THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Finding that the lands hereinafter described are now classified
as C-3, and further findings that pursuant to procedures, the
above stated application for a zoning map amendment was presented at a
public hearing held by the Tigard Planning Commission on September 8, 1981.
All interested persons were afforded an opportunity to be heard at this
• public hearing. Therefore, the Council adopts the following substantive
findings:
A. That this application is in conformance with the C-5
designation on the adopted NPO # 4 Plan Map.
B. That the proposed C-5 zoning conforms to Policy 0 22
from the NPO 0 4 Plan.
SECTION 2: Therefore, pursuant to the requirements of Chapter 18. 88 of
the Tigard Municipal Code, this request for a Zone Change to

provisions of Chapter 18.36 of the Tigard Municipal Code as embodied in

Your recent notice to us on this subject indicates that
there may be an office/warehouse building constructed
on this property. Attached are maps showing a 10 foot
wide drainage easement which is located either through
or along the edge of the Hartwick property. Originally
this facility was a ditch. Years ago Mr . Hartwick piped
a portion of the ditch and placed pavement over it.

hundred feet and backfilled the ditch.
• We would request that no improvements be made in close
proximity of this easement that would make maintenance •

The Zone Change has been written in ordinance form and will be considered
by the City Council at its September 28th meeting held at Fowler: Junior High
School, Lecture Room, 10565 S.W. Walnut Street, 7:30 p.m. At that time,
the City Council has the following options: approved, modify, deny, remand
back to the Planning Commission, or determine to hold a hearing on the
record established at the Planning Commission. .
No additioqal testimony will be taken by the Council at its meeting. You
1 will be provided written notice. of the Council's action.
The Conditional Use shall expire in one year from the date of approval if
the use has not begun and continual progress toward its full operation
is not evidence.
