Proceedings on Proposal No 1882 commenced upon receipt by the Boundary
Commission of a resolution and property owner consents from the City of
Tigard on Se ptember 3, 1982 requesting that certain property be annexed
to the city. The resolution and property owner consents meet the require-
ments for initiating a proposal set forth, in ORS 199.490, particularly
Section (2).
Upon receipt of the petition the Boundary Commission published and posted
notice of the public hearing in accordance with ORS 199.463 and conducted
a public hearing on the proposal on October 7, 1982. The Commission also
caused a study to be made on this proposal which considered economic,
demographic and sociological trends and projections and physical develop-
went of the land.

Proposal No. 1882
. FINDINGS
•
Based on the study and the public hearing the Commission found that:
1. The territory contains 1.49 acres, 1 single family residence, an
estimated population of 1, and is evaluated at $70,500.
2. The property owner desires annexation to obtain sewer service for
his dwelling.
3 There are developed subdivisions to the east of the parcel. A
proposed development on a recently annexed tract (Proposal No 1766) ,
is located to the north.
4. The territory is within the acknowledged regional Urban Growth
• , Boundary. It is designated Urban Intermediate on the washington
County Comprehensive Plan. Current county zoning is RU-30.
■
5. The area lies within the city's NPO #3. The adopted NPO Plan did
not have a plan designated for this area The city is currently
preparing a land use plan for the area The city has an "active plan"
and is planning for lands identified within its Urban Planning Area
under the City/County Urban Planning Area Agreement. The county is
planning for the lands outside the UPAA. The city's proposed. plan
desiliation for the parcel is Low Density Residential.
6. The territory is located within the boundary of the Unified Sewerage
Agency of which the city is a part. There is an 8" sewer line approxi-
mately 100' south of the eastern boundary of the property.
7. The territory is within the boundary of the Tigard water District .
which also serves the city. There is a 12" main in Bull Mtn. Rd.
There is a 4" main in SW 126th and 6" mains in the Ames Subdivision
to the east.
8. Other services such as police, parks, and street maintenance would
be available from the city upon annexation.
REASONS FOR DECISION
Based on the Findings the Commission determined that!
1. The city has the sewer service available that is desired by the
property owners,
2. The City/County Urban Planning Area Agreement (UPAA) recognizes this
general area Will be provided urban services by the city. The
annexation is in accord with the UFAA.

22. YOHN MOBILE HOME/COOK PARK
(a) City Administrator reported that the Park Board considered purchasing
the mobile home, however recommended to the City Council not to
purchase at this tittle. The Park Board also recommended that the City
should have a caretaker on the premises and should continue to

CORPORATED LANDS WHICH ARE WITHIN TIGARD'S URBAN PLANNING AREA,
REPEALING ORDINANCE NO. 79-26, PRSCRIBING AN EFFECTIVE DATE,
AND DECLARING AN EMERGENCY.
WHEREAS, in the past, the City Council has 'attempted to
encourage annexations that would establish straight, compact and •
logical boundaries for the City of Tigard; and
-' WHEREAS, the City Council further finds that it is necessary
to establish a system for measuring the physical, environmental;
and social impacts of proposed annexation on the community, to
insure adequate staff review, and to insure compliance with the
requirements of Tigard ' s Comprehensive Plan, ORS Chapters 197 and
222, concerning annexation, and ORS Chapter 199, concerning local
boundary commissions; and
WHEREAS, in furtherance of the above olicies, the City

3. The City shall not approve the extension of city or
Unified Sewerage Agency (USA) sewer lines beyond the
Tigard city limits except where the annexation applications for
those properties have been submitted to the City or where a non-
remonstrance agreement to annex those properties has been signed
and recorded with Washington County and submitted to the City or
where there is a potential or imminent health hazard. In health
hazard situations involving land located in the Metropolitan
Regional Growth Boundary, the City is required by ORS 222. 850 to •
222. 915 to annex the affected area, unless an alternative plan .
to alleviate the hazard is approved. Therefore, property owners
affected by a health hazard annexation will sign and record with
Washington County a nonremonstrance to annex to the city and
1. submit the recorded copy to the City of Tigard.
4. The City shall actively seek to annex the areas served
by all new city or Unified Sewerage Agency sewer lines
that are contiguous with the city. •
5. The City shall accept, encourage, and assist in the
preparation of annexation proposals of all lands within
Tigard' s Urban Planning Area.
6. The City shall actively seek to include all "unincor-
poratdd island" areas into the city.
7. Land use designation and zoning shall be assigned to
proposed annexation areas only after a thorough study
addressing State-wide Planning Goals, city and neighborhood needs
have been completed and adopted by the City.
Section 2. PROCEDURE
The following process shall be followed in the applicaiUon and
• review of annexation proposals:
• 1. To ensure adequate staff review for annexation application,
deadlines shall be established. Applications for aftnexa
tion shall be filed with the city prior to 5: 00 p.m. On the last
Working day in either February, May, AugUSt, or November.
2. The city staff shall review the annexation proposal
applications and submit all required information to the
Portland Metropolitan Area Local Government Boundary Commission
With sixty (60) days after the application has been submitted.
Section 3. APPLICATION

1. A statement of the availability, capacity and status of
existing water; sewer, drainage, transportation, park,

2. A statement of the increased demand for such facilities
to be generated by any proposed development within the
annexation area.
3. A conceptual development plan which indicates the types
and intensities of proposed land uses, transportation
corridors, significant natural features and adjoining land uses.
4 . A statement describing any potential negative physical,
aesthetic and social impacts of any proposed development
on the community as a whole or the neighborhood.
5. A map to scale of area to be annexed which includes the
surrounding area, and. metes and bounds legal
description of annexation area.
Section 4. REPEAL
The City of Tigard hereby repeals its former annexation policy, 1 )
Ordinance No. 79-26, in its entirety.
Section 5. EMERGENCY CLAUSE •
Inasmuch as it is necessary for the peace, health, and safety of
the people of he City of Tigard that the foregoing change in the
boundaries of the City become a permanent part of the City' s
records, an emergency is hereby declared to exist, and ,this
ordinance shall be effective upon its passage by the Council, and
approval by the Mayor.

ANNEXATION FLOW CHART
This flow chart will acquaint you with the annexation procedures used by the City .
of Tigard. There are difficulties inherent in this sequence, but we will do .
everything
possible to assist you. Should questions arise do not hesitate to ,
contact us.
Step One. PETITION FOR AND CONSENT TO ANNEXATION. This "petition form" is
furnished by the City. Complete two copies of this form. Please
Note: if more than one person is a registered owner of the property
all names must appear with corresponding addresses for each tax
lot in question. Return two (2) copies of the "petition 'form" to Planning
Director.
Step Two. ANNEXATION RESOLUTION. An Annexation Resolution will be prepared
by the City Staff and presented to the City Council at a Regular
Meeting. Two things can happen at this point.. If the. Council does
not approve the resolution you will be notified stating reasons,
alternatives, etc. If the Council approves the resolution you will
be notified, and we will work together to complete the necessary
paperwork in preparation for review and action by the PORTLAND
METROPOLITAN AREA LOCAL GOVERNMENT BOUNDARY COMMISSION (PMALGBC) .
Step Three. TIME. Council usually acts on the resolution within' fourteen (14)

days. The average processing time is forty -five (45) days (but could
take up to 90 days) from receipt by the Boundary Commission for
approval or denial of a resolution.

SPECIAL NOTE TO DEVELOPERS. In an effort to speed up the development process we
have devised a "Fast Track." After submission of the "petition forms" and approval
of the Annexation Resolution by Council, and while you wait for action by the
Boundary Commission; We suggest that you present your development proposal to Our
