Uffelman, Boise Cascade Building, Portland, who is also the secretary of the Astro Tool Corporation, the business which would use the facilities proposed. He questioned the real significance of - the zone change from M3 to M4, but asserted the Fasano standards are met in this case. He pointed out that while, as paragraph 2 of the Staff Recommendation states, "The structure is encroaching into the greenway, which violates the City's • Open Space Ordinance", Section 18.57.041 Cl) provides for an exception process for structures, and he submitted the proposed plan is an architecturally sound design in an area zoned for the ihtended use. There was no PUBLIC TESTIMONY. COMMISSION DISCUSSION AND ACTION. Extensive discussion took place among - the Commissioners and Staff. Howard emphasized the precedent that allowing even • this small encroachment on the greenway would establish, and pointed out the • imprecise nature of the data on flood levels. Fund, Wood, Speaker and Kolleas opposed the recommendation for denial. Wood outlined the reaSons for the recent • change in the floodplain ordinance which permits certain encroachments. Tepedino suggested consideration of alternatives such as two stories, rearrangement of utilization of land above the floodplain, compensating excavation to preserve flood storage capacity, etc. - The President asked Commissioner Wood if he could frame a motion with conditions suggested by the preceding discussion. At this pa:I:it Selby offered suggested conditions appropriate to an approval of the applicants request. Wood thereupon MOVED for preliminary plan approval of ZC 251.79PD and Special Permit M 7-79 based on findings that the applicant has demonstrated that the design of the building i8 compatible with the greenway plan of the City in the context of a planned unit development. Approval is granted with the following conditions 1. That all elements of the General Plan and Program be included in the application prior, to review befor e the Planning commission. 2. Surrounding land uses consists of multifamily units to the west across the greenway, industrial uses to the north and east. To the south is a single family house and vacant property. The surrounding properties are designated "Industrial Park" on the north, east and south, The western area across the greenway is designated residential and multi- .- family. 4 4 4. 7. The subject site is 220 feet south of the existing sewer line on S.W. Bonita. It is physically possible to install the line and ample capacity for the service exists. Water service is available to the ' site. S. Traffic circulation to the property will be served by S.W., 74th which fronts the subject property. S.W. 74th is a city street and it is designated as a local street on the NPQ #5 Plan. The street is in substandard condition having inadequate, paving width, no curbs or sidewalks and five additional feet is necessary for street width. 9. The total amount of reduced storage capacity in the floodplain is fifteen, (15) cubic feet. The area of floodplain that the pilings will occupy is the storage area where no water glow will be affected. (see attached special use application for details) 10. The project Will extend into the greenway. The structures will cause some displacement and interference of the water surface. . II. CONCLUSIONIIRY FINDINGS: 1. The proposed land Use is in conformance with the "Industrial Park" • zoning and designation. • . 2. The encroachment into the greanway area is in violation of Policy 47 (page 13) of the Environrrental Ettli.Mand Cpen, Space Plan 4 3. Map #25il2A `4YN MEMBERS OF THE COMMISSION: The property in question, T.L. #900, was purchased by its present owner February 15, 1979 with the intent of relocating a manu- facturing business from California to Oregon. Specializing in the manufacture of t1toolst1 for the electronics industry, the business has been continually expanding to the point that new facilities are re- quited. Classified as light manufacturing, the processes involved in the proposed facility are tlenvi.roitztentally clean!, with no objectionable effects resulting therefrom. Since much of the work is handcrafting and assembly, the owner is planning access and facilities for handl,. capped employees. In looking for a new site the owner was directed to this property and the flood plain statistics regarding the parcel were revealed at that time. The total parcel was represented as .90 acres and the Itbuiidablett area being .28 acres or 12,196 sq ft. Since the ownerls intention was to build 9,000 to 10,000 sq. ft. to house the business plus some lease area to provide for future expansion, the site seemed to present no problems and negotiations were completed to effect the transfer of property. Subsequently, architectural studies were undertaken to develop the new facility and the problems surfaced. With a lot width of 1001 and a side yard setback requirement of 201 each side, 40% of the otherwise buildable property becomes immediately unusable.
