Commercial St. Tigard, Oregon 97223 Gentlemen: This will acknowledge your letter of December 18, 1975 wherein you request Lake Grove to turn over to the Tigard Water District its facilities east of 1-5. In response to your request, please be advised as follows: • After the Lake Grove District was formed in 19G2 it bonded itself to the full maximum legal limit of debt to construct a water system. Construction was completed in late 1963. The system then constructed included the following components: 1. A 16" main from the center of the Palatine Hill Water District system. 2 A million gallon reservoir at Booties Ferry and Knaus Rds. 3. A booster pumping station at Terwilliger Blvd. 4. A 16" primary feeder main to the distribution system. 5. A distribution system of 12", 8" and 6" pipe with adequate valving and fire hydrants. it 6. Ail pipe installed is either cast or ductile iron except the 12 main along toots Ferry Rd. from S. IN. 72nd Ave. to Tualatin. The District in recent years constructed at its expense a supply connection to the Lake Oswego system as well; take Grove has two sources of supply, either one of which is adequate to furnish excellent service and fire protection to • the area west of 1-5 as well as the area within the District's boundaries. Water from both sources is pumped twice -- 8ull Run water by Palatinnand take Grove Lake Oswego supply by the City. The take Grove systnm furnishes water in the City of Durhm and maintains a standby connection to the City of Tualatin system. The Lake Grove facilities have been integrated for the benefit of an area much larger than that of Lake Grove alone, The service which has been and is now furnished to the 1300.008 Ferry td S,W, 72nd Ave. area Durham and standby for Tualatin has been possible because of the substantial debt incurred by the property owners of Lake Grove. The ‘,„ / -2- k, District obligated itself for principal and interest in the total amount of $1,001,336.84. As of December 1975, the remaining bonded indebtedness totaled $480,627.56 and will not be retired until 1984. The area west of 1-5 has not been taxed to pay for any portion of this obligation; it is only through the sale of water that Lake Grove can recover a portion of the bonded debt cost. This area, which now enjoys excellent water service, ha riot participated (except in a minor way through the purchase of water) , in the + great costs of supply, storage, pumping, and primary mains of the Lake Grove Water District system which makes the service possible. The higher outside rates for water in the area west of 1-5 help the District somewhat but not to the extent that it offsets the taxes being paid by Lake Grove. It is only by higher outside service rates that the District can recover a portion of the total cost of service to the area west of 1-5. Since the Dis- trict's bonded debt will not be retired until 19840 the residents and property owners of the District must continuo to rtmt those yearly obligations. If revenue from the area, west of I-5 were to be lost, an additional burden would fall upon Lake Grove residents and property owners. As it now stands, the , customors in the aroa west of T-5 are, by their payments for water and fire protection that the system provides, paying partly for the bas,Lc supply, , storage, pumping and primary distribution main costs related to the service they are getting without the payment of taxes. During the past two years Lake Grove has had to pay substantial sums for re- construction of its facilities in Carman Drive and the crossing of 1-5 because of the construction and widening of 1-5 and the interchange work related thereto. , These costs strainea the finances of Lake Grove, yet the work was done in a vonner which provided continuity of service to the area The Lake Grove Dis- trict owns and maintains all of the pipe lines and appurtenances crossing I-5, within the right's of way of Boone s Verry Rd. , S. W. 72nd Ave. and Peters Rd. The City of Tigard has no city owned water system. The Tigard Water District boundaries do not include the area in question, nor are they the same as those of the City of Tigard, From nowpaper reports over a period of several years, it appears that the Tigard Water District system is inadequate to properly serve its present customers let alone provide an extension to and adequately serve tho area now beinq well served by take Grove. The area in question now has excellent service which would not necessarily he the case if the Tigard District wore to purchase the facilities from Lake Grove ard then service the , area by an extension from its sytem. The existing Lake Grove facilities in- elude connections to Portland supply, the Palatine Hill Water District, the Lake Oswego and the City of Tualatin systems. Tualatin also secures it water fram • Lake Oswego. If the discussed and proposed supply development for east Washing- ton County from the Willamette River at Wilsonville i5 approved, financed and constructed, several years will elapse before completion of such a major project, It is our understanding that the Tigard Water District system is inadequate • to serve its present necls and further, because of controversy with one of your suppliers, the City of Lake Owego, the District has been notified that service fran the City is schaluled to be discontinued. {1 -3- ,. W. . ' 85th Avenue. Tigard Water District would have to bear the cost to extend , these pipe lines to existing mains. This does not mean that the water , i district will pay the cost to extend mains in front of anyoness property. - This cost is borne by individual property owners on request. We have found, however, that when a parcel of land is assured of being served ' domestic water and fire protection from a municipal source, its value , increases substantially. 1 If the Tigard Water District were to serve your area you would have ., P t to annex your property to the water district. Property annexe0 to the water district is subject to advalorem taxes. The district presently ,. has 8 tax rate of 38C per $1,000 assessed valuation and this rate has ‘ not been exceeded during the past 10 years. That is the creation of a more desirable environment by encouragement of a. Flexibility in land development. The proposed development allows a variety of spatial accom- modations for doing business for those activities that are uniquely oriented to the light industrial character of the area. b. The application of new techniques and technology in community devel opment. The project"is a "neighborhood service center" that will serve the needs'of the employees in the area. It employs the technique of screening the business from general traffic and view while offering easy access. c. The development of land use patterns with lasting values. By providing, for the basic necessities of the employees in the area both of the present and future viability of the area as a commerci is i al center s enhanced. Its orientation assures a steady clientele thereby contributing to a stable business climate. • d. Economies in land development. The proposed development p p aims towards achieving these econ- ()Mies both within the development and Within the community urn- rounding it. Within the development economies are achieved by the con- solidation of p reviously non-integral, non-related uses. When previously uses are drawn together into ohe larg- er parcel there is an overall gain in efficiency through larger scale design which can integrate the Uses as well as make them complementary. The provision of such a planned orable effects " ed un7 t has favorable outside the immediate area. The location of the site with respect to its market and the flexibility of the design make this an attractive place to locate e from a business p oi n b of View. This provides an alternative for thos e busenesses who might otherwise e b e forced to locate in a disorganized manner wherever they could find space. . 2. The proposed develoP►nent bears a high 'degree of conformity with Tigard's adopted comprehensive plan. Community Goal #5 is to conveniently locate shopping and business facilities with respect to their market ,area. The proj- ect is specifically designed to fill a need that is presently lacking in ,the area, the provision of basic, everyday goods and services to those employees in the immediate vicinity. The small grocery provides only the most rudimentary of supplies at prices that are not competitive with larger operations. Employees that ' do basic shopping on their way to or from work are therefore forced to travel greater distances or buy higher priced goods than would be necessary with a competitive facility. The same site uation applies to banks. Both U.S. and First National are locat- ed in Central Tigard. . Employees wishing to use banking facilities on their way to or from work or on their lunch hour must again travel a relatively long distance. Lastly, the same situation holds for food services. There are no restaurants to serve these employees located within a distance that can feasibly be traveled on a lunch hour. Community Goal #6 is the encouragement of the development of ` open space for commercial or industrial uses. The proposed dev- elopment will fill in what is presently a relatively vacant island surrounded by commercial or industrial activity. Its development for activities that will complement both the present and future commercial uses of the surrounding area not only fulfills this goal but does so in a more efficient manner than the haphazard development of such activities at other locations where they will not be so complementary. This pattern not only promotes such ai-•i ons w . , y. This p y p notes efficienvy but aids in the r p eservation of open space by making this partially developed area more attractive from a business point of view than p undevelo ed areas. The adopted Comprehensive Plan of Tigard also outlines object- Ives for general commercial areas with which the proposed develop- ment bears a high degree of uniformity. The area presently contains the grocery, a few single family homes, a junkyard and vacant lands :>. surrounded by modern commercial or industrial activities. Another such policy is to permit additional businesses that develop sites oriented to adjacent, side streets. As discussed the site was chosen partly because its location allows it to sup- plement its major clientele with drive-by traffic from 72nd and U pp er Boone's Ferry Road. This s supplementary clientele is ex- pected to increase when Boone's Ferry is widened west of 72nd. The Plan encourages the establishment of high design standards for appearances and the landscaping of setback areas. The prop- osed development will be replacing an older group of buildings. The land surrounding them is not landscaped but covered with a few trees and brush. As can be seen from the drawing the proposed . building and landscaping will replace this with ,a design more complementary to the immediate area in both its landscaping and architectural form. ' Lastly, the development strives to establish uniformity and a sense of continuity along the roadside. The present disjointed patterns of uses creates an island of haphazard development sur- I rounded by totally different and modern industrial and commercial uses. The proposed development on the other hand will employ the same simplistic, modern style as tho surrounding u.?es. The Tigard Comprehensive Plan also provides objectives, standards and policies regarding major intersections. The prop- osed development will occupy no such interL.ection. The first objective is the clustering of high intensity uses at intersections. The proposed development will consolidate and intensigy the relatively sprawling, disjointed pattern that pres- ` ently exists at this Intersection. second A S ` objective of the Plan is to minimize traffo congestion at major intersections. By internalizing the traffic flow generated by the project congestion will be kept to a minimum. The provision of offstreet parking will provide a situation pref- erable to that which presently exists. According to the Comprehensive Plan there are forecasted changes in the community which justify the requested action. The area is expected to grow rapidly and an integral part of such expectations is the provision of economic opportunities for its residents, both present and future. LOCATION: Intersection of SW 72nd and Upper Foones Ferry Road (Wash . Co. Tax Map 251 12D, tax lots 2100, 2200, 2104, and 2103) . APPLICANT: George Killian BASIC FACTS : 1 . The site is designated "General Industrial" on the Tigard Community Plan and zoned M-3, Light Industrial . 2, Surrounding land use is a warehouse and gas station to the east, a wooded lot to the south, a vacant lot and a building 1 under construction to the west . • 3 . The surrounding zoning is M-3, Light Industrial . 4 . The existing land use is a vacant lot with "Connie' s Market", a small grocery store, and two residences presently in use. 5. The topography is relately Slat, 6 . SW 72nd Avenue is designated an arterial in the Tigard COmmunity Plan requiring an 80 ' - 120 ' mipimum right of way with SW 72nd presently being 40 ' wide thus requiring an additional 20' in dedication, Upper Boones Ferry Road is designated an arterial on the Tigard Community Pl with the same right Of way requirements, FINDINGS : 1 . The applicant is requesting an industrial/commercial plan w . development which will replace the two existing dwelling units and neighborhood store and in their place locate retail commercial, • ffice, warehouse uses and possibly a branch bank, 2. Prom preliminary calculations the' appropriate number of parking spaces are being provided, 3. The parcel is 2, 11 acres, This appears to be an appropriate size for the small plan development as proposed, 44 The proposal conforms to the minimum lot size requirements of Section 18,484080 of the Tigard Municipal Code, ) 4,, a„ • Staff Report Agenda 5. 1 Page 2 5. Section 18 .48. 040 of the Tigard Municipal Code requires front yard setback of 30 ' . The site plan as shown is less than 20' . The rear yard setbacks. also requires in the same section are 20' . No mention is shown on the site plan, the north setback appears to be 20 ' . 6 . The internal circulation pattern appeals good especially as it relates to the circulation around the proposed branch bank and the separation of customer circulation and service circulation. .41 7. There seems to be a lack of concern for pedestrian traffic. No sidewalks are shown. 8. The general landscaping appears to be inadequate, especially in the parking areas, and no buffering of any type is offer- ed in this concept for the existing residential structures to the north. The proposed site plan shows paving up to the lot lines, Normally the code requires a landscape buffer. This should be adhered to in this case. 9 . SW 72nd is in a deteriorating condition. as is SW Upper Boone$ Ferry Road, 10, The turning movements and circulation pattern appear to be adequate according to the Fire Marshall . 11 . Question does arise to the adequoncy of the public services especially regarding water to this site. The applicant is proposing to hook onto the Lake Grove Water District mainline which serves this general area, As of present no master for their service area is on Tile (required by 1973 legislation for all water districts) . 12 . According to Joe Greulich, Tualatin Rural Vire Department the water line serving this site is inadequate in that it travels great distances with no loop back systm main- taining constant pressur6 and quantity to serve the area, The Ttgard Water District is the logical provider of water services to this area and such water service could be provided by an extension of the Tigard Water District line presently at the railroad tracks on SW 72nd Avenue and Durham Road at SW 79th Avenue, Connection to the Lake Grove Water line would require approval of the Port- land Metropolitan Area Locra Governtbent Boundary Commission as an extraterritorial connection. 13, No showing of sewage disposal is shown on the site plan nor provisions for public transportation , 14 .. Washington County Department of Public Works bas developed a proposed cross section of SW Upper Ooones Ferry/turham Road. This cross section envisions a 901 right of way, Staff Report Agenda 5. 1 Page 3 15. Although NPO #5 has not completed their plan for the area, they issued the following finding at their July 1, 1976 meeting "Commercial/Industrial land users are acceptable • at SW 72nd Avenue and SW Upper Boones Ferry Road but there is concern regarding traffic hazards and density of development as proposed". 16. The proposed site plan shows five access points. This appears to be in conflict with the goals of the Tigard Community Plan which encourage the number of driveways to be minimal .
