Your request was approved with the following conditions as set forth in the enclosed ordinance. 1. That the applicant receive approval for the street width and cul- de-sac length variance. 2. That sewer irastaliation be provided to the site prior to issuance of building permits. 3. That half-street improvements along SW Greenbtzrg Road to collector street standard be made, or a performance bond submitted in lieu thereof, with a stop sign at the corner of the intersection to Greetiburg Road, prior to recording of the final plat. 4. That construction and site drainage plans be approved by the Engineering • and Building Departments prior to issuance of permits. 5. No occupancy of any structure shall take place until after final in- spections have been made and Occupancy Permits have been issued by by the Building Official. 6. TIGARD PLANNING COMMISSION July 17, 1979 • • Page 3 . • •Wood summarized factors which would justify conditional use for duplexes in general, and felt these justifications are absent in this case and in this area. ,; Tepedino felt the character of the neighborhood and the facts presented in the application were not persuasive in favor of the duplexes as requested. Wood MOVED for denial of Conditional Use CU 13-79 based on Staff's General Findings of Fact and the following Conclusionary Findings: (1) Same as Staff. (2) The area presently is primarily a large-lot, single-family area. (3) The change in the character of the neighborhood is opposed by several surrounding landowners. (4) The remainder of the parcel does not require duplex buffering ' from S.W. 97th Avenue in order to be developed as a single-family subdivision. The motion was seconded by Kolleas. Funk asked if these units could be sold as common-wall single-family units. Discussion among the Commissioners and Staff brought out that duplexes on 10,000 square foot lots could not be sold separately because of land registration requirements. Also, in the present case to partition the 10,000-foot lots into two 5,000-foot lots would violate the zon- ing, which calls for minimum 7500-foot lots. Another alternative would be to request a planned unit development. The President called for a vote on the motion for denial. The property involved in the request is described !. as Tax Lots 2800 and 2900 on Tax Map IS I 35DC (Washington County). , , Nature of roosal and Reason for•Action and Conformance to Com rehensive� The applicant proposes to subdivide 2.88 acres containing 2 existing dwellings " into 15 lots. In order to develop to this density, the applicant desires to rezone from the existing R-7 zoning to R-5. On Ma y 21, 1979 the Tigard City Council approved amendments to the zoning ordinance to permit R-5 development in key areas that are depicted on the city's land use plan. Since the plan now allows for a more intense use than the existing zoning would allow, the applicant desires to zone the property in accordance with the adopted plan. Public Need Due to the growth of the Portland metropolitan region's economy, there is a ' constant demand for adequate housing. To direct growth to outlying areas creates a burden on the taxpayer to support the extension of services over great distances. The proposal to re-zone "skipped over" or previously undeveloped land • to R-5 to allow higher density development in existing urban areas is to the , benefit of the public as services to the site are already in. No new public monies for utilities, etc., will be requil'ed.
