Re: BOUNDARY CHANGE PROPOSAL NO. 1942 - Annexation of territory to the •
City of Tigard. A
Proceedings on Proposal No. 1944 commenced upon receipt by the Boundary
Commissio o. of a resolution and property owner consents from the City of Tigard
an August 12, 1983, requesting that certain property be annexed to the city.
The resolution and property owner consents meet the requirements for initiat-
ing a proposal set forth in ORS 199.490, particularly Section (2) .
Upon receipt of the petition the Boundary Commission published and posted
notice of the public hearing in accordance with ORS 199.463 and conducted
a public hearing on the proposal on September 15, 1983. The Commission also
caused a study to be made on this proposal which considered economic, demo-
graphic and sociological trends and projections and physical development of
the land.
FINDINGS
(See Findings in Exhibit "A" attached hereto) .
REASONS FOR DECISION
(See Reasons for Decision in Exhibit "A" attached hereto) .
ORDER
On the basis of the Findings and Reasons for Decision listed in Exhibit ".A",
the Boundary Commission approved BOUNDARY CHANGE PROPOSAL NO. 1942 as modified
on September 15, 1983.
NOW THEREFORE IT IS ORDERED THAT the territory described in Exhibit "A"
and depicted on the attached map, be annexed to the City of Tigard as of the
date of approval.

On the basis of the study, and the public hearing, the Commission found
that:
1. The territory proposed to be annexed consists of two parcels totalling 2.83
ac. , one single family residence, an estimated population of 2, and is ,
evaluated at $99,100. i
2. The property owners desire to annex in order to receive city services. I
There are no plans to develop the vacant property at this time.
3. The territory is within Metro and the acknowledged rc , ,onal urban growth
boundary.
4. The territory is designated Urban Intermediate on the County Plan map, and
zoned RS-1, one-acre min. lot size. The territory is within the Tigard '.
+, Urban Planning area, the area outside the Tigard city limits within which
growth will be directed over the next 20 years. Washington Co. has agreed
to the city's planning area.
5. The city's comprehensive plan designates these parcels as Medium High
.. Density Residential. Under existin g zonin g, once annexed to the city, the j.
• parcels would be zoned A-20, 20 dwellings/acre. Under the new zoning
• ordinance which is being prepared, the zoning would be R-20, with the sane
number of units permitted per acre.
6. The territory which is developed (TL 1400) is served by a septic tank. Gravity
sewer to serve this parcel would connect with the Summerfield trunk line which ,
ends approximately 1600' south and 350' west of the southwest corner of
TL 1401.

8. The Tualatin Rural Fire Protection District provides fire protection to the
site Annexation to the city will have no effect.upon fire service as the
district serves the City of Tigard. There is a station just south of Fischer
Ra. , approximately one mile from the site
9. Police protection and other city services will be available upon annexation.
10. According to the UPAA between the City and the County, the City agreed
to annex the full right-of-way for roads contiguous to territory being * '
annexed to the city, rather than annex just to the centerline of the road.
The city has proposed modifying this annexation proposal to include all of
SW 108th, from Durham Rd. south to the Tualatin River, where the road ends.
The city's Public Works Director prefers to take the entire length of SW
108th, rather than just a portion of SW 108th to ensure control over road
improvements.
REASONS FOR DECISION
On the basis of' the Findings the Commission determined that:
1. The proposal should be modified to include all of SW 108th from Durham Rd.
south to the Tualatin River, consistent with the UPAA between the City and
the County.
2. The annexation is consistent with regional planning, county planning, the
4 city°s adopted urban planning area, and the property owner's wishes.
3. Annexation of the territory allows the property owners to go forward with
their plans in a timely fashion.

4. Annexation to the city is required in order to assure uitamate sewer service
to the site.

RESOLUTION NO 83 - 65
A RESOLUTION FURTHERING ANNEXATION TO THE CITY OF TIGARD OF THE TERRITORY AS
OUTLINED IN EXHIBIT "A" AND DESCRIBED IN EXHIBIT "B" ATTACHED (BREWER).
WHEREAS, "consents" in the form of a petition have been presented to
the City of Tigard requesting annexation of certain tracts of land presently
' contiguous to the corporate limits of the City; and `
WHEREAS, the consents in the form of a petition were signed by the
owners of said tracts of land; and
•
WHEREAS, The City of Tigard Council has reviewed the consents and set
the final boundary for the annexation as required by subsection (2) of ORS
222.170; and
WHEREAS, subsequent to the setting of the final boundary, the
consents of land contained therein represent "more than half of the owners of
Land in the territory, who also own more than half of the land in the
contiguous territory and of real property therein representing more than half ,
of the assessed value of all real property in the contiguous territory;" and {;
WHEREAS, the proposed annexation therefore is in accordance with ORS
222.170 and constitutes a so-called "triple majority" annexation under ORS
222.170 at a "minor boundary change" under boundary commission law, ORS
199.410 to 199.510.

proposed annexations and made the staff recommendation for approval

PUBLIC TESTIMONY
• Waynetta. Chamberlain 16720 SW 108th opposed allowing apartments on
the proposed property. Discussion followed regarding the
`.. Comprehensive Plan process. She was extremely disturbed that the
designation had changed on property that had been established through
the public hearing process and was again changed without them. being
personally notified. Lengthy discussion followed regarding the
Comprehensive Plan process and involvement in the Neighborhood
Planning Organization.
PUBLIC HEARING CLOSED
COMMISSION DISCUSSION AND ACTION
e Commissioners consensus was that there was basis to deny the
request.
• Commissioner Edin moved and Commissioner Vanderwood seconded to
approve Zone Change ZC 6-83 per staff's findings and recommendations.
Motion carried unanimously by Commissioner present.
6. OTHER BUSINESS
• Director of Planning and Development announced that John Butler had
been appointed to the Planning Commission and should be attending the
next meeting.

RECOMMENDATION: Based on staff's review of the annexation proposal, site
inspection and analysis of the Interim Zoning Map and
applicable plan policies, staff recommends that the
Planning Commission recommend approval of the annexation

On May 9, 1983, the Tigard City Council
F adopted the Comprehensive Plan Map by
Ordinance 83-24 which designates the property
medium high density.
VICINITY INFORMATION The surrounding property is developed as large lot
single family residential. The property to the
north is zoned A-20. The land to the southwest and
east ie atilt. Within Washington County.
SITE INFORMATION: There is a single family residence on the property, a
barn and some out buildings. The property slopes to
the south. There is a drainage swale along the western
edge of the property. There are several trees along
the drainage swale. The remainder of the property is
field grass.
B. APPLICABLE COMPREHENSIVE PLAN POLICIES:
2.1.1 THE CITY SHALL MAINTAIN AN ONGOING CITIZEN INVOLVEMENT PROGRAM AND
SHALL ASSURE THAT CITIZENS WILL BE PROVIDED AN OPPORTUNITY TO BE
INVOLVED IN ALL PHASES OF THE PLANNING PROCESS.
All property owners within 250 feet of the property were notified
of this application. In addition, a notice was published in the
Tigard Times on June 30, 1983. NPO #6 was also notified of this
application.
2.1.3 THE CITY SHALL ENSURE THAT INFORMATION ON LAND USE PLANNING ISSUES •
IS AVAILABLE IN AN UNDERSTANDABLE FORM FOR ALL INTERESTED CITIZENS.
All interested persons are given at least 10 days to offer written
;• comments on all planning applications. Interested parties are also

afforded an opportunity to speak at the pubic hearing on this
matter. The planning staff is available to answer any questions on
planning applications.
10.1 .1 PRIOR TO THE ANNEXATION OF LAND TO THE CITY OF TIGARD:
a. THE CITY SHALL REVIEW EACH OF THE FOLLOWING SERVICES AS TO
ADEQUATE CAPACITY, OR SUCH SERVICES TO BE MADE AVAILABLE, TO
SERVE THE PARCEL IF DEVELOPED TO THE MOST INTENSE USE ALLOWED*,
AND WILL NOT SIGNIFICANTLY REDUCE THE LEVEL OF SERVICES
AVAILABLE TO DEVELOPED AND UNDEVELOPED LAND
UNDEVELOPED WITHIN THE CITY OF
TIGARD. THE SERVICES ARE:

Water is available from an 8 inch line in S.W. 108th. There is no
sewer line in the immediate area Sewer will be available with the
construction by Tualatin Development Company of the TDC trunk
line. The site drainage could be handled by running it to the
drainage swale. S.W. Durham Road and S.W. 108th can be improved to
accommodate additional traffic "`f necessary. Police protection and
fire protection are available.
c. THE CITY SHALL PROVIDE URBAN SERVICES TO AREAS WITHIN THE TIGARD
URBAN PLANNING AREAS OR WITH THE URBAN GROWTH BOUNDARY UPON.
ANNEXATION.
10.1.2 APPROVAL OF PROPOSED LAND ANNEXATIONS BY THE CITY SHALL BE BASED ON
FINDINGS WITH RESPECT TO THE FOLLOWING:

D. CONCLUSION AND RECOMMENDATION:
The annexation proposal and zone change meet applicable planning
policies. Staff recommends that the Planning Commission forward the
annexation proposal to City Council with a favorable recommendation.
Further, staff recommends that the Planning Commission assign the A-20
zoning designation to the property to be effective upon annexation.

• A Resolution furthering annexation to the City of of
the territory described in Exhibit "A" attached.
WHEREAS "consents" in the form of a petition have been presented to the
City of requesting annexation of certain tracts of land
presently Contiguous to the corporate limits of the city; and
WHEREAS the consents in the form of a petition were signed by the owners of
o said tracts of land; and

0 0 would, by operation of ORS 199.510 (2), be automatically withdrawn from that

„ WHEREAS, the part of the territory that lies in the

WHEREAS, the City of Council has reviewed the consents

and set the final boundary for the annexation as required by ORS 199.490(2) ;
and
WHEREAS, subsequent to the setting of the final boundary the consents for

land contained therein represent "more than half of the owners of land in
the territory, who also own more than half of the land in the contiguous
territory and of real property therein representing more than half of the
assessed value of all real property in the contiguous territory;" and
WHEREAS, the proposed annexation therefore is in accordance with ORS 199.490)2)
and constitutes a so-called "triple majority" annexation and a "minor boundary
change" under boundary commission law, ORS 199.410 to 199,510.
NOW THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF 4,
a municipal corporation of the State of Oregon, at a regular session held on the day of 197 , that:
Section 1, The Council hereby approves the proposed annexation and
requests the CommiEsion to approve it and effect it as soon as possible.
Section 2 The City Recorder i8 hereby directed to file certified copies
of the statements of consent and of the Resolution with the Portland
Metropolitan Area Local Government Boundary Commission at once,
