(16) Children's day care II. STAFF OBSERVATION:" The parcel is presently occupied by a large farm house and out buildings which are used as a horse riding academy and boarding facility. The majority of the site is pasture, generally flat, I. with some change of grade in the southern portion but not af the magnitude to cause constraints for development. A small pont e..;:ists in the southern portion. The site is surrounded by single family -dwellings on rural sized lots on the east and 14' northeast and vacant wooded lots on the northwest -and south. Sewer is available to handle the proposed density on this site via a trunk line in S.W. Durham Road. Access to this line will be provided across an easement to be furnished by an inter- yelling property. Water service is available to facilitate the proposed density on this site via main lines in both S.W. Durham Road and S.W. 92nd Avenue. S.W. 92nd Avenue i8 in substandard condition and the intro- duction of zoning which qualified the property for 72 housing units necesitates that a half street improvement be provided. III. CONCLOSIONARY FINDINGS: 1. There exists a, public need to apply City of Tigard zoning to all parcels of land in the city in order to ease the administration of land use regulations, and provide con- sistency thoughout the City. 2. The applicant is requesting the application of the City of Ti- card zoning ordinance to a recently annexed (January 18, 1977) 18.65 acre parcel designated "Urban Low Density Residential" on the Tigard Community Plan, 1971. 2. City of Tigard Ordinance 77-2O (February 28, 1977) directs the Planning Commission to conduct such proceedings as may be nec- essary to conform the authorized zoning and land use of -the parcel to the reduirements of the City's zoning map and code. 3. The applicable policy from the Tigard Community Plan., 1971, is as follows: • a. "The mwzimum overall density of development Will be four dwelling units or 12 persons per gross acre. This amount to a 8tandard of 7500 square feet of land per dwelling unit allowing for streets and other open space. Some areas will ilave a lower density owing to topography, existing develop- ment patterns, or the desire of indivialals to own a larger lot. " LI. STAFF OBSERVATION: The parcel is presently occupied by a large farm house and out buildings which are used as a horse riding academy and boarding facility. The majority of the site is pasture, generally flat, with some change of grade in the southern portion but not of the magnitude to cause constraints for development. A small pont' exists in the southern portion. The site is surrounded by single family dwellings on rural sized lots on the east and northeast and vacant wooded lots on the northwest and south. Sewer is available to handle the proposed density on this site via a trunk line in S.W. Durham Road. Access to this line will be provided across an easement to be furnished by an inter- vening property. ' Water service is available to facilitate the proposed density on this site via main lines in both S.W. Durham Road and S.W. 92nd Avenue. S.W. 92nd Avenue is in substandard condition and the intro- duction of zoning which qualified the property for 76 housing units necesitates that a half street improvement be provided. III. OMICLUSIONARY VINDINGS: 1. There exists a public need to apply City of Tigard zoning to all parcels of land in the city in order to ease the administration of land use regulations, and provide con- sistency thoughout the City. 2. Com.rehensive Plan Conformance The proposed zoning--R7--is in conformance with the Tigard Community Plan. The following adopted City Objectives for urban low-density residential use are also the objectives 0 of the owner in requesting the proposed zoning to R7 in con- formance with the Tigard Community Plan: . a) to provide areas of the City having a predominately single- family residential character, b) to permit densities that will economically support the • cost of necessary public services and facilities, such as paved streets, pedestrian ways, and, utilities, and c) to permit a variety of housing types to meet the needs of different family size and family income. 3. Communilii:t The proposed R7 zoning will help to accommodate the continuing demand for more single-family residential development in this portion of the metropolitan area. Development of the property for residential use will provide • the opportunity for persons employed in the commercial- ,. industrial areas to the east along Interstate 5 to obtain convenient family housing, as well as providing housing for those who work elsewhere but choose to live in this desirable area of Tigard. 4. NeW Conditions Which Justia2.flonin2 Annexation of the property by the City provides the owner the opportunity to have city Utilities and services (sewer, water, fire, police, etc. ) extended to his property. The City is required to provide neW city zoning within a • reasonable period of time for all newly annexed areas. 5. 5titability of Location he property is a desirable location for residential home sites and is suitable for development at A7 density as called • for in the Tigard Community Plan, There are no physical site restraints to development. The topography is gently rolling over most of the site. The southern portion of the property provides choice view and wooded lots with more varied topography. Existing public utilities--sewer and water--are available to the property. The property has • good accessibility to the major arterial street system, 92nd Avenue and Durham Road. The property is located directly across 92nd Avenue from Tigard. High School, and residential development can make full use of the tennis courts, swimming center, and track and field area. Cook Park is located nearby at the end of 92nd Avenue. Community shopping facilities are proposed nearby in the Tigard Community Plan at Hall Blvd. and Durham Road. 6. Impact on Adjacent Properties Residential development of the property at R7 density will be compatible with adjacent properties and uses in, the ' immediate neighborhood. A number of adjacent property owners have been contacted and have expressed a desire for City R7 zoning and corresponding residential development. A majority of the immediate neighborhood is presently undeveloped, except for Tigard High School acrt78s 92nd Avenue. 7. Public Services Required • Public services--sewer, water, schools, police and fire pro- tection, etc.--are normally provided by local public juris- dictions to meet the needs of new development in area so designated for development in the comprehensive plans of each public jurisdiction. The new development pays the cost of these public services through system development charges and increased property taxes from the new development. The Tigard Community Plan proposes full urban services to the area within which the property is located. The property is adjacent to 92nd Avenue, which connects to Durham Road, a planned major arterial street. Existing sewer and water services are located adjacent to the property and are adequate to serve Site development at R7 density. Additional trunk sewer construction is proposed in the near future by United Sewerage Agency�of Washington County from �+ nearby Durham g g y �:om tiiezr Sewage Treatment Plant.
