Public hearing opened, (2) Plantitg Director stated Planning Commission had denied application based on the following staff findings: The proposed land use 18 a highway oriented type of buaineaa and does not conform to the "Aetail Commercial", PAQg 4 -0 ligOULA4 lOtTINO NINUTg8) March 28$ 1977 • 2 The generally undeveloped character of this and adjoining parcels provides the opportunity for development of an attractive retail commercial area. The continuation of the "strip", which presently exists on the northeastern portion of Pacific Highway would be a mistake, expecially since this would probably cast the die for the type of development to occur on the adjoining parcels. Both Neighborhood I and III have attempted to stop the continued ex pension of strip highway development in the vicinity of Garrett and School Streets. The majority of /and in this area is now planned for commercial professional development, with this and its adjacent parcels near the Gaarde-McDonald intersection being slated for retail Use The boat sales facility approved across Pacific from this site was judged satisfactory by staff because of the screening in the form of fencing and landscaping which was provided. Director further stated Planning Commission also moved to deny the application in order to allow applicant to meet with NPO #3 and to meet with staff to ptepare an acceptable site plan. 4 Director displayed revised site plan and advised Council they would not be considering same proposal as presented to Planning Commission. Murdock and S .W. 98th Avenue be removed with the exception of half a- street left in tact for the parcel at southwest corner of Murdock and 97th . o Michael Staley, neighbor, stated he would be in favor of staff reornmendation if a 4 way stop was included, • J. J. Shannon, neighbor, stated the need for a pedestrian/bike path to the school from S .W. BASIC FACTS : I , The site is designated "Urban Low Density Residential tt on the Tigard Community Plan , 2 . The parcel is in two zoning designations, C-5 on the front portion and R-7 in the rear. This zoning designa- tion was requested and approved by the City Council in • 1969 (ZC 3-96 and ZC 4-69) II . FINDINGS : 1 . The applicant is requesting change of zoning designation from C-5 "Limited Neighborhood Commercial" to R-7 "Single $ ' Family Residential . " 2. The site is primarily vacant and ( overed with over grown grasses and brush. 3, The northern property line is City limits boundary with fully developed subdivision on septic tanks to the north and single family residences along the north property line from 121st to the end of the property , 4 . The commercial • zoning was established in 1969, Since that time the City has approved location of a neighborhood commerial shopping center along Scholls Ferry Road at 121st Avenue thus diminishing the need for the existing r-5 zoning, 5 . W. 121st Avenueanhas thesi d it as ' major collector., With this type of neighbor traffics construction of du ple a duplexes as buffer to the lots further West into the development makes the use of the land more desirable for single-Family homes as it transitions into the site 5. The proposed use of duplexes to transition into the site from a major collector has been done in the past by the city which recognizes the need. This location is more suitable than many other� locations in the-way, ,developments which do not front directly on a major collector. 6. Th i s request will create minimum impact under the Comprehensive Plan and will blend in with the adjacent single-family use, . presently adjacent proposal 7.
