The City as i
y initiated and.. there is now Pending proceed-
inks to conform the Derry Dell zoning area, which, prior to its
annexation, was subject to County zoning jurisdiction to •
• conform to the City' s zoning ordinances . In this connection ,•
. the question has been presented as to whether the residential
. ' portion of the Derry Dell area heretofore zoned by the County
R=-7 can be rezoned to City R-15 residential classification
as a mart of the transition from County. to City zoning.
It is the opinion of this office that the transition of the
large area from County to City zoning; jurisdiction involves
legislative powers to be exercised by the City Council whereas
the change in zone classification from R-7 to R-l5 involving a •
limited area of the total Derry Dell annexation would be cones
sidered the exercise of a quasi judicial function. Thus, it is
our otitlook tat the transition from County zoning should be ,
first made the most compatible City zoning classification
and thereafter any rezoning should: be accomplished, in accord--
ance with the quasi Judicial requirements of the Fasano decision.
It is my understanding further that there is a need to
review the community plan in the light of the actual develop
meat of this area and, perhaps this should be accomplished before
any attempted rezoning is undertaken.

2. Tigard Municipal Code, Section 18.12.020 Anne actions states the
following:
rezoning regulations applicable to an area prior to annexation,to the
city shall continue to apply and shall be enforced by this City
until a zone change for the area has been adopted by the city council..."
3. Generally, the proposed zone changes involve a strip of commercially
zoned land adjacent S.W. Pacific Hi'ghway averaging approximately 200
feet in depth along S.W. Pacific Highway two areas of multi-family zoned
land adjacent 5W Park Street and SW Gaarde Street and situated betWcen
the commercially zoned land and 'the remainder of the "Derry Pella neighborhood
Which is zoned for single family residential Use. Land across SW Pacific
Highway from the subject area is zoned predominately C-3, General Commercial.

4. The existing land use pattern within the subject area is described as
follows:
Adjacent SW Pacific Highways Mixed commercials residential and
vacant lend. Some older single family houses mixed with gas ,
stations (3), an equipment rental store, and a used appliance firm.
Interior of "Dirrry Dell" area is predominately single family residential.
5: The 'bard Community.Plan designates a strip of land approximately,
.. 1000 feet deep along SW Pacific Highway for residential-commercial use, the
Plan

The Plan designates the remainder of the neighborhood Urban tots Density
Residential, the Plan stating "the predominant use in these areas will be

Objectives, Policies and Standards for each of the aforementioned Plan if
designations are described in the Plan document.

"Derry Dell" neighborhood Will be included within the
neighborhood plan area now scheduled for a planning effort commencing
next month and scheduled for completion in October, 1974.
7. The existing County toning designations and the City zoning designations
are roughly equivalent with the following exceptions:
County RU-20 (old A-2) - allowable density 27 units/net acres
based on building type and' lot coverage: "
City A-2 allowable density 12 units/gross acre.
County B-4 (old Cy2) General Extension Commercial District,
permitted uses: Any Retail Business, Panting Garages & Passenger
Terminals; Wholesale Businesses; Manufacturing and Processing; provided
their entire output is sold on the promises; Building Supply, Equipment
