Dear Ms. Girod:
Enclosed is a copy of Ordinance No. 79-115 which was approved by the Tigard City
Council at their regular meeting of December 17, 1979. Your request was approved
with the following conditions as set forth in the enclosed ordinance.
1. That the applicant dedicate five feet of right-of-way with half-
street improvements along S.W. Frewing to local street standards
prior to issuance of a Building Permit.
2. No Occupancy Permits shall be issued until all conditions placed upon
this development by the City of Tigard have been satisfied and inspec-
tions verifying this have been carried out by the appropriate depart-
ment.

3. No changes will be made to approved plans of specifi ations unless
formal application is made to the appropriate City department and
changes are approved by that department. Application for changes
will be made in writing and shall include applicable drawings.
4. Construction plans on all public right-of-ways shall be submitted

2. 911 EMERGENCY PHONE RECOMMENDATION
(a) Russell Washburn and Doug Krebs of the Tualatin Rural Fire Protection
District presented their 911 emergency phone concept to the Council.
Chief Krebs noted that Washington County 911 Committee has selected a
plan to have centers in Forest Grove, Hillsboro and Tualatin using a
call transfer system. The fire district plans on a 3 year serial levy
election in February of 1980 to request $200,000 a year from the voters
for funding of the 911 prOposal. December 15, 1980 wil?, be the target
date for implementation of the system,
(b) Council noted that this was an informational presentation and thanked the
Fire District for their information.

6. HARVEY KING SEWER IMPROVEMENT DISTRICT
(a) Director of Public Works noted sewer line would run south from Bonita
Road on 74th Avenue and almost 50% of the property owners have signed
the LID petition. After further discussion regarding land • owners and
the LID process, consensus of Council was to have Director of Public
Works gather more signatures and report back to Council.
7. S.W. 72ND AVENUE STREET IMPROVEMENT PETITION
P (a) Director of Public Works stated that the petitions are being signed and
noted that many parcels that will be involved in the LID process do not
have frontage on 72nd Avenue. After discussing different alternatives for
assessment, Director of Public Works stated he would be getting other
signatures for this project and reporting back to Council.
8. WALNUT STREET SIDEWALK IMPROVEMENT PETITION
(a) Director of Public Works stated the original petition for the Wal,Aut
Street sidewalk project requested a cement sidewalk and a masonry wall.
The cost for the original request would be approximately $60,000. Due
to this high cost, he suggested Council consider forming an LID for the
full street improvement from 121st Avenue to 128th or 135th at a cost
of approximately $104,0D0O which would include a 6' s-inhalt sidewalk.
(b) Mayor and Council requested staff contact petition( ~ ;nd make them aware
of the costs and different alternatives and possibly ..equest residents
do the wall. themselves. Mayor Mickelson stated he would assist Director
of Public Works in contacting the property oWnett3.
9. STREET LIGHT PLAN
City noted areas in the Cit that needed street lights.

TO CITY OF TIGARD "A-2" MULTIFAMILY RESIDENTIAL ZONE AND ADOPTING EXHIBITS
"A", "B", AND "C" GRANTING THE APPLICATION AND FIXING AN EFFECTIVE DATE.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Finding that the lands hereinafter described have been heretofore
and are now classified as City of Tigard "C-3" and further
findings that pursuant to prescribed procedures, the above stated application
for a zoning map amendment was heard in a public hearing held by the Tigard
Planning CoMmiSsion on December 4, 1979, and all interested personS were
there and then afforded an opportunity to be heard, and thereafter the
Planning Commission filed its report and recommended approval with the City
Recorder, a copy therefore hereto attached and by reference made a part
hereof, the Council adopts the following substantive findings:
A. That the applicant is in conformance with the proposed density
within the permitted amount for the multifamily designation, of the
Mr') #1 Plan.
B. That the proposed zoning is compatible With the surrounding neighborhood.
SECTION 21 THEREFORE pursuant to the requirements of Chapter 18.88 of
Tigard Mdnicipal Code, the applidant's request for an amendment
P of the Tigard Zoning Map of 1970 to zone those lands described in the attached
Exhibit "A" for Multifamily Residential (A-2) use is hereby approved subject
° to the provisions of Chapter 18.24 (Multifamily Residential Zone) of the
Tigard Municipal Code as embodied in or exhibited by the documents submitted
and identified as follows:

another access to this arterial road. Mr. Waker responded to the open
space issue,, and argued that the island between the two drainageways
should not be denied access to Durham, since such access is essential
for the development of the properties.
COMMISSION DISCUSSION AND AC TION: Smith felt the issue of the
requirement for another hearing, if substantial construction cannot be
started within a year, should not be an issue for the Commission at this :f==
time, since the applicant is aware of the problems which might arise
at a future hearing with a different Commission. He discussed with
Staff the issue of sensitive lands and the governing ordinances. It
was determined that the present ordinance would call for no different
physical handling of the drainageway by the developer than he now ,.
proposes. Smith asked the Cityss desire for this drainageway -whether
outright dedication or some alternative. Howard stated he would like
to see a homeowners association responsible for the maintenance of the
open space in accordance with a deed restriction. ..
Funk expressed more concern for the availability of parking than
for the access on Durham, since this appears to be the only practical
access to these properties. Bonnea concern had already been addressed.
Herron :xplored the parking and emergency vehicle situation on lldth
'.,:° with btaff. Speaker inquired about adequacy of access to Durham via
' a 17••root»wide pavement, and whether the developer is required to provide
r half-street improvements along Durham he is not, according to the present
proposal,) Mrs. Kolleas expressed concern about the 17—foot—wide street.
Smith raised the question of how access might be provided other than
via Dunham. Speaker and Staff discussed possible alternatives with' the
aid, of a large aerial photograph of the area. It Was pointed out the
draJhageways can be more easily crossed with culverts farther south,
while still allowing access to all properties on Durham. It was agreed
this might not be ideal, but neither is the topography of the area.
Smith stated he does riot dislike the proposal, but felt the limita-
tion of access to Durham Read was very important. lie thereupon MOVED
for denial of Subdivision S 6..79, based OA the fact the proposed subdivi-
sion accesses via 110th onto Durham Road. This is considered uhdesirabls
because of the policy established by the City to limit access onto
this road. The Motion, which was seconded by 1olleas, carried with

1. The site is presently toned C-3 "General Commercial" and is designated
A-2 "Multi-family Residential.( 'on the NPO #1 Plan.
2. The applicant wishes to zone the site in accordance with the Comprehensive
t° Plan in compliance with Section 18.24 (Multi-family Residential Zone) of
the Tigard Municipal Code (see exhibit "A" and attached site plan).

6. Sewer and water are •presently on the site off SW Frewing and capacity for
additional apartment units is available.
7. The applicant proposes to partition the parcel into two lots. The duplex
will have approximately nine thousand square feet and the western lot will
have approximately 7,110 square feet. The square footage and number of units
are in keeping with Section 18.24.030 lot requirements of the Tigard
.Municipal Code.
II. CONCLUSIONARY FINDINGS:
1. The zone change request to °'A-2" is in keeping with the NPO #1 Plan. V
2. The proposed density is within the permitted amount for the multi--.family designation.
°�. A minor land partition is required.
3. SW Frewing is in need of five additional feet of dedication along the
frontage of the subject site with half-street improvements.
4. In accordance with Section 18.56.015 (b), the Planning Commission must find
that since the proposal is not needed to carry out the purpose of open
space, the Planning Commission may exempt the Planned Development designation
requirement,

Staff recommends exemption of the Planned Development Designation Requirement and
approval of the Zone Change subject to the following conditions:
1. That the "applicant dedicate five feet of right-of-way with half-street im-
provements along SW Frewing to local street standards prior to issuance of
a building permit.
2. No occupancy permits shall be issued until all, conditions placed upon this
development by the City of Tigard have been satisfied and ittspections

Narrative relative to proposed zone change for south portion of
9960 S.W. Frewing property from C-3 to A-2.
North portion of this property to remain C-3.
Zone change to A-2 proposed to allow for construction of a duplex
which would open up lucrative home needs in donformance with Tigard's
Adopted Comprehensive Plan.
This change would offer diversified needs in allowing low cost, moderate
housing, while still maintaining commercial use for a portion of the
property.
No change of north portion (remaining C-3) where property borders C-3,
with the change to A"2 of south portion compatible to properties bordering
south side, which are A-2. No conflicts with zoning of bordering properties.
The development of property more pleasing due to overgrowth of area with
blackberry vines.
It would complete a continuous flow of development along rrewing Street 1
with no adverse impact on surrounding uses because presently developed
commercial on north and residential to south.
There is some need for student housing,so development could have some
favorable impact on schools.
Utility, city and county services are adequately available for this •
