Box 23557 Re: Change in Setback & Sidewalk Tigard, Oregon 97223 Location-Lots 14, 15, 161 17 & 18. Dear Sirs : This is a request for a change in conditions to the planned residential unit, "Brookway". Since the cul-de-sac, Brook Court, is physically a 50' dedicated radius (ioo' diameter) and has a 36, paved and curbed radius(72' diameter) , the net difference leaves 28 or 14 feet from front curb to property line on each I -, lot. This compares to the usual 8' distance between curb and property line on the portions of the planned residential unit along regular streets. For the sake of uniformity, we request that the sidewalks be allowed to stay between 4' and 8' back from the curb-ratheirem the property line as technically called for-and that the front yard setback requirements be allowed to be 28 feet from the curb as on other lots. This would make all of the setback requirements appear the same throughout the plat. (Actual house setback from the property line would be 14 feet rather than 20 feet if the minimum were adhered to. ) (1) The sidewalk being allowed to be 4 to 8 feet from the curb will not conflict with underground gas or electric lines. (2) The houses on a cul-de-sac do not line up with other lots and thus can not affect their front yard peripheral view in any way.
