Tax Map 2S1 lAD, Tax Lots 300, 500 and part of 600) ,- REQUEST: For a zone map amendment from Washington County RU-4 "Single Family Residential" zone to City of Tigard C-P "Commercial Professional" zone on a .80 acre parcel. I. FINDINGS OF FACT: 1. The site is zoned RU-4 and is designated "Commercial Professional" C-P on the NPO # 4 Plan. 2. The zone change request is in Compliance with the Comprehensive Plan deSignation of Commerdial Professional. The following policies of NPO #4 are applicable: Policy #25, Page 9 "Minimtm Commercial Professional Lot Size" Policy #27, Page 10 "Site Development Requirements" Policy #28, Page 11 "Public Facilities Servides Improvements: 3. The applicant proposes to donstrudt a 21000 square foot office complex in combination with the 10t000 square foot lot (tax map 281 lAD, Tak Lot 400) adjacent west of TaX Lot 300 which brings the total commeroial office site to one adre. 4. The subject site has an exiSting house on the northwest corner of Tax Lot 500 with some significant vegetation throughout the site. The parcel slopes gently from southwest to northeast. There is a wetlands condition on the southwestern corner of the parcel. Therefore i a proper site drainage plan to a pbblid storm sewer will be required prior to bUilding construction. 5, The surrounding land uses consist of the State Highway 1-5 to the east across 8W 66th; the Lamb Weston building to the south across SW Hampton; single family residences to the north and west across 8W 6/th. All of the Surrounding parcels are designated "Comtercial ProfesSionala oh the NPO # 4 Plan. • 4 STAFF REPORT AGENDA 5.3/ZC 34-79 TIGARD PLANNING COMMISSION December 11, 1979 Page 2 6. SW Hampton is designated as a collector street on the NPO 44 Plan. There is presently the required 60 feet of right-of-way with approximately thirty feet of paving and curbs or sidewalks. 7. SW 66th and SW 67th are designated as local streets on the NPO 44 Plan and are presently in substandard condition having no curbs or sidewalks and only thirty feet of paving. Al]. streets are City jurisdiction. 8. Sanitary sewer is available to the site off the corner of SW Hampton and SW 68th. Water is presently on site. II. CONCLUSIONARY FINDINGS: 1. The zone change is in conformance with the land use designation in this area and the plan meets the one acre parcel requirement of Policy #25 • " of the NPO #4 Plan. 2. The wetlands condition on a portion of the site will require proper drainage when construction occurs. 3. Site drainage, landscaping, tree preservation and street improvements shall be mandabory through site design review approval. III. STAFF RECOMMENDATION: • Staff recommends approval of the zone change from WaShington County RU-4 to City of Tigard C-P subject to the following conditions 1. That owner receive site design review approval prior to issuance of Building Permit. 2. That Tax Lots 300, 400, 500 and the soutivrnportion of 600 (Tax Map • 2S1 LAD) be consolidated prior to issuance of Building Permit or the • buildings on the plan must be relocated. 3. No Occupancy Permi 'ts shall be issued until all donditionS placed upon • this development by the City of Tigard have been satisfied and inspections verifying this have been carried out by the appropriate department. 4. No changes will be made to approved plans or' Specifications unless formai application i0 made to the appropriate City department and changes are approved by that department. Application for changes Will be made in Writing and shall inclUde applicable draWings. 5. "Nature of proposal and the reason for requestin ; the particular action ." The subject property is within an area arnexed to the city of Tigard durin ; 1975 . As such , it car- ried with it the Washington County RU-4 zoning single family residential use on 7 ,000 s. f. min- . imum lots . Since the city Comprehensive Plan designates the area for Commercial-Professional use, there is implied a Baker conflict . The appli- . cant proposes resolving this conflict by acquiring a zone change from RU-4 to C.P. and ultimately developing the property in accordance with this zone. Included with this brochure is a separate brochure illustrating the proposed development 's site plan and artist 's rendering. In the appendix of this report is the topographic survey of the existing site, showing the location of the existing house , tree size and location and utility lines . 2 . "How the proposed use is tin accordance with Tigard 's Comprehensive Plan." As noted above, the Tigard Plan includes this site in an area designated for Commercial Professional use. The requested zone change would therefore ip bring it into conformance with the adopted plan. 3. Public need and benefit of proposed action. Public need for, Say, multi-family housing would involve a fairly extenSive amount of demographic analysis t population trends economic opportunities ; . 44 • -2- transportation facilities ; educational and recrea tional facilities , to name the more important areas of concern. Public need for additional office space would , on the other hand , appear to be primarily a function of the market place -- assuming that all zoning and planning requirements are satisfied . That is , if similar enterprises in the vicinity maintain a high occupancy rate this fact alone should be adequate proof of public need . The pre- , requisites for office space are considerably few- er than those for additional housing; therefore the required burden of proof should be correspon- dingly less . During the preliminary planning stage of this pro- ject a market study was made of the various office complexes in our region. This report is inclu- ded in this brochure as an appendix. In order to update this study and note any significant changes in the area since that time, a more recent survey was conducted specifically for this report . General conclusions formed from conversations with various rental agents indicate that while there is still a significant demand for such space, the previous high demand has diminished and potential tenants are doing more shopping. (Unfinished) 0,000 s .f. 40,000 s.f. for Use by wne o r Balance, 20% committed. ..3- Much of the C.P. zoned property southerly or Hwy. 217 has been used for corporate owned and occupied buildings: Burroughs ; Farmers Insurance ; Investors Insurance. These buildings were not included in the survey. Community benefits of such developments are many and varied . The most obvious are the physical improve- ments to the various public services performed by the developer. Sanitary, water and street systems are all improved in ratio to the scope oc, the de- velopment. Less obvious benefits include an in- creased number of employment opportunities in the neighborhood which in turn stimulates housing and general economic growth. Other benefits include increased revenue to the city, providing a broader financial base for civic improvements. An analysis of the benefit-cost ratio* of commercial-profession- al developments would confirm this . Public services utilized by such developments are proportionately less than the community benefits derived from the additional tax revenue and fees . A diversity of economic opportunities in a community increases its social and economic stability as well as encour- , aging additional economic growth. 4. Social, enviromental and public service changes that would justify the zone change. • The most obvious change in the area has been the gradual transition from residential use to commer- cial use -- a change resulting from the proximity * Journal of the Ametican Institute of Planners , March ) 1977 This article analyses the benefit to/ cost to a munici , pality from various types of developments ) ranging from single family, detached residences (high cost to commun,- ity in terms of services required ; low benefit) to low impact, commercial office complexes (low coSt to coMmU a nity; high benefit in terms of community amenities not necessarily utilized by the tenants,) = -4- , of two high use, major arterials . As currently zoned , residential use is the sole permitted use on the site and its location does not encourage this use. The fact that the city's Plan recommends an alternative use would indicate that its use as res- idential property is not tenable. The gradual ex- pansion of city services into this area provides a framework for orderly and logical development in accordance with the plan. 5. Site suitability Since the permitted uses in the requested zone do not depend on direct exposure to high use streets and are fairly restrictive in nature , the actual C.P . designated area in the city is relatively small, consisting of approximately 136 acres north- erly of Hwy. 217 - of which the subject site is a part - and approximately 40 acre southerly of the highway. The fact that all esselitial services are available and the site is adjacent to identical uses would certainly argue that the site is suit- able for the proposal. The property fronts on a major collector that is partially improved and has convenient access to two major highways., While there are other, vacant C.P. zoned sites in the vicinity, they are either not available or not of a sufficient size for the proposed project. b. Social and enviromental impacts.
