Box 23557 Tigard, Oregon 97223 Re: Planned Development • Preliminary Plan & Program Dear Sirs: 11985 S.W. 1130 On May 240 of last year, the Planning Commission approved my request for a preliminary plan and program for a Planned Development at the South end of 113th Avenue off Tigard Street. The next step in the approval process is my petition fpr a general plan and program. At present we are waiting for the Corps of Engineers to complete their study of Summer Creek • from Fanno Creek up that watershed so that flood elevations may be more accurately determined in making the general plan. Mr. James R. Harris, the Civil Engineer on this project, has recently checked with the Corps of Engineers on their progress on Summer Creek and learned that they are not going to do the work themselves, but will contract it out. This should be done this spring, however, that probably means that there will not be a final study complete before the fall of 1978. Since this is the present situation, I would like to re- quest the the above mentioned item be kept open until the Corps of Engineers has completed their study. When more definitive information is available I will proceed with the general plan so that the land may be best utilized out of the flood hazard area. Very truly yours, cc: at. Main Street, MARI) , Tigard, Oregon 97223 Re: Planned Development 11985 S.W. 1130 ' Dear Sirs: i 1 The first condition after obtaining approval of the pre- 1 ; liminary plan of the above referenced planned development, 4 May 240, 1977, calls for locating the flood hazard contour ! 1 line(the 100 year flood-plain contour) , prior to submitting 1 . the general plan and program. This requirement is going to take some time to meet so we would like to ask for a delay , 1 in taking the next step until some time next spring. (1978) To date we have contacted the County and they have referred us to the City (See attached Washington County Dept. of Public Works report dated June 8, 1977) . Through our Engineer, James R. Harris , we have also contacted the Corps of engineers and got a status report on their progress in determining the flood hazard line along Summer Creek. Although the Corps of Engineers • states that their study will be available by late 1978 , Mr. Harris feels that there will be enough data available in the spring of 1978 to make a determination of the flood hazard line around 1130. Because of this we are requesting the delay. To , proceed at this time on our own would cost in the neighborhood of $6,000 and only be of use to this single parcol. Mr. Harris , has worked for the Corps of engineers and is a qualified hydrolo- gist, however, he helves that it would be beater for all con- cerned to let the Corps collect the data for water surface pro- files and flood-area mapping in the vicinity at this time rather than duplicate the effort ourselves. This new schedule will fit into the anticipated development time of the summer of 1978 also. (See attached letter from the Corps of Engineers dated 8 July 1977) . We will keep you posted on the progress that the Corps of , engineers is making and at what future time we will be ready to ' submit the general plan. Kenneth Soderlind of our staff concerning available flood information on Sumter Creek in Tigard, 0 Oregon. You stated that the information is needed to evaluate flood risk for a proposed development at the terminus of S.W. 113th Avenue just south of S.W. Tigard Street in Tigard, Oregon. The Corps of Engineers has not developed any information which would identify the extent of flooding along Summer Creek. However, some basic data have been prepared in support of a Flood Insurance Study of the Tigard area recently initiated by this office for the Federal insurance Administration. Included in that study is a detailed analysis l; which will include water surface profiles and Blooded-area mapping for is Summer Creek between its mouth and Scholls Ferry Road. The study results should be available by late 1978. The density proposed is not desirable and should be reduced. We feel the 1. 25 acres of land allowed by the developer can- not properly accommodate 14 dwellings . On the Preliminary program offered the plan states that the average "lot size" will be 5 ,000 sq. ft. Unless the overall size of the property is not 5. 84 acres , which is on record at City Hall , and the land to be deeded to the city is not 4 . 59 acres as stated in the program we can see no possible means to average the lot sizes at 5 , 000 sq. ft. Our calculations reveal an aver- '. age lot size of 3 ,111 sq. ft. for 14 dwellings after 20% is subtracted for street allowances on a 1. 25 acre development. Twenty percent of 1 . 25 acres reduces the area for 14 dwellings to only an acre! We feel that an exception to this extent is not warranted and the density should be reduced. To allow for 5 ,000 sq. ft. lot sizes our calculations show that 1. 25 acres can accommodate 8. 712 dwellings which is more acceptable to the adjoining neighborhood. 2. Due to the high density the parking available for the 14 dwellings is inadequate and does not support its own area. To scale on the proposed site plan there are only 8 parking space v available on the cul-de- sac. The cul-de-sac is cong64t:ed because of the higher number of driveways which irterrupt the norhal parking areas of the street. The . residents of 113th place believe that the result would be a burden on our street which would serve and the street parking for the proposed development. 3 , We do not oppose development of this area, but feel that the density and type of dwellings to be constructed on this Bite need further consideration. If a vote is to be held by the property owners in the area We would like to register a °NO V0TTR" for each listed at the bottom of this page . This statement is presented by the residents of 113th place and We request two weeks advance written notice of all hearings relating to this proposed development. The applicant is requesting preliminary review of a 14 unit . residential planned development on a 5 .84 acre parcel in accordance with Section 18. 56.020 of the Tigard Municipal , Code . • ,. 2 , The site is zoned R-7 (single family residential) and Wash- ington County RU-4 and designated. Urban Low Density on the Tigard Community Plan , 3, Section 18. 56 .010 states : "The purpose of the planned development district is to pro- . vide opportunities to create more desirable environments through the application of flexible and diversified land de- velopment standards under a comprehensive plan and program professionally prepared, The planned development district is intended to be used to encourage the application of new techniques and new technology to community development, which will result in superior living or development arrange- ments with lasting values , It is further intended to achieve economies in land development) maintenance, street systems, . and utility networks, while providing building groupings for privacy, usable, and attractive open spaces, safe circula- tion, and the general well-being of the inhabitants , " , • , 4, "Section 18, 56 ,020 provides for preliminary plan and program . A major portion of the site is within the 100 year flood, plain of Summer Creek, as designated by the Army Corps of Engineers . 6. A 50 foot sewer easement runs through the property. Build- ings would be allowed to abut the easement line . II . STAFF OBSERVATIONS : The site is presently used as a horse pasture, with a natural tree line along the border of the property. The eastern portion • of the, site slopes gently to a natural ridge, which drops two to H three feet to the flood plaii1 .the flood plain as common area Zill-etgetede=g2nild to IdMi- cated to the greenway system, The majority of the common area is grass covered with few trees of any size . The houses on Lots 1 and 2 are located in flood plain (see dotted line on site plan) . No flood plain fill has been requested. A 15 foot sewer easement is specified on the plan . According to engineering de- partment records, this easement is 50 feet . In addition, a culvert with riprap extends into the property from the subdivi- sion on 113th Place. The handling of this drainage system should be subject to engineering department approval , • The applicant is requesting approval for 14 units, whereas 29 would be allowable . III . CONCLUSIONARY FINDINGS : The preliminary concept is in accordance with the intent of the planned development ordinance . A natural drainage area is being retained, economies in land development , maintenance, street systems, and utilities are being demonstrated, however, no im- provements to the greenway are proposed. In keeping with past policy a pedestrian/bike path should be constructed, the common area landscaped, and passive recreation facilities provided , IV, STAFF RECOMMENDATION: • Staff recommends approval of the preliminary Plan with the con- , ditions that the general plan incorporate the following: 1, The site be surveyed to show the exact location of the 100 year flood plain ‘ \ .a.. Treliminary Program Our purpose is to develop moderate price& single family housing by clustering lots and housing units on the one buildable area of the site. Clustering lots will reduce utility lengths and thus development costs. Lots will be smaller than current zoning, but gross density will be less because of the large open space area retained by common ownership.. Development standards will be as follows : fifteen foot front yard, zero side yard, five foot rear yard. Average lot size will be 5,000 square feet. All lots will be of separate title, thus allowing fee simple ownership even where common walled structures exist. A fifteen foot sewer easement runs directly through the development area. Each unit will have its own connection to public sewer, maintain- '( ing the fee-simple ownership theory. 4,59 acres will remain undeveloped and shall be deeded to the City of Tigard for inclusion in the areenway„ The property will remain in a natural state and be maintained freo of noxious growth and weeds.
