This letter is to confirm the Department of Land Use and Transportation's
position on Mr. Krueger's Winterlake development and conversations with
• Mr. Krueger, Mr. Monahan and yourself.
My understanding is that Mr. Krueger's development was approved May 20, 1980,
` by the Tigard City Council . There was no city requirement to improve SW
135th Avenue, which is a county road. Our records do not indicate that
Washington County formally required any improvements be made to SW 135th
Avenue, At that time, the Urban Growth Management Policies had not been

Because of the past approval , this Department has no objections to issuance
of building permits for Winterlake development. However, we will require
that approval of future developments that access `
SW 135th Avenue. ether
directly or indirectly be conditioned to ar.;sure the improvement of SW 135th

2. Background

3. Vicinitx_kformation
The property involved in this rezoning request borders Morning Hill
subdivision on the south, undeveloped property zoned R-20 (Residential,
20 units/acre) to the west, Phase I of Winter Lake to the north, and
undeveloped land zoned 4.5 (PD) (Residential, 4.5 units/acre) to the
east.
4. Site Information and_Exaosal Descriat_im
Presently, only part of Winter Lake Drive is completed and the remainder
of the property is undeveloped. The area proposed to be rezoned lies
south of Lake Drive and the proposed lots on Pond Court. To provide
better access to the multiple family development, Pond Court is proposed
to be extended to 135th Avenue.
The applicant states that due to poor economic conditions, the project
has not proceeded further. The original zoning designation is desired
with one modification. The zone change to A-12 involved a 14.7 acre
square at the southeast corner of the property. The acreage involved in
this request is approximately the same, but as noted above, the area
involved is somewhat different.

No agency comments objecting to the proposal have been received.
B. ANALYSIS AND CONCLUSION
In 1980, the City made a commitment to allow medium density development
not to exceed 12 units per acre. During the revision of the
Comprehensive Plan and Development Code, the property was rezoned to R-7
because final development approvals had not been granted. It was not
noted that the applicant had received City approval of the change three
years earlier.
This proposal does not require a plan amendment because the existing R-7
zone and the proposed R-12 zone are consistent with the Medium Density
Residential designation in the Plan. the site design and the
compatibility of the project with surrounding prOperties will be
analyzed during the Site Development Review process Which would 401100
an approval of the requested zone change.
Chapter 12 of the Comprehensive Plan lists a number of lodational
criteria on Page 79 that should be applied to this proposal.
The following factors will be determinants of density ranges allowed
• through toning in the medium density planned area
(1) The density of development ih areas historically toned for medium
density development,
(2) The topography and natural features of the area and the degree of
possible buffering from established low density residential Areas.

(3) The capacity of the services.
: (4) The distance to the public transits
(5) The distance to neighborhood or general commercial centers and
office business centers.
(6) The distance from public open space.
The property has been intended for Medium Density Residential since the
late '70's and a commitment to a density of 12 units per acre since
1980. Mr.! proposed multiple family development is to be oriented around
the small lake on the property and ample opportunities to provide
buffering should be available during the development of the site
design. An LID for improving 135th Avenue is intended to provide for
necessary improvements in conjunction with this development. Based upon
previous reviews of the project, adequate services are available to the
site Public transit is provided on Scholls Ferry Road. A Neighborhood
u� Commercial area has been designated nearby on the west side of 135th
Avenue and park land will bci available to the northeast as part of the
Winter Lake and Summer Lake developments.
The proposed rezoning appears to be consistent with previous land use o,
decisions made by the City and the relevant Comprehensive Plan policies.
C. RECOMMENDATION
The Planning staff recommends that the Planning Commission recommend
approval of Zone Change ZC 9-84 to the Tigard City Council.

b. Bob Wright, Project Engineer, recapped presentation made at
3/12/84 meeting noting that the construction will cost
approximately $1.2 million and about $800,000 will, be needed to
purchase right-of-way for the improvement. He stated that on this
date he learned that the State Highway Department is going to
construct the improvements on Dartmouth from 68th to 69th Avenues
and this area would not need to be included in the LID district.
Mr. Wright also suggested that if Council finds that some parcels
are already developed and wishes to withdraw them from the
district that would be appropriate at this time and would not .,
require a new public hearing. :.
Mr. Wright also stated he had talked with one property owner since
the last hearing, Mr. John Alexander, and discussed with Council
the concerns of Mr. Alexander.

:i have a serious problem and seek your assistance.
As per enclosed exhibits, I received May 20, 1980, from the Tigard Planning Comm-
ission plat approval with conditions on Winterlake. On June 25, 1980, City Council
endorsed Winterlake.
At that time I intended to begin phased development of Winterlake, but due to market '
conditions was prevented this endeavor.
The same problem confronted me in 1981 and 1982.
During the late fall of 1982, Century 21 Homes offered on 26 lots on a northerly por
tion of Winterlake and closed with me in December. Thereafter they renamed their
development Brittany Square. This initial purchase helped me temporarily solve cash
flow problems I had incurred. •
Lash year, October, 1983, Century 21 Homes defaulted on their second phase purchase,
Recently I have been negotiating with West Johnson Construction regarding the 12 acre
multi-family "pond site" for a joi.rit venture.

On August 21, 1979, the Planning Commission approved Zone Change, ZC 29-79a
and ZC 29-79b and directed the applicant to address the following issues -
Emergency vehicle :access, the drainage way issues and the floodplain issues.
A re-examination of the iloodplain was requested.
On February 5, 1980, the Planning Commission considered the Staff Report on
Special Use Permit, M 1-80 which addressed the floodplain, drainage way, and
ensrgency access issues raised at a previous meeting. M 1-80 was Approved
with the following conditions:
I. That the question of emergency vehicle access be resolved at the General
Plan and Program Hearing.
2. That site and public drainage construction plans be approved by the
Building and Public Works Department priorfto issuance of Building
Permits or Bonds.

Fro r apractical point of view, I would agree with the applicant that no floodpla n
exists on the site based on information from the Corps. of Engineers relating to
Summer Creek in that the Summer Creek floodp ain is not on the site„ However,
there are some lands immediately around the small lake and just up stream from
the lake which would be inundated during a 100 year storm depending on the desi97
of the controlled out fall structure. I my opinion, this is an insigaificent:
problem which can easily be addressed during the design stage. '
The hyd_aulCs of the drainage
ways are well thought out; accurately computed,
and then apparently partially enclosed within , a storm drain conduit„
The lake offers an excellent opportunity to accomodate stormwater runoff from the
proposed subdivis on in accordance with our storm water detention ordinance.
