Dear Mr. Howard:
This office has been retained by Ron Lautt regarding
the annexation and development of his property. He has
advised me that the property was annexed to the city on
the representation that an improvementodistrict would be
formed and that his property would be served by sewer.
He now informs me that the latest proposal for sewer
installation does not serve his property.
If this in fact is the case, he will be severely
damaged. Please inform me of the Status of the sewer
line installation.

Enclosed is a copy of Ordinance No. 79-31 which was approved by the Tigard City
Council at their regular meeting of April 23, 1979. This letter will su ►ercede
the one sent to you April 25, 1979 by this office in which a clerical ervor
occurred in listing the conditions. Your request was approved with the following
corrected conditions as set forth in the enclosed ordinance.
1. That USA sewer service be available for any parcel prior to issuance
of building permits.
2. That ten feet of right-of-way be dedicated to the City from lots 700
and 600 along the frontage ,of S.W. McDonald with half street improve
ments prior to issuance of building permits.
3. That five feet of right-of-way be dedicated to the City from lots 100,
101, 105 and 1000 along the frontage of S.W. 97th with half street
improvements prior to issuance of building permits.
4. Dead end streets will be prohibited unless the need can be justified.
5. No changes will be made to approved plans or specifications unless
formal application is made to the appropriate department and changes
are approved by that department. Application for changes will be
made in writing and shall include applicable drawings, engineering
specifications r.cations and other details requested by the department. No
construction shall take place in these instances until after the changes

Requests: For a zone map amendment from Wash. Co. RU-4 to City of Tigard R-7
"Single Family Residential".
Previous Action: The seven parcels were annexed into the City in January jointly
to develop. A Local Improvement District (LID) for sewers has
been formed.

General Statement: The Planning Staff feels that these five applications should be
heard jointly because of their proximity to one another. Staff
feels that there are no unique problems with any of the parcels.

I. Findings of Fact: •
1. The sites are designated "Urban Low Density" on the NPO 46 Plan which
alloWs four dwelling units per gross acre.
2. The owners are requesting zone changes in ordor to comply with the
ComprehenSiVe Plan. They Will individually begin to subdivide their
respective properties to create residential developments (refer to
attached narrative.)
3. Applicable NPO t6 PolicieS for reSidential development are as f011oWS: •

"Streets" - Polity 43 (page 3) collector and 16cal street standarda (page /1
"other services" - Policy 44 (page 3)
"Site character" - Polity 46 (page 4)
4, Lots 600 and 700 have existing single family units on the northern
portion and vacant open area to the south, Lot 601 it presently
vacant, Lot 1000 has a Single family Unit on the southwestern cornet
with open space to the north and east. Lots 100 and 101 have single
family units on the west frontage of 97th Avenue and open space to the
east Lob 105 is vacant. The ebtire topography tor this area aloes
slightly from southwest to the northeast.

Both streets are substandard, therefore, half street improvements

The Tigard Planning Commission on March 27, 1979, has voted to recommend to
the City Council that the above referenced project be approved subject to

MINUTES: It was moved, seconded and CARRIED that the minutes of the March
6, 1979, meeting be approved as submitted.
It was stated that what COMMUNICATIONS there were would be considered later

Previous Action:. The seven parcels were annexed into the City in January jointly
to develop. A Local Improvement District (LID) for sewers has
been formed.
Genetal Statement: The Planning Staff feels that the five applications should be
heard jointly because of their proximity to one another. Staff
feels that there are no unique problems with any of the parcels.
I. Findings of Fact:
1. The sites are designated "Urban LoW Density" on the N130 46 Plan which
allows four dwelling units per groSs acre.
2. The ownets are requesting zone changes in order to comply with the
CoMprehensive Plan. They will individually begin to subdivide their
respective properties to create residential developments (tefer to
attached narrative.)
3. Applicable NPO #6 Policies for residential development are as folloWst

5. The surrounding land uses are designated "Urban Low Density" and
9 are presently occupied with single family residences (some of
which are in the County) . •

6. The feasibility of installing a sanitary sewer line to service the,
seven lots is questionable. Installation of the line is pending
approval based on connecting ability of a private line from the
subject parcels south to 94th Court and S.W. Inez Street. Water
service will be provided by the Tigard Water District.
7. Southwest McDonald and S.W. 97th Street will serve as the major
circulation facilities for the sites. They are designated "collector"
streets by the NPO #6 Pian. Both are presently county streets and
are in substandard condition having inadequate paving, right-of-way
width, and no curbs or sidewalks.
II, Conclusionary Findings:
1. There exists a need to zone parcels that are within the city limits
to the City of Tigard Comprehensive Plan designation. .
2. Southwest McDonald Street is in need of ten (l0) additional feet

of right-of-way and S.W. 97th needs five additional feet or right-of--way.
,Both streets are substandard, therefore, half street improvements
are necessary.
3. Sanitary sewer connection remains a concern due to the physical
elevation of the land and the distance to the nearest line: A second
alternative to install sewer service woULd be to construct a pump station
