Commission Discussion and Action a. It was moved (Goslin) 9 seconded (Lewis) and passed by unanimous vote of the Commission present to deny the application based on the • staff findings: 10 The existing zoning does not conform to the adopted Community Plan. 2. The requested use does not conform to the Tigard Community Plan. 30 Approval of the conditional use permit would encourage the development of the southeast quadrant into freeway oriented businesses. 40 The Community Plan designates the northwest quadrant for a regional shopping center and does not designate any other freeway oriented business interchanges along Hwy. 217. 5a The proposed drive-in retail commercial use Would be incompatible with adjoining residential parcels to the south and would create traffic conflicts in the vicinity of Greenburg Road and the Cascade Industrial Park frontage road. 6 Non-residential uses on the southeast quadrant should be controlled and have access from 80W0 Shady Lane in order to minimize vehicular, pedestrian and land use conflicts. Pg. 4 - PC Minutes - September 21, 1971 ( 70 The Community Plan recommends planned unit development controls over all interchange development. 8. A survey of service stations within a 2 mile radius of the subject Site reveals that 8 stations have beeriVacated, -closed or converted out of a total of 39. 9. Standards in the Community Plan provide for other high intensity uses on quadrants which are zoned in nonconformance with the Plan, such as apartments, offices, medical • clinics, church%)s and community centers. Retail commercial uses, and especially drive-in retail commercial uses, should be discouraged along Greenburg Road. V. OTHER ITEMS A. Walnut Street Dedication 1. The staff recommends approval. 2. It was moved (Lewis) , seconded (Goslin) and passed by unanimous vote of the Commission present to • approve the street dedication. B. Villa La Paz Directional Signs 1. Pete Wilson Realty requested approval of three directional signs; one to be located at 91st and GreenbUrg; two to be located at Gre-enbUrg and Pacific Highway. • 2. Staff Recommendation a. The staff recommended approval of only one double faced directional sign at the nearest arterial (91st and. Greenburg) . by It was moved (Woodard) , seconded (Lewis) and passed by unanimous vote of the Commission present to deny the request. VI. ADJOURNMENT: 9:30 P.M. Pg. 5. PO Minutes - September 21, 1971 a. •, Tigard Planning Commission 0 Staff Report September 21, 1971 Agenda Item - Zone Chang2_2pd Sign Variance For property designated as tax lot 2101 on tax map 2S1 2BD ..422licant City of Tigard (on behalf of Walter Zwingli) A221,1.2p,nt' s Requ2st Approval of a change of zone classification from 0-3, General Commercial to 0-P, Commercial Professional and a variance of Section 156-7 of the Zoning Ordinance to allow a free-standing sign in conformance with the Sign Ordinance. The subject property contains approx- ., imately 6,300 square feet. Location and Land Use of Subia22s22111/ The vacant subject site is located on the west side of $,W. Pacific Highway approximately 120 feet southwest oi S.W. Walnut Street. Surroundirlg Zoning and Land Use The area surrounding the subject property is zoned C-3 and is developed with various retail commercial uses. The adjoining lots support a service station, market and commercial office complex. Staff Findingnd Recommendation The staff finds that the requested zone classification conforms with the adopted Community plan, that ingress and egress may be jointly provided for the subject property and adjoining service station over an existing easement, and that the proposed use will be compatible with adjoining land uses. The staff further finds that a variance from Section 156-7 of the Zoning Ordinance, which relates to sign standards in the Commercial-Professiona1 district, is • • justifiable because the subject site is not part The • a larger non-retail commercial office complex. The Zoning Ordinance sign standards in the C-P zone are intended for general, professional or administrative office complexes. The staff finds that strict adherence to the C-P sign standards is unfair to th9 property , owner and that the s,taildardar Sign standards of the nrdin.ance • should apply to the subject lot. It is recommended that the requests be approved. i• s., % • • • V'. 1 ' P w- PO Staff Report - City of Tigard - f4 .... ..., , , . . . . . . . . i v i \ Vi . . . , . . . . . (407 . .• , .. * . * . . CENTER ST..P.0, BOX 23006 Tigard, Oregon 97223 • September 7, 1971 . , MtMORANDUM, TO: President, Tigard Planning Commission FROM: Fred, A.Anderson SUBJECT: ZWINGLI VARIANCE APPLICATION At your request, I have reviewed a copy of deed of conveyance H from Walter R. Zwingli et ux to The Signal Companies , Inc. , with respect to a portion of Lot 38, North. Tigardville Addition, which . • is involved in a pending application fOr variance by Mr. and Mrs. Zwingli on the parcel adjoining on the Southwest. The deed reserves to the Zwinglis for the benefit of the • Southwesterly adjoining tract, the right to use for ingress and egress a strip of land 20 feet in width within the area conveydd to Signal Oil and running back 75 feet from the highway line. In like manner, the deed grantto Signal Oil the right to uee for ingress and egress a 20-foot strip adjoining the Signal tract with a run- back of 75 feet on the ZwIngli retained lands . The net effect of the reservation of the easement and the granting of an easement, is to create a 40-foot area 20 feet on each property. -- for the common use of the two properties . The 20-foot area on the Zwingli property cannot be used for structures but only for ingress and egress ; thus, there remains but 33 feet of frontage with a runback of 75 feet and with the back portion of the lot 55 Peot in width, • I believe the Planning Commission is aware of my general outlook froma legal point of view, that the Pacts of this case do not fall within the intendments of the variance criteria of the Subdivision Code, with partiular regard to the fact that the appli- cant or applicant' s lessor created the problem. This to my mind would establish a dangerous precedent to the extent that anyone could by pre-planning create a similar problem and thenask for • special. dispensation. 1/4 ,A,Andert4on PAAteb ■•■ ‘.■ ::..::,.+...-:.w.a:.+a-...,.u ,.«..:.u+..:....r+--:.,., ....;..., -i;....,.1•:s-,-;+o w.... -..«w;ns» F :..F„.,:.,.,.,..,., .,.v;,,a,,,,,,.. ,e„ •w..•,,:„,,.,w;.,-r ....ay.-....rv:kn.,-...«.T-..w-... ......m.-+:.. .-, ,w .aa.oaa: .ws.,..-++nr ., File ZONE CHANGE APPLICATION Receipt Date yq City of Tigard Planning Department 639-4171 12420 S.W.
