Most of this site is underlain by Wapato silty clay loam (U.S. Soil Conservation Service classification) which is very poorly drained, has a seasonal water table at the surface or within one fdot of the surface, may have ponding in lowlying • areas, and is subject to flooding. The soil has severe low strength and a fluid seismic response, which could result in the partial if not total loss of bearing strength in the event of a major earthquake. The SCS characteristics indicate that this soil has severe limitations for support of dwellings and shallow excavations . • 2. The remainder of the parcel is underlain by Woodburn Silt Loam: with a slope of 12% or greater. This soil type has moderately severe low strength posing moderate to severe limitations for shallow excavations and moderate limitations for support of dwellings without basements. • 3. There is an earthen dam impounding a sizable lake (Lake Chamberlain) immediately upstream of the site. This structure • has no spillway to handle storm overflows and there is no ap parent channel or drainage for water below the dam, A major storm could conceivably cause the waters of the lake to rise sufficiently to cause an overflow and breaching of the dam, with resulting threats to the property and lives of residents below on the subject parcel, There is a legal question as to Who would be liable for damages in the event of such an occurence the City, the developers or the owner of the dam, 4. The proposed subdivision does not conform to the Com- prehensive Plan, particularly Policies #1; 2 3 and 5 of the Environmental Design and Open Space Plan, Staff is now in the pro- , cess of implementing this portion of the plan, and more stringent restrictions on development in hazardous areas such as this parcel are being developed, At the barest minimum, sites in sensitive areas will require a detailed development report prior to ap- proval (see Policy #6 of the Environmental Design and Open Space Plan) , • Recommehdatich This subdivision proposal ,Should be denied because it does not conform to several major provisions of the Environmental Design and Open Space Plan, and it poses significant hazards to property and human life, The applicants proposal shows little if any attempt to consider the very severe, and apparent , physical " w ' „ , • , A Page 2 limitations of the site. Only the portions of the site under- . lain by Woodburn Silt Loam are suitable for development, and even they may require special engineering to support dwellings . If this subdivision is approved, it should be conditioned to require hydrology, soils , and geological engineering reports by qualified engineers . Conditions should also require a de- tailed explanation of how dwellings will be especially designed and constructed to resist site problems. Also, provisions for the safety of the dwellings and residents in the event of a dam failure should be spelled out . The developer should be required to accept all legal liability for damages and injuries in the ** event of a darn failure be presented at the hearing, With regard to the Subarea #6 (southwest NPO #5' and southeast NPO #6) , the Planning Department has been contacted by the planning consultant for the City of Durham since the Hearing of September 12. Discussions with the consultant indicate that annexation of this entire subarea by the City of Tigard might be acceptable to the City of Durham if it had some assurance that it ' s advice on subsequent development proposals would be serious- ly considered by Tigard in its deliberations. The Tigard Planning Department therefore proposes the following new Implementation Policy be added to the Annexation Plan : "For parcels within the presently unincorporated areas east of Hall Blvd. (85th Avenue) in NPO #5 which are south of Durham Road or are contiguous to Durham Road, the City of Tigard will • give special consideration to the views of the City of Durham When decisions on development proposals are being made. This is an extraordinary condition that does not apply to other properties in the same vicinity. The dam within the Lake Terrace subdivision has pre-existed for approxi- mately 40 years: The lake provides a much needed storm detention system for the upstream drainage basin. The drainage course through the property and the topo- graphy is such that the buildable portions of the site are restricted to the extent that a degree of modification must be done in the land use to make this land productive for the use for which it is permitted. 2.
