Commissioner Ball stated that in light of the possibility that the site may not be used by International king's Table that a good deal of the testimony which had been presented relating to this use really may not be pertinent to the eventual use of the property after being changed to a commercial tone. The parcel now zoned R-7 was a separate tax lot at that time. co Bali asked what improvements were presently located on parcel A. d0 Mt. Houck stated there is presently a garage on this site. e. Bail stated that he was confused as to why the site had been graded down to the level of Pacific Highway preceding approval of the requested zone change. f. Mr. Houck stated that the sale contract had been tegotiated prior to the staff report and this included grading of the site. g. Ball thiva asked what impact the zone change would have upon the adjacent residential area in terms of preesure for additional changes to commertial zoning. h. Mr. Houck tcplied that he felt there would be no ptecedence set by changing parcel A from residettial to commercial in that it represents the extent to which cOmmettial development could logically expand from the highway. 3. Proponent e a. Mt. Howard Smith spoke in favor of the request stating his concern that when the property was annexed that the staff appeared at the Boundary Review Commission meeting argaing for annexation to the City but presenting tone of the concerns presently being voiced. He ttated that, at the time of the annexation, he had appeared at the BRC heating attd spoken against the request using many similar atguments tow being ustd by the staff. He stated, hwevet, that despite his objection to the annexation, he is in faVor of an Intetnational King°s Table Restaurant being iodated on the site in question. Re stated that he and his neighbors find this type of use the lesser of its when considering other Uses which could be placed upon the site. 1 40 Cross Examination a. Ball said that without a market analysis the. number of restaurants in the vicinity is really irrelevant and tilAt we don' t know how many restaurants of any particular type could be, supported in this area. For instance p maybe the 18 a market for 10 or even 11. Without the necessary market data, Bali stated, we have no way of knowing. / ' 4. The population of metropolitan Portland in 1970 was one million. The projected population by 1990 for the metropolitan area is 1.45 million. Page 2 • The population of the area surrounding the City of Tigard as well as the City of Tigard itself has experienced a substantial increase. The daily traffic count on Pacific Highway has increased from approximately 11,700 vehicles per day in 1960 to approximately 31,000 vehicles per day in 1973. The bulk of this increase has occurred in the past several years. The vehicles utilizing Pacific Highway was approximately 26,000 per day in 1971. To facilitate the increased use of Pacific Highway, a fifth lane has been added recently. The land use of the area in the general vicinity of the subject property has changed dramatically in the past ten years. Both the North and South sides of Pacific Highway have been ex- • tensively developed. In fact, the subject property is the only piece of property on the North hide of Pacific Highway that is undeveloped. These developments have all been either retail outlets or service oriented business, The subject property is within the Metzger Water District. The subject property is currently being serVided by the Metzger Water District. Any additional serviceg which would be required are available. sewerage serviCe in the area is provided by the Unified Sewerage A5'ency (hereit "USA") . At the present time, the subject property has two discharge connections. Additional discharge Units are questionable at this time, but will be available within six months. Portion A is rectangular shaped, having Aensions of 85 feet by 190 feet. The 85 foot boundary fronts the East side of S.W. 69th Avenue. Because of the configuration of the lot, combined with its location, it is not possible to utilize it for the permitted land uses. It is not suitable for residential purposes. 3 (e) . The two highways service the , major population centers in the surrounding area The ingress and egress from and to these highways is quick and safe. As such, the area lying between /-5 and Highway 217 is ideally located for service oriented businesses. In this area, the subject property (-. is the only suitable property which iS aVailable. The subject property has excellent visibility. It is eleVated, which allows it to be seen easily from Pacific Highway. Ptrthermore, patrons of the restaurant would have an excellent view of the surrounding area beCaUSe of the height of the property. The access to the subject property is egcellent. Pacific HighWay runs adjacent to the property. The applicant has not proven why the subject site is more suitable than other sites in Tigard zoned for the same purpose. Specifically, the applicant's submission leaves unclear whether other sites were considered for the proposed use. 10. The proposed on change and development is adjacent existing residential uses on both the west and north portions of the site The proposed use could have a detrimental effect on these ua if not properly designed. Increased traffic noise and lights emanating from parking lots, blowing debris and odors are all potential detrimental effects to the adjacent residential neighborhood. In addition, potential grading of the site to the level of Pacific Highway would adversely affect the traffic noise levels in the adjacent residential neighborhoods. The existing embankment adjacent Pacific Highway shields the residential neighborhoods from traffic noise generated by Pacific Highway traffic and its removal would create increased neighborhood noise levels. The applicant states that landscaping and screening would be sufficient to alleviate conflicts between the proposed commercial use and ivisting residential uses The staff contends that landscaping and screening is not sufficient protection against noise and that adverse impacts exist that are not considered by the applicant. Consequently 0 the staff finds the applicant has not described all the adverse effects the subjett proposal will have on adjacent neighborhoods nor has the applicant proven that said effects can be alleviated. 116 The site is served by water, sower and utility serVice8 necessary for developMent. A shopping center eXists on the southeast quadrant, and there is vacant commercial property on the southwest corner 4. The site is surrounded on three sides by residential zoning and residential development. The vacant commercial property to the south is divided from the site by a major highway, and accordlne,iy the request will not compatibly relate to either the zoning pattern or to the existing or porposed land uses. In addition, if the zone were changed to C-2 (8-4), any use permitted i n „ that zone would be permissable on the site. 1 i 5.
