- 9. CABLE T.V. AGREEMENT
(a) City Administrator reviewed the history of the cable T.V. issue over the
past year and explained that at this point there is a draft inter-govern-
ment cooperation agreement which will form a Commission of representatives
to request and evaluate proposals. He pointed out that this would save
money by sharing costs and provide a higher degree of expertise than Tigard
could acquire on it's own, He requested that Council review the proposed
agreement and suggest any amendments. n 1.
(b) After discussing the provisions to allow the City to pull out of the
agreement (at any time on 10 days notice), Council requested that this
be placed on next week's agenda.
10. DESIGNATE CITY OFFICIAL FLOWER
(a) Mayor explained the request from the Garden Club and pointed out the silk
sample and catalog pictures of the flower.
(b) Consensus of Council to place this on next week's agenda and to invite
Garden Club members to attend.
11. UPDATE Off' TIGARD - METZGER ISSUES
(a) Planning Director reported that representatives of Metro, Washington
County, Metzger and the City had met to discuss the Metzger issue. He
went on to say that the Washington County Urban Planning Area Agreement
would be signed Tuesday and that the City may be requested to present a
proposal to. Metzger regarding provision of City services. He concluded
by saying that the proposed growth boundary would remain at Pfafflu,

SHIP STRUCTURE
Via) Planning Director reported that the request for a change in this system
' had come from the NPOs due to declining participation. He explained
that this amendment would reduce the membership from 12 to 7 and would
delete the requirement from petition signatures. He concluded by recommend-
- ing approval,
(b) Council discussed their desire to retain the petition requirement to
,. validate the person's representation of the community# Consensus of
Council to amend and place this on next weeks agenda.
3 - GAIN REID PROJECT ON KATHERINE STREET
(a) Planning Director reported that Tax Lot 200 had been partitioned in,
Washington County Circuit Court by a divorce decree (into tax lots
200 & 201). He stated that the City had not been informed of this
action. He went on to report that the proposed development on t:a}t'
lots 100 and 200 Would have only office spaces facing the reaidentiai
neighborhood.

(b) Council discussed their recognition of the minor land partition by the
divorce court. Planning Director stated that he will request that the
developer go through the City's minor land partition process to clear
up the status of the lots.
14. WASHINGTON COUNTY MUSEUM
(a) Planning Director explained the Washington County request for a contri-
. bution to the museum fund from Tigard in the amount of $2,500.
(b) Consensus of Council to refer this to the Budget Committee.

15. ANNEXATION OF LANDS TO THE TIGARD WATER DISTRICT •
(a) Planning Director reported that this will provide for automatic annexation
to the Water District of lands which are annexed by the City, He recom-
mended approval.
(b) Consensus of Council to approve.
16. OTHER
(a) Planning Director read a draft letter to Mrs. Sharp regarding John
Tigard House for the Mayor's signature. Council authorized sending the
letter,
(b) City Administrator reported that we are scheduling intervieWs with the

Selection Committee for .iudget Committee vacancy.
(t) City Administrator brought to Council's attention the memorandum regard-
ing Budget Committee meetings,
(d) Public Works Director reported that CH2M Hill has requested that the City
pUt pressure on the Corps of Egiteers to provide the information needed
in the CH2M Hill report. He indical!ed that the CH2M Hill report has been
waiting for this information for more ihan six months. Consensus of
Council to formally request the information from the Corps and attempt to
assert political pressure if that doesn't work,

With these facts in ~mind I formally request that my client
be given time on your March 10, 1980 agenda to present
testimony supporting Condition #4,+, Section 2 of Ordinance
No. 80, just as it was recommended for adoption from the
Planning Commission. In the alternative, I request that
the City Council reconsider the matter on the basis of the
record below, alone, without giving any consideration to
the public testimony at the council meeting, and that the
council be requested to make a journal entry in its official
record on reconsideration, that the decision as to Condition
#4, rendered on reconsideration, was made without regard to
the public testimony erroneously received in evidence. The
logical implication is that, without public testimony,
Condition #4 should remain as ordained by the Planning.

Dear Mr. Howard:
Enclosed is a copy of a letter from my attorney representing Mr.
• Reid in a request to be heard before the Tigard City Council in
an effort to correct the February 25, 1980 hearing illegality.
While Mr. Reid and the City Council may be able to reach an
amicable resolution of the disputed Item #4 , the "clock" keeps
• running on my previous zone change for the adjacent Tax Lot 100
and its subsequent eXtension. I clearly face an April 13, 1980
deadline.
Both Mr. Reid and I are in agreement with the conditions of Ordi-
nance No. 80 as it was presented to the City Council. Ordinance
No. 80 embodies all the terms of the zone change previously given

to Tax Lot 100. This previous zone change is also acceptable to
Mr. Reid and me.
In the face of an impending deadline, I would request that you
give me formal direction a8 to how I might protect and extend my
previous zone change, if the resolution of ZCPD-2-80 rung past
April 13, 1980.
If perchance this can be handled at a Staff level, please consider
this letter my formal request.

down which will only lead to further industry down the street. ..
3. That NPO 12 proposed office or light industrial be compatable
With the surrounding neighborhood and is to be single story,
Howard Baker, 12065 S.W. Karol Court, Tigard, noted that industry has
moved into this area and it will keep creeping upon his home. He'd
like to try and get it stopped before it goes any further.
Ron Cole, 12085 Karol Court, Tigard, stated the area has many children
that play in the streets. All the property is zoned residential and
he would like to keep it residential. Asked Council to consider
the families that live in this area.

THE CITY OF TIGARD ORDAINS AS FOLLOWS
Section 1: Finding that the lands hereinafter described are now classified as
City of Tigard R-7 "Single Family Residential", and further
findings that pursuant to procedures, the abovestated application for a toning
map amendment was presented at a public heating held by the Tigard Planning
Commission on February 5, 1980. All interested persons were afforded an
opportunity to be heard at this public hearing and thereafter the Planning Commission
filed its report with the City Recorder, a dopy hereto attached and by referende
made a part of. The CounOil adopts the following substantive findings:
A. That this application is in donformance with the M-4 "InduStrial
Park" designation on the MPO #2 Plan which is a portion of the adopted
Tigard CO4prehensive Plan, and
B. That the proposed zoning is compatible with the surrounding neighborhood
as determinedbythe Tigard Planning Commission.

1. If substantial construction or development has not.taken place within

revert back to the present zone.

frontage for street improvement purposes.

in writing and shall include applicable drawings.
8. Grading plans on all public right-of-ways shall be submitted and approved
• by the Public Works Director prior to commencement of work.
9. Public water service and tianitary service shall be installed to this
site prior to the issuance of a Building Permit.
10. All existing or proposed utilities shall be placed underground.
Street lighting installations shall be approved by the Public Works
Director.
11. No Balding Permit shall be issued until the expiration of the twenty (20)
day appeal period from the date of approval.
12. Improvements may be bonded prior to issuance Of Building Permits.
13. That site and public drainage plans and construction be approved by
the hullOing and Public Works Department prior to issuance of Building

The Tigard Planning Commission on February 5, 1580 has voted to recommend
to the City Council that the above referenced project be approved subject to

1. If substantial construction or development has not taken place within

revert back to the present R-7 zone.
2. A half street improvement to local street standards be provided along the

a question by Kolleas it was explained that detached houses on 5,000
square foot lots would require a. Comprehensive Plan Revision, while
the present application comes in under a Conditional Use under existing
zoning. Smith pointed out that this parcel has already been graded,
with sewer stubs already in, and that therefore for cost reasons it
should be developed either with ten or twenty units.
The President called for a vote. On a roll--call vote the motion
failed, four to four. Voting aye were Popp, Tepedino, Kolleas and
Herron.
Speaker MOVED approval of Conditional Use CU 1-80, based on Staff
Findings and Recommendations, including Condition No. 9 calling for a
six—foot Fence along Lot 1300. The motion was seconded by Smith.
Further discussion centered on a compromise in lot size, which was
declared impossible Without a comprehensive plan change. Howard said
this development generates approximately 1;9200 in development, charges
for streets and parks.

CROSS EXAMINATION AND REBUTTAL: Mr. Reid addressed the storm
drain issue. In response to a question as to how many people would
be employed, he stated no definite figure can be given,

In an extended discussion Dewe Hamilton clarified that while
the NPO stated access to this property was to be through the adjoining
industrial park, the present development there precludes this access,
and consequently access must be off Katherine Street, ?,
The contents of the Warehouse were questioned, especially with
respect to toxicity and attractive nuisance aspects, Howard explained
the requirements imposed on any tenant which occupies the building,
but stated there are limitations on enforcement with only one code
enforcement employee. This Was not acceptable to Mr. Hamilton.
COMMISSION DISCUSSION AND ACTION: Smith led a discussion on the
. access problem during which various alternatives Were considered.
Popp got clarification of designations on the NPO #2 map, and the manner
in which enforcement of the low noise, low traffic, non—labor intensive,
. etc., provisions In Condition 4 are enforced. Reid described the type
of tenant he hopes to attract. Tepedino related discussions similar
to those tonight in connection with the first such warehouse project
on Burnham Street.
The President called for a motion, and smith MOVED approval of

5.5 ZONE ORDINANCE AMENDMENT, ZOA 1-80 (Chapters 18.72 and 18.56)
A request by the City of Tigard for a Zc)ne Ordinance Amendment
for Chapters 18.72 and 18.56 to allow the Planning Director
the authority to determine the continuation of Conditional
Use and Planned Development Districts when expiration occurs
and substantial changes have not taken place.
Howard presented revised wording of Chapters 18.560170 and
18.72,030 for consideration. Tepedino raised the question of what
objective measure might be included to eliminate the charge of "arbi
trary and capricious'. It was agreed no satisfactory objective measure
is practical. Smith preferred approval via a Staff process, but for
only six months rather than a year, which was agreeable to Staff. This
would require of the applicant a completely new application if substan-
tial progress had not been made in 18 months.
There was no PUBLIC TESTIMONY.
It was the consensus that the ordinances as discussed and revised
be submitted to the City Council for adoption.
OTHER BUSYNESS: Howard reported he has asked the City Council
to eliminate the Site Design Review Board. The reason is that an
appeal from the Planning Directorts site design decision goes on appeal
to the Site Design Review Board, whOse action is final„ No appeal can
be taken to the City Council. Howard's proposal, on the other hand, is
that an appeal from the Planning Director's decision would be appealable
(Y. to the Planning Commission W and thence to the City Council. In discus-
sion, Smith, an alternate member of the Site Design Review Board, stated
his belief the Site Design Review Board is not an effective body.
Howard suggested that annexations in the future be made with
zoning in accordance with the Comprehensive Plan. This would eliminate
one step. Mach Commission member would receive the staff Report as
submitted to the Boundary Commission for revieW prior to the Boundary
Commission hearing, together with the Zone Text Ordinance annexing
the property to comprehensive zone. This would give the Commission
members the opportunity y to have the applicant appear before the Cont-
i ' mission if it is thought desirable, for whatever reason. There was no
diesent expressed on the Commission.
After a general presentation of problems faced by the Staff in
day to day oprations, the meeting adjourned at 1130.

only single story buildings, in scale with the adjacent homes, should be
permitted. Vehicular access should be gained through the industrial park
rather than putting business traffic on Katherine Street. A change in zone
to permit this office use should only be approved as an M-4, Industrial Park
*Ars
Zone, with an overlying Planned Development Zone. This would ensure that
the property would be developed according to the site development plan approved
at the time of the tone change. A condition of the zone change should stipulate
that if the project i8 not constructed, both the M-4 and Planned Development
Zones will revert to the original R-7 Residential Zone. Once the planned
development has expired, the underlying industrial zone could be developed
with any of the uses permitted in that zone.
5. The subject is relatively flat and vacant. Surrounding land uses consist of
single family residence to the west and north, industrial warehouses to the
south and east.
6. Sewer and water are available to the site off SW Katherine Street.
, .
7. Traffic circulation will be available to the site off SW Katherine and T ga ra
Street. SW Katherine is a City street with fort: (40') feet of right-of-way
and is in substandard condition, has no curb or sidewalk and inadequate parking
Width. The NPO 42 Plan designates SW Katherine as a local Street.
II. CONCLUSIONARY FINDINGS:
1. The applicant has sufficiently addressed all the concerns of the preliminary
and general plan reqUirementS stated in Sections 18.56.020 and 18.56.030 of
the Tigard Municipal Code.
2 The plan indicates that Tax Lot 200 will properly blend with Tax Lot 100.
However, the two tax lots should be consolidated into one to eliminate restrictive
Uniform building code regulations.

3. The proposed use is in keeping with the NPO 42 Plan and the facilities are
available to serve the business with standard imProvements.
4. The applidant has expressed a desire to redeive approval of the general

plan and program level 11 possible.
III. STAFF R8COMMENbATION:
Staff recommends approval of the zone amendtent from R-7 to M-APD at the general
plan and Program level subject to the following donditions:

1. If substantial construction or development has not taken place within one (1)
year of the effective date of this zone change, the property shall revert
back to the present R-7 zone.
• 2. A half street improvement to local street standards be provided along the
Katherine Street frontage (to include meandering sidewalks and, if necessary,
• curb to protect the existing trees) prior to issuance of Building Permits,
3. Five feet of right-of-way be dedicated along the Katherine Street frontage
for street improvement purposes.
4. That offices will be the primary use, with secondary uses of warehouse business
subject -P.o the following critieria:
a. Low traffic generatos
b. Low generators of noise
o. Non-labor intensive
d. Uses confined to storage rather than manufacturing assembly and processing.
5. That Tax Lots 200 and 100 be consolidated into one (1) prior to issuance of
Building Permit.
6. No Occupancy PermiLs shall be issued until all cotiditions placed upon
this development by the City of Tigard have been satisfied and inspections
• verifying this have been carried out by the appropriate department.
7. No changes will be made to approved plans or ecifications unless formal

approved by that department. Application for changes Will be made in
writing and shall include applicable drawingS.
8. Grading plans on all public right-of-ways shall be submitted and approved
by the Public Works Director prior to commencement of Work.

toward the type of person who will require a small office and

We are requesting the zone change as we have purchased the
land in order to combine it with the tax lot next door, and

this will provide us with a large enough parcel upon which we can
• expand the unit development office warehouse planned for next
door. This will allow us to build and design a jingle unit

This area is designated M4 with a request for a planned

comprehensive plan.

Our marketing survey indicates that there is a need for a
facility that will allow a small business man to obtain
drive-in storage with a small office. This provides a needed
support facility for the communities retail businesses. It
makes this property a productive project enablihg .it to
produce many job opportunites and adding to the tax base.
4. Any changes in environmental, economic or social conditions
and/or changes in availability or public services, or access,
and/or any other aspect of community development Airectly
affecting the subject site that would justify the requested

Generally, Tigard and St Beaverton is beginning to have a
great deal of industrial) commercial and office development
creating a demand for support facilities of this nature,
Sewer lines have recently been installed to this site and

Immediately adjacent and to be incorporated into this
project is tax lot 100 whichas been zoned exactly as this
request. There was specific testimony at the zone change
hearing on lot 100 about this property as an additional phase
to its zone change . A pommbh access was. provided. betveen the
two pieces of property to be used in common when this pisce was
developed. iCkto
Behind both properties are high jack concrete walls of
existing industrial warehouse,' making it very poor property
for single family homes.
To the west is the existing house from which this property
was partitioned. There is only one residential home across the
Street. In addition we have kept the building almost completely
on lot 100 using lot 200 as a buffer to the residential area.
Our entrance i8 to the east of the residential buildings
so that any traffic generating noise would not cross in front
of the homes. We have kept the building mass toward the east
property line with the Maximum landscaping toward the homes.
We have also lowered the building adjacent to Xatherine to
expose the Minimum mass toward the street and residential area.
7. The types of public services necessitated by your proposed
development and the impact that your project may have on these
public services;
The buildingS will be predominately concrete with wood to
soften the lines in the office areas, minimizing the need for
fire and police protection.
Water and sewer lines are Installed. The use of these
facilities will be minimal since there will be few employees
and only a few bathroom facilities.
There will be little electric power requirement since
manufacturing will not be conducted,in warehouses the
lighting and heating levels are minimal.
Schools and parks will not be used in conjunction with these
facilities. Streets and roads will be impacted; however, they
are used primarily for distribution of goods to local users
which would Occur even if these facilities were found in
another area.

PLANNED DEVELOPMENT R-7 to M-4PD
I. Personal reasons for opposition to zone change.
A. Would de-value my property and make
it less desireable for a family residence.
B.
• Would create additional hazards for
my children by increasing traffic on the street and
in the area. I was hoping t0 avoid problems such as
this by living on a quiet dead end street,
into I I Zmpac t on Neighborhood
A. Taking into account the
g proposed sicle-
walk planned for the front of the site, I do notthink
this is adequate to avoid traffic hazards to the
many small children living on Kathrine street.
Many of them catch school buses on the very corner
that this increase in traffid will have its major
impact.
B.The
existing roads do not appear in my
opinion to allow sufficient access which a building
of this type would require.
C. I am concerned as to there dose ;nt
seem to state any restrictions in the staff report
as to what types of materials and/or machinery
will be or allowed to be stored on the site.A hazord-
ous condition which already exist at the industrial
park adjacent to the planned development.
