SUBJECT: Elton Phillips — Ravine Issue 108th/113th
Mr, Elton Phillips recently annexed property located within the •
108th/113th Ravine into the City of Tigard. Tigard's Comprehensive Plan
• restricts development in the ravine since the Ravine is identified as a
significant natural feature in the Plan. To place a sewer line in the Ravine
Mr, Phillips must apply for a Sensitive Lands permit,
A problem has arisen since Mr, Phillips wishes to retain a portion of his
land which is within the floodplain, The City Code requires dedication of
"sufficient' open space for greenway, The staff has interpreted that this
means all lands within the floodplain must be dedicated, If the Council feels
that this should not be the policy that staff enforces, it should indicate its
preferred policy.
The pertinent policy reads in part as follows:

• PATHWAY WITHIN THE FLOODPLAIN4 IN ACCORDANCE WITH THE
ADOPTED PEDESTRIAN BICYCLE PATHWAY PLAN,

The question which the Council should address is, where development takes
place On property which includes the Ravine area, should all, area identified
as the floodplain be dedicated to the City? If not, what criteria should be
used to determine the eXteht of the dedication?

A RESOLUTION FURTHERING ANNEXATION TO THE CITY OF TIGARD OF THE TERRITORY AS •
OUTLINED IN EXHIBIT "A" AND DESCRIBED IN EXHIBIT "B" ATTACHED (Phillips) .ZCA 11-84B
WHEREAS, "consents" in the form of a petition have been presented to the City
of Tigard requesting annotation of certain tracts of land presently contiguous
to the corporate limits of the City; and
WHEREAS, the consents in the form of a petition were signed by the owners of
said tracts of land: and
WHEREAS, the City of Tigard Council has reviewed the consents and set the
final boundary for the annexation as required by subsection (2) of ORS
222A70; and
WHEREAS, subsequent to the setting of the final boundary, the consents of land
contained therein represent more than half of the owners of land in the
territory, who also own more than half of the land in the contiguous territory
• and of real property therein representing more than half of the assessed value
of all real property in the contiguous territory:" and
WHEREAS, the proposed annexation therefore is in accordance with ORS 222.170
and constitutes a so-called "triple majority" annotation under ORS 222,170 and
a "minor boundary change" under Boundary Commission law, ORS 199.410 to
• 199.510.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF TIGARD, a
muhicipal corporation of the State of Oregon, at a regular meeting held on the b
10th day of September 1984, that
SECTION 1: The Council hereby approves the proposed annexation and r% .
the Commission to approve it and effect it as soon as possible,

those present, voted to recommend to the City Council that the Council approve
a resolution forwarding the Phillips Annexation request to the Portland
Metropolitan Aroa Local QovernmeMt BoUndary Commission. At the same time, the
Commission voted to assign the R-2 zoning designation to the property in
conformance with the Comprehensive Plan, The R-2 zoning designation will be

A RESOLUTION FURTHERING ANNEXATION TO THE CITY OF TIGARD OF THE TERRITORY AS
OUTLINED IN EXHIBIT "A" AND DESCRIBED IN EXHIBIT "B" ATTACHED (Phillips) ,ZCA 11-84B
WHEREAS, "consents" in the form of a petition have been presented to the City
of Tigard requesting annexation of certain tracts of land presently contiguous
to the corporate limits of the City; and
WHEREAS, the consents in the form of a petition Were signed by the owners of
said tracts of land; and
WHEREAS, the City of Tigard Council has reviewed the consents and set the
final boundary for the annexation as required by subsection (2) of ORS
222.170: and
WHEREAS, subsequent to the setting of the final boundary, the consents of land
contained therein represent "more than half of the owners of land in the
• territory, who also own more than half of the land in the contiguous territory
and of real property therein representing more than half oF the assessed value
of all real property in the contiguous territory:" and
WHEREAS, the proposed annexation therefore is in accordance with ORS 222,170
and constitutes a so-called "triple majority' annexation under ORS 222,1.70 and
a "minor boundary change" under Boundary Commission law, ORS 199,410 to
199.510.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF TIGARD, a
• municipal corporation of the State of Oregon, at a regular meeting held on the
10th day of September 1984, that;
SECTION it The Council hereby approves the proposed annexation and requests
the Commission to approve it and effect it as soon as possible,
SECTION 2', The City Recorder is hereby directed to file certified copies of
the statements of consent and or the Resolution with the Portland Metropolitan
Area Local Government Boundary Commission at once.

the annexation request to City Council with recommendation of
approval and approve with the zone change from Washington County RS 1 •
to City of Tigard R-2 upon approval of the annexation by the Boundary
Commission, based on staff's findings and the following conditions.
1. The annexation proposal shall be reviewed and approved by the
Tigard Police Department.

2. All future development on the property shall be reviewed and
approved by the City of Tigard.
Motion carried unanimously by Commissioner present.

1. To secure sewer to lot #1100.
a. Unified Sewer .Agency System dead-ends approximately 30'
from my S/P corner of'lot #1100. This was to be extended
to lot 01100 by Tualatin Development Corp. (see Exhibit "E")
and the'nt fore I gave them an easement to cross my property
so they could complete the sewer to Summerfield Housing

Development. This was never done and at present is in
litigation in Washington County courts between Unified
Sewer Agency and Tualatin Developement Corp.

plans for only one additional unit in the near future, 108th Avenue has

The standards for approval for annexation into the City of Tigard are
set forth in Section 10.136.030 of the Community Development Code as

REASON FOR BOUNDARY CHANGE
1. To secure sewer to lot #1100.
a. Unified Sewer Agency System dead-ends approximately 30'
from my S/n corner oflot #1100, This was to be extended
to lot #1100 by Tualatin Development Corp, (see Exhibit "E")
and therefore I gave them an easement to cross my property

Development. This was never done and at present is in
litigation in Washington County courts between Unified
Sewer Agency and Tualatin Developement Corp.
b. If this is not clarified between these two organizations, j

to lot #1100 for connection to two proposed houses, with
permission of City of Tigard.

5. Best Use of Land

I believe the above proposal as to the future use of this

land would fall into general plan of expanding Tigard.
With all utilities relatively available, it can go only
one way and that is from open fields to residential, areas
and some multiple dwellings. It. is all around us, thus,
I am falling into the so called "plan of progress."
