(a) City Adminrstrator stated Portland General Electric company
wished to extend the franchise with the city of Tigard at
additional 10 years, Representatives of Portland Genera

Connci'k Amaind the existing ordinance to extend the

• Council, vGI representatives and staff discussed the
possibilities of underground utilities along 99W and other
amendments to t ordinance. Council will, take the matter
under advisement. City Administrator and Attorney will
review the proposed changes,
10. EHRNEELT TRIAL
(a) City Attorney reported the court held in the City's favor •
and upheld the City sewer assessment on the Ehrnfelt
property.
11. REJECTION O BIDS - Police Cars
(a) City Administrator repotted two bids received as follows:
Knauss Chevrolet $3,602,82
Wentworth & Irwin, Inc, $3,470.96
City Administralor recommended rejection of bids submitted
as City can purchase cars under Multnomah County joint
(b) Motion to a thorie purchase of two City police cars from
Multnomah Coanty: Councilman Moore, seconded by
Councilman Norton.

(a) City Administrator read letter from new sponsors, Lake
Terrace Development Cormany reduesting an eXtentiOn of
Ordinance No 71-13 for an additional 60 days. Mr. Lutz,
representative of Lake Terrace Development Company
stated tile additional '1 days wouid allow them to finance
the proposed project, City Administrator stated Since the
ordinance had al:ready expired possibly an amendatory ordinance
extending the time should be adopted.
(b) Motion by councilman Bergmann to instruct City Attorney
to prepare new ordinance covering the take Terrace
Panned Unit ttevoopment for a 60 day period, seconded by
Councilwoman Pais4ey.
Attorney Anderson suglented the City Planner study
revised project to we if it conforms with current
zoning code .

AN ORDINANCE AMENDING ORDINANCE No.69-25 and ORDINANCE No.
69-33, PRESCRIBING REVISED CONDITIONS FOR CONDITIONAL USE FOR -
"PLANNED RESIDENTIAL" DEVELOPMENT PURPOSES WITHIN THE R-7 ZONE OF
CERTAIN 1ANDS IN Section 34, T1S, R1W, W•.M., TIGARD, WASHINGTON
t. COUNTY OREGON DECLARING AN EMERGENCY AND SETTING EFFECTIVE DATE.
■
WHEREAS, by Ordinance No. 69-25, duly passed by the City
Council on March 10, 1969, the lands described therein were rezoned
from Washington County SR to R-7 (Single Family Residential); and .
WHEREAS, by Ordinance No. 69-33, said Ordinance No.69-25 was
amended to authorize "Planned Residential" development on said lands .'
and prescribing conditions applicable thereto; and
WHEREAS, application has been made for a change in conditions
previously imposed with respect to said Planned Residential develop-
ment in order to provide additional flexibility and assure the high--
est degree of esthetic, social and economic development; and after
dur and legal notice a public hearing was held by the City Planning
Commission on November 17, 1970 with respect to said amended condi-
tions, and the City Council thereafter duly considered the recommend--

Dear Sirs:
On your agenda you have a hearing scheduled on a proposed amend-".fEID
ment to the Planned Residential Conditional Use you approved on
March 10th, 1969 on the Henry Potter property. The amendment prorn
poses a change from an integrated Planned Residential use of 48
multi-family units supporting a neighborhood commercial zone in -
front to a subdivision containing 11 duplex lots and 22 single
family lots in the rear. It appears to the Planning Commission
that this is more than an amendment to the original plan. More
particularly, it is a whole new concept more closely akin to sub-
dividing the subject parcel with individual lots and duplex sites
being available, rather than one well planned integral multi-
family Planned Residential Unit in residential zone where one
party would be responsible for maintaining the property.
The concept has now been turned around into quite something else.
We now have 33 separate parcels of land being created with the
resulting density being 1/2 houses and h duplexes. This is not the
original concept of the conditional use and therefore it is main-
tained that it should, be referred back to the Planning Commission
for consideration as a whole new conditional use. Furthermore,
the old approval should be cancelled since it now is obvious that
• the developers have uo intention of following the original plans
as they were bound to do in the public hearing.
It is the legally ordained function of the Planning Commission to
• advise the City Council on planning matters. This is just such a
matter. A revieW of the record shows that the Planning Commission
initially heard this request Feb. 18th, 1969, and unanimously
denied the conditional use. Subsequently the City Council reversed
• the recommendation on the appeal of the developers. It is not to
• suggest here that the Planning Commission will again deny hearing
a request for a Planned Residential development on the sUbject
property. Each application will stand on its own merits as it
• relates to what is considered good planning. However, for the
Council to take action on this as simply an amendment to an
already approved Conditional use-thA.a, in spite of the initial
denial on the part of the Planning Commission and-this, without
referring the matter back to the Planning Commission for study
would seem not to be in the interest of promoting public confi-
dende in our local government arid would seem to be eliminating
the function of the Planning Commission altogether.

It is the intention of the following conditions to provide the
maximum flexibility in the development of land so as to achieve
livability, esthetic and economic development. It is furthermore
the intention to provide a development that is compatible with
surrounding residentially developed lands.
To achieve this flexibility, the following conditions may be
utilized:
1. Streets may be paved to a width of no less than 24 feet,
with appropriate curbs to provide storm drainage - plans
to be approved by City staff - provided that parking
shall be prohibited on such street and that each dwelling
unit shall have a minimum of 4 parking stalls for its use.
2. Normal front, side and rear setbacks may be waived, pro-
vided that each dwelling unit shall have at least one
Yard of 20 feet or more.
3. That the land may be subdivided in accordance with pro-
cedures established by the City' s subdivision ordinance.
The following conditions shall be required for the development of
this property:
1. All utilities shall be underground.
2. The total numbex of dwelling units shall be no more than
50 and shall be residential in character, constructed Of
Materials compatible to surrounding residential develOp-
ments, and no more than two stories in height.
3. That the area designated as open space be dedicated to the
City for park purposes with satisfactory guarantee of
appropriate grading, seeding and other plantings as re-
viewed and approved by the Planning Department.
• 4. Street tree plantings and decorative lighting shall be
required along the street and in parking areas, subject
to plan approval by the Planning Department.
5, Plans for the development shall include appropriate indi-
cations of storm drainage and utilities.
6. This conditional use shall expire at the end of one year

The revised plan contains 49 condominium units.
It is recommended that the plan be approved with the
following conditions:

2. The total number of dwelling units shall be no more
than 49 and shall be residential in character, constructed
of materials compatible to surrounding residential devel-
opments and no more than two stories in height.

Although there was a crowd of people present
from the neighborhood, no one spoke in oppo-
sition to this proposal, although a few ques-
tions were asked.
The Commission discussed the proposal very
little, but felt they should approve the zone
change in order to remove the County zoning
and give the property City zoning, since they
had a chance to do so. The sewer capacity
problem was also mentioned.
A unanimous vote to approve the zone change
was followed by a unanimous vote to deny the
conditional use request.

provided that the zoning would be the proposed
new C--5 Small-scale Neighborhood Shopping, and
not the existing C-4. Under this new zoning,
the size of the development would be limited,
and a great amount of landscaping and sign con-
trol would be required, which would provide •
convenient shopping in this outlying area, with-
out great neighborhood disruption.
A proposed site plan, showing this and the ad-
joining proposed P-R development, is available
in the Planning Office for review.

2. APPROVAL OF MINUTES
A. The minutes of the Regular Meeting on January 21, 1969, were
approved as written.
3. PUBLIC HEARINGS
(Due to the great crowd of people present, the order of the agenda
was revised)
A. Zoning Ordinance Amendment
REVISION OF THE C-4_(Neighborhood Commercial) ZONE
t .
1. Staff recommendation and explanation `
a. Mrs. Wied read through the ordinance and made the
recommendation that the proposal be a new zone labeled
C-5 rather than a revision of the existing C-4 zone,
because there will probably be a need for another type
of reviled C-4 zone in the near future.

2. Public Hearing
a. Darrell 12190 S. W. Summer Street, asked
for an s.
explanation of the existing C-4 zone.
b. Gary :homes, 11520 S. W. 121st Avenue, asked if this '
type of development would hurt the downtown businesses.
Mr. Woodard explained that adoption of this zone would
only provide a possibility of having such businesses.
Mrs. Wied explained that the scale of C-5 development '
would be small, and would hot be considered as corn-
petition for downtown business.
c. Myron Robinson, 12045 S. W. 116th Avenue, said that
most businessmen cruet improve the community, just get
rich on it.
d. The Public Hearing was closed
3. Commission discussion and action
a. It was moved (Woodard), seconded (Aitken) and passed
by unanimous vote of the Commission present that the
proposed amendment to the Zoning Ordinance be enti-
fled C-5 and be approved as written.

that there are now shopping areas within a mile and
a half of this area, and that that wasn't very far to
travel for the "lazy American in his big car."
d. Susan Davis, 12150 S. W. Summercrest, said that people
moved out to this area to be in the country, not near
"conveniences."
e. Mr. Paterson asked for a general concensus from the 1
large group present - - the concensus was negative.
f. Mr. Penrose said that, aside from this development, he
• had a personal desire to see such a monvenience center
in his own neighborhood.
, g. Mr. Richard Nelson, 11650 S. W. 121st Avenue, said he
lives directly across from this property, and he wouldn't
• li.7-.; looking at it.
h. Mr. Chuck Downie, 12205 S. W. Summercrest, said he felt
that traffic alorj 121st was now too fast and that ad-

ding this development would only add to an existing
hazard.
i. Darrell Jones asked if the creek on the property wouldn't
make the construction of the project unfeasible.
j. Gary Thomas, 11520 S. W. 121st Avenue, said he assumed
this development would have a late-hour "7-11" type of
market and that he felt this would be more disturbing
in the neighborhood.
k. Mr. Woodley, Leron Heights, explained that he felt that
• , the area was already too large for a small-size shop-
. ping center and that, besides, neighborhood shopping
days are a thing of the past.
1. Susan Davis asked, "who is to decide our needs?"
. . m. Darrell Jones asked if public opinion was considered.

n. Mr. McBee, Burlcrest, and Mr. Davis also spoke in oppo-
sition.

a. Mr. George Penrose explained the proposal with Its mi*-,
ture of heights and types of units including one-story
duplexes, 131-story four pleXes and 2-story townhouges.
b. Myron Robinson asked if all the units were to be mul-
tiple units, and if there would be a way to hold the
• developer to the plans presented, asked about the setter
capadity, and said he had no objection to the plans.
c. M2. Paterson explained that a Conditional Use Would hold
the developer to these plane.
• Mr. Penrose said that sewer service would be like any
other development now - on a first-come, first-served
basis.

General 6pecifAtations for the Construction of Lake
lmprovaments for the aka Terrace Development
A.' General
The contractor shall furnish all the necessary mater-
ials, equiPmcnt and labor to Provide a functionable lake
. on the Lake Terrace property, west of 121st Avenue in Tigard,
Oregon. The work shall include the dewatering of the
existing lake-like area, constructing an oltfali dam and
removal of the existing debris. from the area that is to
become the lake. The contractor shall (*btain all necessarY

Permits before proceding with the construetion work.
B. Dewatering of lake area
The contractor shall begin at the invert of the
existin culvert that is under 121st Aventie on the Lake
TeL proptr,,ty and excavate a 14,0 foot wide trench at a
slope of 4,-0.5 for 300 feet, then continue to the g*4011j14'-.1.'

The tontractOr shall place LI6 feet of 36-inch diameter
14 gauge corruoated metal pipe th the dowaterin# trench
with the upper end at an dieltb.tioh Of 2111.0 and ,sloping
downward toward 121t Avenue at a slope of -0.5'/'10 to i;he
lower end. A tee section shall be placed at the upper end
with a head .1,24ate placed on the extreme urper end of the
pipe, 1h too shall be placed in such a manner that A
section can be added to the tee to an elevation of 2F14.0
to control the elevation of the lake.
A concrete cutoff wall 6-inch thick by 6 feet deep
shall be placed the length of the dam. The top of the
