16. TEMPORARY USE TU 2--77 (Richard A. Cooper)
A request by Richard A. Cooper for a one year extension to retain a temporary
mobile office at 13935 S.W. Pacific Highway (Wash. Co. Tax Map 2S1 3DD, Tax
Lot 1000) .
(a) Planning Staff referring to the Memorandum to Council explained the
concerns of this item including landscaping, sidewalks, sewer and access.
He recommended additions to the conditions specified in the memorandum to
include the addition of a new (d) requiring sewer hook up within 30 days;
and the addition of (f) to require the applicant g

length of time since the initial granting of the Conditional Use.
(b) Legal Counsel explained that this action (f) was allowed by Ordinance.
(c) Councilwoman Stimler stated that she had a problem with the requirement
to return to Planning Commission as the delays have been due in a large
part to the continued development surrounding this"Jand.
(d)( Mr. Cooper, Tigard Motors, questioned the requirement of the access through
the' "backyard" of his property, stating that he had never agreed to that
access and had not been involved in development plans of adjacent lands.

17. APPEAL - ZO E CHANGE Z2-79 (Lindal Cedar Homes)
(a) Planning Directoe'explained that this project had been denied by the
Planning Commission on the basis of the one acre minimum Commercial-
Professional development specified by the NPO. •
(b) LaValle E. Allen, 7540 S.W. Hermosa, NPO #4 member and resident explained
that tht one acre minimum was designed to discourage small developments
which would not provide continuity in this zone. He went on to say that
the NPO wanted to "discourage" these developments unless "hardship" could
be shown on the part of the developer; in which case the development would
be subject to Site Design Review (to prevent the feared lack of continuity) .
(c) Planning Staff explained the definition of "hardship", stating that it is
intended to t_over cases where an owner had purchased property for a
specific type of development, after which the zones were changed to prohibit
such development. He went on to say that since the developer had purchased
this property after the. NPO placed the one acre minimum restriction, the
developer should have known of the restriction and did not have a "hatdship"
placed on him.
(d) Planning Director sunimarized the problem and recommended that Council deny
the appeal.
(e) Motion by Councilman Brian, seconded by Councilman Scheckla to deny the
appeal and uphold the action at the Planning Commission.

18. PROPOSED VACATION OF A PORTION OF AN UNNAMED 30 FOOT WIDE DEDICATED PUBLIC RIGHT-

ROLL CALL:

Staff: Howard, Selby; City Attorney Joe Bailey during part of meeting.
MINUTES: The minutes of March 27, 1979, were considered. Wood asked they
be corrected as follows:
Page 3, 1st paragraph, the motion was corrected to read: ". ..
on the ground that it does not comply with the NPO #4 Plan require-
. ments for the MINIMUM SIZE DEVELOPMENT. The motion was.. ." (Underscore
indicates the correction )
Page 4, 3rd line, the word OWNS should be PURCHASED, making the
sentence read, "It was established that the applicant. PURCHASED the
• property without conditions.. ." And on the same page the modified
Condition I should conclude: ". . .that an agreement be reached to pro-
vide such access upon development of the INTERVENING PARCELS."
On page 5, under New Business , the typographical error in the
second paragraph is corrected, making it read, "At this point (10:15
P.M.) .. . "
There being no other corrections offered to these minutes, it was moved, second-
ed and carried the minutes of March 27 be approved as corrected.

Sensitive LandS ordinance. Wood reported at some length the purpose and aCcom.4
plishments of the subcommittee of four Commission member8, pointing out that the
impact on the first item on the agenda; hovVeVer, the ground miles established for
the subcommittee precluded any discussion of, or calculation of possible effects
onr the fit8t item to be heard this evening, which involves consideration of
sensitive lands (floodplaiti) . This was Said to allay concerns of possible viola-

A request by Lindal Cedar Homes, Inc. for a zone map amend-

Gonzaga Street & 66th (Wash, Co. Tax Map 2S1 IAA, Tax
Lot 7200) .
Howard read the STAFF REPORT.
The APPLICANT'S PRESENTATION was made by Mac McQueen of the Seattle office
of Lindal Cedar Homes. He explained the Company's plans to erect two buildings
to be used for office purposes, while retaining as many trees on the site as
Possible. He described the traffic generated as light, and mostly on weekends. .
He offered to show plans of the first building.
There was no PUBLIC TESTIMONY.
Howard read the STAFF RECOMMENDATIONS.
COMMISSION DISCUSSION AND ACTION: It was asked if zoning permitted this
residential type of construction n this area. Mr. McQueen replied that while
the buildings would illustrate for prospective purchasers the type of
construction, these were in fact permanent buildings with basements, and would
be used as offices and not residences.
The remaining principal discussion was on Staff Recommendation No 4 directing
consolidation of this parcel with others to increase the total buildable area to
the one-acre minimum specified in the NPO #4 Plan for "Office Park" designation.
Howard explained staffls reasoning for approval, describing the land ownership in
the area and the impor' of a one-acre Minimum on Small businessmen-.-Jsthe mainstay 1
of the community". He reported that the present members of r7o 4 are not in
agreement on this policy, and that staff would be meeting with NPO 4 very shortly, •
Making tabling at this time an option. Speaker commented the Commission should
consider what is best from the standpoint of good City planning, even While

recOgniting this imposes a hardship for the small businessman who might want to
e54tablish in th area. Smith asked for a map of the surrounding area, which was
supplied by Mr, McQueen, Bonn thought that in an area of larger office complexes, 4,
this might provide some diversity.
Wood requested further clarification of Condition 4. Howard responded at
• some length, discussing and illustrating on the map the ftsuperblock" concept.
Wood offered a mobion calling for development on this site'in such a manner as
• to allow it subsequent incorporation with other parcels into a unified develop-

this would result in piecemeal development, which is not in accord with the NPO
4 intent.

1. The subject parcel is designated "Commercial--Professional°
on the NPO #4 Plan.

3. The applicant proposes to construct one office building
immediately, and another in the near future. The site usage

4. The subject parcel is presently Vacant and heavily Wooded.
The site elevation is approximately three feet lower than
S.W. 66th and is relatively flat.
5. Surrounding land uses are: vacant wooded lot and the Allstate
Insurance Office across S.W. Franklin to the north. There
are single family residences to the Nest and south. To

?. The proposed project is in keeping with the designated land
use. However, due to its lot size, it is in conflict with
the intent and Policy #25 of the NPO'#4 Plan. (Refer to the

2. Permitting development of this .344 acre parcel may impair the
ability to develop large tracts and it may create a hardship
for the western adjacent lot of 12,000 square feet that, if
not incorporated with the surrounding larger parcels, Will
become a non-conforming lot.
3. There are a number of significant trees on the lot and, their,
preservation is desired where possible.
4. Tho "OFFICE PARK" section of the NP0 #4 Plan suggests that
some local streets adjacent to parcels to be used as ootnraercial-
professional, may be vacated to create "Super Blocks".

for approval prior to issuance of building Permits.

along the fronting of the subject property.
3. That the applicant furnish half street improvements to collector
street standards along S. W. 66th Street prior to issuance of
building permits.
4. That the subject site become incorporated with adjacent lots
to increase the total buildable area up to or above the one acre
limit for "Office Parke' areas.

I have some trouble with No. 4 of the Staff Recommendation. ' I donut
exactly comprehend how they are going to complete such a merger
of land ownership. Is that what you are advocating»--that various
owners would have to sell to one another to create a larger parcel?
` W: Howard Well, I would like to discuss this with you because there are some
problems. The NPO #4 Plan -- We received a letter from Mr. Larson,
Irving Larson. It was addressed to Mr. dash, who is here tonight.

Howard: `issue that we have is that the City of Tigard has been built upon ,
appliction by the small businessman. I an of the opinion that we',` ,
cannot close a small businessman down and request him to then-
' purohase an acre of ground--knowing what an acre is going to cost
in this location. So No. 4 an attempt to set the wheels in motion
to allow this development in conjunction with others on a small basis
as a start which will eventually evolve into the "Super Block".
Now when I talked to NPO 4 members, they are not in total agreement
. ' that what they state here in Policy 25 is the exact truth -- that
that would discourage. I am of the opinion we cannot discourage
building, but I am also of the opinion that we must substantially
uphold the NPO program. Now that leaves us a couple of problems.
One is, NPO 4 is not totally pleased with the interpretation that
has boiled out of this policy. We are going to meet with them soon.
But as I see it--so far as staff is concerned--I see it as the only
way to say to the smaller businesman4: "Okay, you are supplying the
majority of the taxes to this community; We want you here; we want
you to do the best job you possibly can, and we are walling to help
you. But We realize you can't buy a full square block for anything."
That's where I am coming from, and this No. 4 is an attempt on our
part to uphold the NPO Commercial-Professional; but also say to those
people, ltWe all don't have holes in our pockets and maybe we'll
have to start with smaller lots.”

Punk: I know the piece of property, and I have no problems. The one thing
that I can see is, I see that he has a future model home on a site
that -- I don't know whether that fits into the zoning. Does it?

each one of the buildings that are put up, and maintain them mainly

of our buildings and our Use to demonstrate the structure of the

or a real estate office, or an insurance office, or that type of

don't want to make it too difficult for the small businessman to get
an approval in there, but r- I don't know: it's a rough one

Smith: I have no problem with the future model home-it's not being used
as a residence, so therefore I don't see where it is in conflict
with the zoning. Its being used as office space: it just happens
to look like a home. First off, I would like to say that we've got
,.. :. a woods setting here, and using it essentially as a sales office for
Lindal Cedar Honios, it sounds like an aesthetically sound combination.

because the NPO clearly states that no development should take place

that you have conversion units, which I doubt very seriously will
ever be converted to anything but single-family homes. We have
large developments coming into that area that will have a substantial

When you weigh all this stuff, and when you try to say to the
developer, 0Would you work with us," he says "Yes." We say, "We
have this super block concept; would you Work with us?". He says
''Yes", and Staff takes the position that perhaps we can work with the
man and make it work; but then we go to the lTPO and they say, "Not
on less than an acre."
It is a real complication now. All the NPO policies are the same.

and attempt to rephrase No. 4., since a number of Commissioners, includ-
ink; myself, have some difficulty with it.
Wood: I find myself somewhat concerned-.-I am not concerned strictly with
the proposed project; but my concern is for something --w I see our
duty is to follow the NPO Plans We may not agree with the policy
of the Plan---it really doesn't matter. I lean toward this, not
because I am willing to say, "Well, small businessmen are great,
and so we'll just" you know, we just can't do what he wants us to
do. But I am not at all sure that as long as the parcel is designed
' such that a larger development can take place---1 am sure we would
not be going against the NPO Plan. I just want to add that I am
not particularly prepared to make a motion, only becaui --- until
I hear what others have to say.
I would suggest language for (Recommendation) 4. I think the point
is that the development on the subject site be designed so as to
allow subsequent incorporation with adjacent lots to create a
unified development of one acre or more. I think that is what we
can talk about.

block developments; that is, if you permit the small developments
you eventually end up with the type of situation where you've got

area from the same NPO-.-that their intent is not to let the area

structures and parcels. And I think I can relate to this, and t
at going to have to stand by that one-acre limitation because I
can see a definite intent there by the NPO, even though the present
existing members of the NPO noW may not really fully explain that

for what the NPO had in mind. I wonder if we would approve this--
alloy, this, requiring this.-the same on all other parcels--that

retain control so that when they were completed it would look as
NPO basically intended it to look'-.-.that is, as a large, unified
development. Can we achieve the goal of the NPO that way?
Tepedino: 1 think 1 tend more toward what Commissioner Wood is saying. I
don't think it was the goal of the NPO members to say to the ndi-,
vidual landowners that they could not develop if they owned less than
an acre. This . . . (a few' words lost here) • • . to feel that
,' . this was their intent; and even if it were their intent, it would
. not stand up under any kind of scrutiny. I tend to believe it was
their intent to have Tigard develop---that section of Tigard develops--
with the ultimate aim of maybe super blocks; and if we can merge
that objective without telling individual, landowners they must sell
or buy additional land before they can develop, 1 would feel more
comfortable in our position.
Smith: Well, I still have a problem with that, because you in essence could
r provide parcels Where you could essentially have a development like
this on a part of an acre, and somebody else develop the other part
of the acre, and somehow we could have done it all at once; so
technically, perhaps, we have met the requirement. And yet you would
defeat the intent, because yot would still have an appearance of
slot development; and if 1 sae the intent of that---of not having a
lot of small businesses, but essentially large developments--for
instance, if someone came in and did a park here, all the buildings
` in the park, and the driveways and parking areas would be coordinated
so it would look like a unit. But Lindal A-frame is not going to
look like a building IBM might put up next to it. What I am saying,
then; 1 think the intent tends to limit the ability to put on a
lot of small developments even if you took, and put them all on the
same piece of property. 1 have a problem with this, because like
I say,, 1 don't have anything whatsuerer against what the Lindal
people want to do here, and. it's a good location for them, but it
4 just dosn't appear to be compatible with the IWO, and unfortunately

from the NPO, we will start meeting with them, with the first meeting
tomorrow night. I am sure' . . . . we can come back to you real fasts
we can tell exactly what they mean, and it won't be long--,it will be

the owner says, "Well, how much is my 2500 square feet

Wood: I have a concern about the idea that we bring NPO 4 in and they tell
us what the Comprehensive ve p
lan. means. I think their input is very
important in learning what is happening in the community, in the
• field- fine; but the NPO does not adopt the Comprehensive Plan.
Ultimately we have to decide what it Means, and not years and years
later ask Whoever happens to be on the NPO and not the City Council;
you make the Comprehensive Plan mean what you now want it to mean.
l think ve should consider what they say about local conditions
interpreting this, but ultimately we have to giv'e it the meaning
that it seems to have in the Comprehensive Plan, even if today they
might not want that meaning. The City Council passed it tome time

ago. This is a real problem, and 1 am almost wondering if it is a

us.

the Plat is amended or it doesn't mean what it seems to meat. It
seouts to me We ought to deny, and we ought to make it explicit that
we are denying solely upon this interpretation of the XPO Plan to
allow the City Council either to amend the Comprehensive Plan or to
say that the Planning Commission doesn't understand What the Plan
• means. In either case if they do either one, I think that there
would be no need to bounce it back if this was the only ground for
decision they could then go ahead and ovevrtile the Planning Commis«►

• 7. Southwest Gonzaga presently has adequate right-of-way width o'.12 50 feet
foralocal street. However, it physically does not exist. Southwest
66th has adequate right-of-way width and good paving. However, it does
not have the required collector street standard, sidewalks, curbs and
gutters. Southwest Gonzaga and S.W. 66th front the subject parcel on
the south and east. They are presently county roads.
II.• : Conclusionary Findings:
I. The proposed project is in keeping with the designated land use. However,
due to its lot size, it is in conflict with the intent and Policy #25 of
the NPO #4 Plan. (Refer to the "OFFICE PARK" section of the Plan) .

' 2. Permitting development of this .344 acre parcel may impare the ability
to develop large tracts and it may create a hardship for the western
adjacent lot of 12,000 square feet that if not incorporated with the
surrounding larger parcels will become a non-conforming lot.
3. There are a number of significant trees on the lot and their preservation '
is desired where possible.
• 4. The "OFFICE PARK" section of the NPO 44 Plan suggests that some local
• streets adjacent to parcels to be used as commercial-professional, may
be vacated to create "Super Blocks". Southwest Gonzaga is qualified to
fulfill this intent.
III. Staff Recommendations:
Staff recommends approval subject to the following conditions:
1 That the applicant submit construction and drainage plans with necessary .

bonds to the City Engineering and Building Departments fdlr approval Prior to
issuance of building permits.
2. That the applicant apply for street vacating of S.W. Gonzaga along the
• fronting of the subject property.
3. That the applicant furnish half Street improvements to Collector street
• standards along S.W. 66th Street prior to issuance of building permits.
4. That the subject site become incorporated with adjacent lots to increase
the total buildable area unto or above the one acre limit or "Office. Patk°

I. Findings of Fact:
1. The sUbject parcel is designated "Commercial-Professional" on the NPO #4
Plan.

2. Applicable Policies for the Commercial-Professional designation are:
"Street, Water, sewer facilities" Policy 16 (page 9)
"Office Park parcel size" Policy 25 (page 14)

3. The applicant proposes to construct one offide building immediately, and
another in the near future. The site usage will conform with the
surrounding commercial property°s uses (see attached narrative dated
aanuary 24, 1979) .

4. The subject parcel is presently Vacant and heavily Wooded. The site
t elevation i$ approximately three feet lower than S.W. 66th and is
relatively flat.
5. Surrounding land uses are: vacant Wooded lot and the Allstate Insurance
office across 8.W, Vranklin to the north, There are eihqle family
residences to the West and south, To the east. is SW 66th and the 1-5
Vreeway. All surrounding land uses are in the commercial-profeSSional
designated area in the NPO #4 Plan.

Water service is available from the Metzger Water District. Sewer
service is being arranged for the site off the existing Tigard/USA
line at the corner of 8.W, 67th and 8.w. onzaga.

A. Water service for which we have applied a1 Metzger
Water District and arrangements will be made to
install the line from the nearest point.
B. Sewage. Arrangements have been made with Cooper
and Associates to engineer and install the sewer
from S. W. 66th and Gonzaga Sewer Extension to the
Site if the zoning approval is given.
C. Electrical service of 110 and 220 volts.
D. Phone Service.
E. Fire Protection
V. Normal police superviSion.
G. The development itself Will add no further loald on
school, park, or public transportation.
H. The access road from the freeWay and or other roads
Will be Used primarily by the employers and visiting
