(a) City Administrator reported Mr. Johnson was not ready to
develop the land and requested the zoning be restored to
M-4, in accordance with the Tigard Municipal Code which
calls for substantial progress within one year The
Planning Commission had reviewed the application and
recommended the P. D. zone be removed.

restore the original zoning of M-4; seconded by Councilman

As you know subject property was rezoned to
Planned Development some time ago. This zonidg was
extended for six months and is due to expire, accord-
ing Co my records, on April 14, 1973.
Unfortunately, it has not yet been possible for
me to secure a suitable 'tenant for the Location.
There have been numerous prospects but, for the most
. part, the natu 'e of their business activity did not
fit the zone. .
At this time am negotiating with a firm that
needs 5000 sq. ft . of warehouse space for furniture
storage.
Will very much appractate your granting an addi-
tional six months extension of the PD zone change,

AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE LANDS OF
Wallace; E. Johnsen in Section 2, Township 2 South, Range 1 West,
Willamette Meridian,„ TIGARD ,•WASHINGTON COUNTY OREGON. ■
WHEREAS, the hereinafter described lands, by action of
the City Council of the"City Of Tigard, Oregon, pursuant to the
Zoning Code of said City, have heretofore been limited in the use
' to theme uses permitted by said Code, "under, and have been
classified and zoned for, and M-4, Industrial Park; and
` WHEREAS, pursuant to prescribed procedures, the owner of
said lands has applied to the City of Tigard for reclassification
of said property and change of zone thereof to permit the use k
: ,' thereof for P.D., Planned Development purposes, and said application
has been duly publicized and public hearing held by the City Planning
{' Commission on August 17th, 1971 after due and legal notice; and
i; WHEREAS, the Planning Commission has recommended approval
' of said zone change to the City Council, and due and legal. notice
of City Council Hearing having been given by publication in the
:4 Tigard Times, and the City Council having conducted said hearing
at its regular meeting of September 13, 1971, and the Council
finding that no public detriment will result from granting of
1, said petition, and that it is in the public interest that said zone
, change, subject to conditions as set forth by the Planning
Commission, be approved, and the lands rezoned from M-4, industrial
Park to P.D.,,Planned Development.

THE CITY OP TIGARD ORDAINS AS FOLLOWS: ,

headed "DESCRIPTION" be, and the same are, here).y
reclassified to permit the use thereof for Planned Developmte' under
the P.D. classification of the Zoning Code of the City of Ti40.rd,
subject to the conditions set forth on the attached sheet entitled

1. A detailed tree planting and landscaping
plan shall be provided as part of the
general plan and program.
2. utilities, drainage and driveway specifications
shall be provided as part of the general plan
and program.

3. Uses other than allowed as outright permitted
uses within the M-4 District shall be reviewed
and approved by the Planning Commission in
order to preserve the integrity of the Community
Plan and Zoning Ordinance.

being more particularly described as follows, to-wit:
Beginning at the northwesterly corner of said Lot 59,

which northwesterly corner is in the northeasterly right-
of-way line of S.W. Tigard Street. From said place of
beginning; thence South 64° 29' East along said north-
easterly right-of-way line, 256.30 feet to the northeasterly

The staff finds that the request conforms with the
Community Plan and designated uses along the corridor
between Panno Creek and the Oregon Illectric/Southern
Pacific railroads.

The staff further finds that the proposed zoning will
facilitate better utilization of the subject corner lot
than would be possible under existing zoning. The pro-
posed site plan allows a workable truck maneuvering
and off-street parking area, combined with landscaping
along the frontages.
It is recommended that the request be approved subject
to the following conditions:
1. That a detailed tree planting and
landscaping plan shall be provided
as part of the general plan and
program.
2. That utilities, drainage and driveway
specifications shall be provided as
part of the general plan and program.
3. That uses other than allowed as out-
right permitted uses within the M-4
.� District shall be reviewed and approved
by the Planning Commission in order to
preserve the integrity of the Community
Plan and Zoning Ordinance.

review in connection with my application ?or approval in principle to re-
zope subject property to "Planned Development".
As shown on the site plan a warehouse building and office /
facilities are planned. Upon remeiving approval in principle for this
development it will than be possible for me, te have meaningful discussions
with a prospective tenant or tenants whose business activities are compnt-
. ible with the zone. (1 have a prospect'who has exprespOd very strong in-
barest for approximately 10,000 square Feet of space, but who will need
to occupy it within four months.)
You will hate from the site plan that the building is set
back from both Tigard St. and GLant Ave. so as to provide a large open
space area on both streets. To compensate for this to some degree the
plan provides for a 5' sideyard setback on the Westerly property line.
Sanitary sewer service is available. ,Last year a line was
installed alcing the Grant St. frontage, the assessment for which amounted
to over $1700,00. The other utility services are also available.
The residence immediately to the West is owned and occupied
by Mr. Kenneth Graves. Several weeks ago I discussed With Mr. Graves a
1 building plan calling for a 10° setback along the West property line# This
• plan called for placing a building as close as possible to Tigard St. Mr.
Graves expressed concern about obstructing the outlook from the front of
hie home. He stated, however, that as long as he had a reasonable open
area toward the front (that is, the North end of the lot) he did not care
how small a setback there was at other points along the property line.
The building layout shown on attached drawing was designed
with Mr. Gravest feelings in mind. The proposed construction will not in-
terfore with vision from the living area of his home; in fact, the outlook
ent
should be enhanced with the landscaped area to be provided at the North end
of the lot.

CITY OF TIGARD PLANNING COMMISSION
Notice is hereby given that a public hearing will be held by the Planning
Commission of the City of Tigard at Twality Jr. High School in the Lecture A.
Room, at 14650 S.W. 97th Avenue, Tigard, Oregon, on February 5, 1974, at
700 P.M. with respect to the followings
A request by Wallace E. Johnsen for extension of the time
limit as applied to the Planned Development Zone for his
• property on the corner of Grant and Tigard Streets (Tax Map
2S1 2BA, Tax Lot 800). This extension is made necessary
by the Tigard Zoning Ordinance which requires commencement of
construction within one year after granting of the Planned
Development Zone by the City Council. This zone was granted on
September 13, 1971 and renewed by the Planning Commission one
year ago. Proposed for the 1.23 acre site is a 20,000 square
foot warehouse to be built on the northwest property line.
