3. Vicinity. _Information
The property involved in this request is surrounded by land designated
for low density residential development on the Comprehensive Plan Map.
The land to the north and west is undeveloped. There are single family •
. residences to the south and east.
4. Site Information and Proposal Description
There is one single family residence on the property. The applicant •.
lives in the home and has requested annexation to the city in order to
partition the 1.53 acres into three 1/2 acre lots. The applicant is F '
proposing to leave the lots remaining house and sell 1/2 acre lot to the

north and south of the property. Sewer is at least 800 feet from the
property. The applicant has indicated that percolation tests have been
done on the property to ensure that septic systems can be installed for "

the three lots. No evidence has been submitted to the city planning
staff which indicates the results of the percolation tests. Policy
10.1.1 of the City's Comprehensive Plan required that services be
available prior to development of newly annexed parcels of land. !

No agency comments objecting to the proposal have been received. The •
conditions recommended by commenting agencies have been incorporated
into the staff report.

BE BASED ON FINDINGS WITH RESPECT TO THE FOLLOWING:
a. THE ANNEXATION ELIMINATES AN EXISTING "POCKET" OR
"ISLAND" OF UNINCORPORATED TERRITORY;, OR
b. THE ANNEXATION WILL NOT CREATE AN IRREGULAR BOUNDARY
THAT MAKES IT DIFFICULT FOR THE POLICE IN AN EMERGENCY
SITUATION TO DETERMINE WHETHER THE PARCEL IS WITHIN OR
OUTSIDE THE CITY;
c. THE POLICE DEPARTMENT HAS COMMENTED UPON THE
ANNEXATION;
d. THE LAND IS LOCATED WITHIN THE TIGARD URBAN PLANNING
AREA AND IS CONTIGUOUS TO THE CITY BOUNDARY.

LISTED IN 10.1.1(a).
The property is presently served by the Tigard Water District. Sew.ige
disposal for the existing home will have to be considered as part of the
minor land partition ,app1ication. Sewage disposal for development on

the property at the pres4``it time, The City of Tigard Transportation
Plan designates SW 1.2

right-of-way width for major collectors is 60 feet, Currently SW 121st
has a 40 foot right-of-way. A condition of approval for the minor land
partition will be the dedication of 10 feet along SW 121st for
right-of-way purposes. The City of Tigard Police Department would not
be adversely affected by the annexation of one single family residence.
The Tualatin Fire Protection District already serves the property.

C. RECOMMENDATION
The planning staff recommends that the Planning Commission recommend
approval of the annexation request to the Tigard City Council and
approve the zone change subject to annexation of the property with the
following conditions:

A RI:SOLUTION INITIATING ANNEXATION OF TERRITORY TO THE CITY OF R2
This matter is before the Common Council of the City of 77a3je_p
hereinafter referred to as Council; and .
It appearing that:
1) The Council is authorized by ORS 199.490(2) to initiate an annexation upon
receiving consent i,n writing from more than half of the owners of land in
the territory proposed to be annexed who also own more than half the land
and real property therein representing more than half of the assessed value
of all real property in the territory proposed to be annexed.
2) The Council has received the necessary "consents" signed by the owners of
land in sufficient numbers to meet the so-called "triple majority" annexation
requirements listed above and set the boundary of the territory proposed for
annexation as authorized by ORS 199.490(2) .

3) The territory proposed to be annexed is presently within the \

parcels would be re uired to hook up to the public sewer system. If

distance is greater than 300 feet, septic systems, subject to Washington
County Sanitarian approval, are acceptable.

We own the 1 . 5 acre plot in what I believe is called the
Bechtel triangle ( previously owned by J . Kennedy and surrounded
4 by the Moores property) . We have been trying to sell the property
for almost a year with no success , We have spoken to Liz Newton
who informs us LhaL ii would be possible to bl.eak up this pro-
. perty into a 1 acre lot with a house and a . 5 acre lot of bare
land There is a septic tank , in excellent condition , close
to the house 'oh the 1 acre that we proposed to split off
from the 1 . 5 acre total .
Liz said that the break up would be possible with certain
constraints placed on the , 5 acre lot of be land , The constraints
would be with respect to the septic or sewer system for that 4
property, The present house was built in 1916 and has a good
septic system that does not reside on the . 5 acre plot we
wish to break off, This split will help us sell our house
and we would appreciate any help you can give us with breaking
away from the county to be annexed into Tigard .
before we rile to be moved from the County to the city we
would like some assurance that this split-up will be possible ,
