Nimbus Avenue Beaverton, Oregon 97005 Dear Mr. Maris: have reviewed the Empkie Villas-Unit Ownership Plan submitted by you and find it unacceptable because the effect of such a plan is to subdivide Tax Lot 1600. Mr. Empkie's zone change approval permits the placement of four (4) duplexes on a. single lot to be served by a private drive. The effect of subdividing the single lot is to invoke the requirement of the City' s subdivision ordinance that all lots have frontage on a public street. When we discussed this project on the telephone a few weeks ago, I evidently did not make it clear that subdivision of the single lot will make this project infeasible due to the public street requirement. It was my understanding at the close of our conversation that no s*..Abdividing would occur. However, you • have, in fact, divided the original lot into separate parcels for the purpose of transferring title. The net effect of your proposal is a duplex subdivision with shared ownership and maintenance of the private access drive. , If you have any further questions do not hesitate to call me at 6'39-4171. Section 18 . 56 . 070 specifies the minimum parcel size in a planned development to be four acres unless the Commission rinds that the property is suitable by virtue of its unique character, topography, or landscaping, or by virtue of its qualifying as an isolated problem area. The site is approximately one acre in size. The NP II has identified areas adjacent apartments as problem areas and provided the duplex option as a density buffer . This proposal is for single story buildings which will diminish the density impact and provide a buffer between the apart- . merits and the recently constructed homes and adjacent on the south. 3. The surrounding land use is an apartment building and single family residence on the north, single family residence on the south and east and a multi-family planned development on the west . 4. The site is presently occupied by an older single family residence with the majority of the site being a flat grassy fieId. 5, The concept being proposed involves a linear placement of 5 duplex structures, a 26 ' wide street and a 53 ' diameter turn around at the east end of the property, Due to the narrowneo of the lot the lincal building placement is somewhat dictated but it does not need to be carried the enlire length of the site . My planned condominium development will consist of 4 detached two family residences, 1804 sq. feet each each with individual ownership, each with its own individual yard and landscaping, driveway, covered parking, front porches, fireplaces and many individual amenities resembling detached single family resi- dences in every character. I further plan to restrict the marketing of the individual condominiums to r families without children under 18 years old to maintain a mature Homeowner's Association and ensure a less conjested development. My marketing strategy will be to challenge and be in direct competition with the marketing concept offered by the "King City" and "Summer Field" developments: Low cost shelter for the elderly is virtually nonexistent and the highest of all housing demands, Over one -third of my property abuts se ara. Subsequently, without personal notification, the neighborhood plan revised the use of the land to a lower density than was economically feasible to develop, thus eliminating the considerable efforts we had arranged over the • past four years, locating contractors and making the financial arrangements to construct this courtyard villa type condominium development. The proposed courtyard villa condominium development is the only possible neighborhood transition from the existing two story apartment complexes abutting over one-third of the north property line. It will resemble single family detached living in every aspect. This is the only possible transition from the existing land use to the proposed land use designated in the City of Tigard's Neighborhood Plan Two. To elaborate on point #5 of the City of Tigard's application procedure form: "Why the proposed location for your proposed land use is more suitable • than other locations in the city zoned to allow the proposed use." The proposed location is more suitable than other locations in the city currently zoned for •M such use for four reasons: economically; environmentally or aesthetically; . public or market acceptability; and topographically. Approximately 90% of the land designed for medium density, which I require for my proposed use, is built on or in the process of being built on. Because over one-third of the proposed location abuts two separate existing two story apartment complexes, the proposed location is currently economically unproductive to sub- ' divide and develop into detached single family residences. The market demand for detached single family residences in the proposed location is greatly diminished through its proximity to a more transient type of existing land use. The current density requirement for the proposed location places an unnecessary hardship on the proper use and development of the proposed location. • The neighborhood will need to extend its medium density land use to the proposed location, if it is to continue to supply low cost home ownership to its residents, while improving the residential l character of the area. If the cost of detached single family residences is scheduled to continue to escalate as attested to by the enclosed Oregonian newspaper article dated ,• Ml October 1, 1976, it is quite possible that by waiting for the next type of proposal, if the current proposal should be found unacceptable, would mean two story attached dwellings rather than the more desirable single level detached condominium owner= . • ., , r- '',',.•4-_::,,m,,,,,.', Mac; .. t Y tt'r Y.. • disturbing factors caused by this more commercial existing land use. Further, this parcel is without any buffers, either natural or manmade, to protect it from the adverse affects caused by its proximity to Highway 217 and Greenburg Road. This condition should continue to worsen as the commercial use continues to develop. Both of these parcels of the three vacant parcels of ground in the urban medium density zoning are definitely not suitable for single family owner- ship, which my proposed use requires. The third parcel is not quite large enough to accommodate my proposed use. In addition, it is located on the west side of S.W. 98th which abuts the railroad tracks. The noise and environmentally disturbing factors caused through the train traffic strongly deters from the desirability of attracting single family ownership in this location. z` These areas that are presently zoned for my proposed use, although only , approximately 10% of the ground is still vacant, most tainly were zoned to buffer the more delicate residential nucleus of the existing neighborhood from Y� the adverse and harsher environmentally disturbing factors created through 4 commercial use such as a.utomobilh and train traffic. Further, these areas currently zoned to accommodate my proposed use were most certainly designed as a transition �. to improve and maintain the residential character of the neighborhood. The purpose Y' for designating the current areas in the neighborhood plan as satisfactory for 'medium density use is identical with my proposed use! To buffer the area from the more transient existing land use demonstrated by the two separate two level apartment complexes, making the transition to the more desirable single family • home ownership passible and affordable, while keeping in character with the density requirements of the neighborhood designed for this type of use. The pro- posed use i s the only possible economically feasible and environmentally desirable. • • +-.F✓'r4`'•� 6 transition from the existing land use to proposed residential land use designated in the City of Tigard Neighborhood Plan Two r Another important consideration for developing the proposed location, rather than another, is land cost. If there were other land available for sale, the current market cost for such land would quite probably make single level detached dwelling much less possible. Construction costs are less in multi ' level attached dwellings in comparison to the more desirable single level detached dwelling. Because my Mother and I purchased the proposed location in 1972, our land cost is lower; therefore, we can expend more capital for the land improve- ment, making a much more desirable residential development possible. The reason for developing the proposed location over any other location is that single family condominium home ownership requires a stable residential neighborhood to be successful . I am convinced, after a long and careful study, : i that the proposed location offers the quiet amenities of natural seclusion pro- vided by the large oak tree and various other fully matured trees on the pro- ..,: posed location and in the surrounding area, which will enhance the desirability of single family condominium ownership; warranting the large capital investment for this type of improvement, I t is away from the deterrent noise and environ- mentally disturbing factors of automobile and railroad train traffic, which makes single family condominium ownership much less desirable in those locations, It is the only possible buffer from the two existing Iwo story apartment com- plexes, making the transition to single family home ownership both possible and affordable, Because of the escalation of construction costs, waiting for the next type of proposal in the future for the utilization of this land would, quite probably, be two story attached dwellings, which aesthetically and environmentally would not blend in with the residential character which the N:P,O. wants to Ni % M ry.' ..V` L I• KF yjt s n t 0 t..'
