SIZE OF PROPERTY: 12.47 acres
STAFF RECOMMENDATION:
The staff recommends approval with the
conditions approved by the Commission.
PUBLIC HEARING: There was no one present who spoke in
opposition to the application,. 3/18/69.
PLANNING AND ZONING COMMISSION ACTION:
There was a unanimous vote of the Com-
mission to approve the zone change and Conditional Use
with the following conditions:
1. That the Planned Residential is approved
only in concept at this time; t.
2. That plans for the multi-family areas be
submitted for approval by the Planning & !,
Zoning Commission prior to the issuance
of a building permit;
3. That the number of multi-family units be
limited to a total of 15;
4. That access to the lot 12 not be directly
off Walnut St., but off the new road
which will be developed along the easterly
boundary of the property;
5. That access be guaranteed to lots 2 7
onto the public road shown on the westerly
adjoining }property; I'
6. That a guarantee for perpetual maintenance
of the le as an asset to the subdivision
be drawn up and approved by the City prig:
to the recording of the final plat;
7. That the easterly road be a 50' right-of-

This property/is located in an area Which we
feel, from preliminary c mprehensive planning studies, will
be a transition area, t is bounded by the industrial area
• on the east and north, and a busy arterial on the west. In
the future, the creek area can become a part of a greenbelt
system which can pro ide a natural "buffer" between it and
the industrial dist ict. Buffering old highway 217 is,
• however, a mre di icult problem, and one which may have• to be done by thcB,é property owners and developers along it.
Single family or olti-family development heeds not to be
greatly disturbe by the traffic if development ncludes

dense landscapin and/dt plans to back the units up to the
• highway with good site back yards.

• • We/feel that clustered development• of higher
L density than that Of the present will probably be the most
logical and economical se for this area in order to pro-
vide open sp ce for this kind of "bUffering" because of

A. Park Court Subdivision (Map #251 2BB, Tax Lot 400)
1. Mrs. Wled explained the staff recommendation for
a 10-ft. public walkway to Woodard Park on the
sewer easement between lots 6 and 7.
2. Mr. Bill McMonagle, engineer for the subdivision,
explained the proposal and agreed to the walkway.
He also asked who would develop the path. Mr.
• Thompson said the City would maintain the path
after the initial development.
3. It Was moved (Nicoll), seconded (Woodard), and
passed by unanimous vote of the Commission present
that the preliminary plat be approved with a change
showing the 10-ft. sewer easement as dedicated to
the public for a walkway into the City Park.

The staff recommends approval of this combina-
Lion application with the following conditions:
1. That the Planned Residential is approved
only in concept at this time;
2. That plans for the multi-family areas be
submitted for approval by the Planning &
Zoning Commission prior to the issuance
of a building permit;
3. That the number of multi-family units be
limited to 5 on lot one and 10 on lot 12,t
A 4. That access to the lot 12 not be directly
off Walnut Street, but off the new road
which will be developed along the easterly
boundary of the property;
5. That access be guaranteed to lots 2 - 7
onto the public road shown on the westerly
adjoining property;
6. That a guarantee for perpetual maintenance

ORDINANCE GRANTING A ZONE CHANGE AND APPROVING CONDITIONAL
USE WITH RESPECT"TO LANDS OF J. G. CHAMBERLAIN AND ARLENE V. CHAMBERLAIN in
Section 3, T2S, R1W, W.M. , WASHINGTON COUNTY, OREGON, FROM " WASHINGTON
COUNTY S-R" CLASSIFICATION TO "PLANNED RESIDENTIAL DEVELOPMENT" UNDER
"SINGLE-FAMILY RESIDENTIAL R-15" ZONE OF THE CITY OF TIGARD.
WHEREAS, the hereinafter described lands, by action of the
Washington County Planning Commission have heretofore been limited
• in use to those permitted by the "Suburban-Residential S-R" classi-
fication of the Washington County Zoning Code; and
WHEREAS, pursuant to prescribed procedures, the owners of
said lands have applied to the City of Tigard for reclassification
of said property from Washington County S-R (Suburban Residential)
to City of Tigard "Planned Residential Development" as a conditional
use under the R-15 (Single-family Residential) zone pursuant to the
zoning code of the City of Tigard; and
WHEREAS, said application was duly publicized and hearing held
on March 18, 1969 by the City Planning Commission, after due and legal
notice; and
WHEREAS, the City Planning Commission has approved the ;'Planned
Residential Development" conditional use and has recommended approval
of a zone change to R-15 (Single-family Residential) , subject to the
conditional use, and notice of City Council hearing thereon having been
duly given by publication in the Tigard Times, and the City Council
having conducted said hearing at its regular meeting of April 14, 1969,
the Council finds that said lands are well-adapted to and meet the criteria
for "Plated Residential Development" under the R-15 (Single-family
Residential) classification, subject to the conditions prescribed by
the Planning Commission; and the Council further finds that it is in the
public interest that said conditional use and zone change be approved an4
granted.
NOW THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:

"DESCRIPTION"
A tract of land in the Northwest quarter of Section 3, Township 2 South,
Range 1 West, Willamette Meridian, Washington County, Oregon described
as follows:
Beginning at an iron pipe which is South 89° 58' East 660.25
feet and South 00 28' West 449.51 feet from the Northwest corner

of said Section 3, and going thence from said iron pipe South
83° 27' West 101.04 feet; thence South 0° 41' West 1211.66 feet
to a point in the center of Miller's Ferry Road (county road
No. 494) ; thence along the centerline of said road North 63° 21'
East 33.07 feet; thence North 620 48' 20" East 80.95 feet; thence,
North 600 19' East 471.41 feet to a point• in the roadway; thence
North 07° 30' East 29.15 feet to an iron pipe; thence North 07°
30' East 483.66 feet to an iron pipe; thence North 22° 42' West
553.0 feet to an iron pipe; thence South 82° 14' West 257198 feet •
i to the point of beginning, containing 12.47 acres more or less and
excluding that portion of the described area within the public
roadway.

CONDITIONS •
•
1. That the Planned Residential is approved only in concept
at this time;
2. That plans for the multi-family areas be submitted for
• approval by the Planning & Zoning Commission prior to
the issuance of a building permit;
3. That the number of multi--family units be limited to a
total of 15;
4. That access to the lot 12 not be directly off Walnut Street,
but off the new road which will be developed along the
easterly boundary of the property;
5. That access be guaranteed to lots 2 7 onto the public road
shown on the westerly adjoining property;
6. That a guarantee for
g perpetual maintenance of the lake as
an asset to the subdivision be drawn up and approved by the
City prior to the recording of the final plat;
7. That the easterly road be a 50' right-of-way ending in
a cul-dewsac at lot 11 and that a "mutually non-exclusive
easement" be drawn up for recording for those access drives
serving lots 8, 9 and 10;
8. That park area be dedicated to the City in the northwest
corner of the property in order to continue progress in our
greenbelt system, such area to be delineated and then approved
by the Planning and Zoning Commission prior to the approval of

the final plat;
9. That a 10 ft. strip of land along Walnut Street be dedicated
to the public for future street improvement.
