• Dear Mr. Armstrong:
review of our records indicate that the Progress Bible Church property
received a Zone Change on June 26, 1978. Our letter to you dated July 6, 1978
states two conditions - .see enclosed exhibit A. We have no record of the
street dedication, the mobile classrooms have not been removed, and you have
not applied for a Temporary Use Permit. we have no record of you "acknowledging"
these conditions.
Earlier in 1978, you applied for a Conditional Use to operate a school in
the church - see exhibit B. An inspection of your property has been made.
Some of the conditions placed upon you have not been met.
Please review the enclosed documents. We should meet to discuss these issues.
At this time, you are operating contrary to the terms of your Zone Change and
Conditional Use.

THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Finding that the lands hereinafter described have been
heretofore and are now classified as Washington CoUnty RS-1
pursuant to the provisions of the City of Tigard' s Zoning Ordinance and
• Tigard Ordinance No. 75-52 , and further finding that pursuant to
prescribed procedures, the above-stated application for a zoning map
amendment was heard in a public hearing held by the Tigard Planning
Commission on May 16 , 1978 , and all interested people were there and
then afforded an opportunity to be heard, and thereafter the Planning
, . Commission filed its recommended approval with the City Redorder, a
copy therefore hereto attached and by reference made a part hereof,
the Council adopts the following findings :

A. There exists a public need to apply City of Tigard Zoning to all
' parcels of land in the City in order to ease the administration
of land use regulations and assume consistency throughout the
City.
B. The proposed R-1 zoning district is compatible with the
surrounding zoning and the Urban Medium Density Residential Plan
designation.

SECTIOV 2 : TH8REFORE, pursuant to the requirements of Chapter 18. 88 of ,
, . the Tigard Municipal Code, the applicantS request for an
amendment of the Tigard Zoning map of 1970 to zone those lands described
in the attached Exhibit "A" , for Single Family Residential (R-7) use is
hereby approved, subject to the provisions of Chapter 18.20 . (Single.

D. Staff Recommendation :
Based on the findings of fact and conclusionary findings,
staff recommends denial of the Phase II general plan
and program as submitted.
If the Commission elects to approve the request, staff
recommends the following conditions be attached:
1 . That prior to submission for Design Review a complete
storm water detention plan, covering Phase I & II
•
be submitted for Both Oregon State Highway Division
and Public Works Department approvals.
2. That a detailed site development' plan be submitted
for design review approval to include a frontage/
spine road (coordinated, with the owner ,of Tax Lots
900 & 1000 (Tax Map 2S13DD) , separate parking areas,
and final location of all proposed buildings,
landscaping and pedestrian/vehicle access/circulation. .
3. That a minimum 40 foot radius curb be provided at
the corner (north side) of Gaarde and Pacific Highway
as specified by the State Highway Department,
4, That a traffic analysis report be submitted prior to
Design Review that includes the impacts of the
frontage road.
5. That 10 feet of right-of-way be dedicated along the
S.W. Gaarde Street frontage and that a half street
improvement be made to collector street standards
as specified in the NPO #3 Plans
6, That the necessary right-of-way as specified by
the State Highway Department, be provided along the .
Pacific Highway frontage and that margin improvements,
be made including 5 foot sidewalks and curbs,
7, Provide better traffic circulation .

they had conducted a hydrological study which found the
storm water detention problems will be adequate in a •
series of areas throughout the site; the maximum. depth
will be 2 1/2 feet at center; the impact created by the •
commercial areas would be for a short duration only.

o Bibianne Scheckla asked for the specific detention
locations.
o Robertson said they would be in the larger open spaces
in the grass for short areas of time. ,
o Bibianne asked that the water areas be protected and
there be some form of vector control .
o Robert Ames, representing the present property owners H.
of the site, stated its present use was not safe for
children; the number of restaurants is equal to the
•
demand; this would be the greatest restaurant in Tigard;
and it is not often you get a nice company like Elmer ' s
Willing to wait around for all the development procedures.
o VanLorn stated through two (2) drainage studies the
problems had been identified and the lake takes care of
the immediate runoff from large storms and was a natural
part of the site development, the NPO never said this
had to be a planned development ; the site could have
developed independently,
o Roger. Staver cited the traffic report as showing 60 cats
a day (7%) coming off Gaarde which was not enough for
a curb cut .
o Altman stated the basic framework of the entire development
was necessary to be certain they will function together.
E, Commission Discussion:
o Quimby asked NPO #3 chairman if his committee had any
input into or comment on this propo$al,
o Kluempke stated no but they did not know there was to
• be a restaurant,
o Sakata stated she felt an obligation to the community
for a long range plan; there were other needs than
restaurants; they had made a sham of the NPO Plan and
• proceeded to read from NPO #3; this would only add to
• the strip commercial; the parking spaces adjacent to

the residential area would be noisy ; the traffic signal
• will serve as a shortcut for those turning left off
Pacific,
o Quimby agreed with Sakata; no need for another 1-estaurant ;
•• should be an office; this was not a planned development.
o Wood was not generally opposed to the restaurant but
felt it was the wrong location for timer' s being too
• small; a lower intensity use was needed,
o Aossman opposed the denial stating an tlmer' s was urgently
needed.

o J,B, read a letter from Charles Mgebroff, from NPO #3,
• who wanted to express his agreement with the plan, stated
citizens have accomplished what they wanted; professional
offices of Pacific Highway are desireable but not in demand;
he saw no major damage to the neighborhood; this was better
than a peicetneal development ,
Quimby asked if Mgebroff had voluntarily written this,

astounded by the change in the neighbors attitudes
previously they were against the proposal +
C. Staff Recommendation:
Based on findings of Tact and conclusionary findings ,
staff recommends denial of the preliminary planned
development proposal.
If the Commission elects not to deny the request as
recommended, staff recommends that the request be tabled
until the following information has been submitted:
1. A storm water detention plan be submitted. .for both
Oregon State Highway Division and Public Works

Applicant: Progress Bible Church
I . Findings of Fact:
1. The site i5 designated "Urban Low Density
Residential" on the Tigard Community Plan, 1971,
and "Urban Medium Density on the NPO 07 Draft
Plan. The site is currently zoned RS1 (County-
Suburban Residential) .
2. The applicant is requesting the application of
the City of Tigard Zoning Ordinance to a 2 acre
parcel annexed to City in September 1976 ,
(Ordinance 76-40) .
3. City of Tigard Ordinance 78-5A (February 27, 1978)
directs the Planning CommisSion to conduct such
proceedings as may be necessary to conform the
authorized zoning and land use of the parcel to
the requirements of the City's Zoning Map and Code,.
4. The site is currently occupied by the Progress
Bible Church, a mobile unit which is used for
Sunday school classes and a parking lot. The
• southern portion of the site is vacant. The
church has been operated for several years uhder-
appropriate authorisation from Washington County,
5. The existing structures are on a septic tank system.
' The applicant's narrative states that they have

experienced problems WIth the septic tank drainfield
• Which resulted in the county greatly restricting
the operating capacity of the church. Sanitary

12 inch line extended to 121st and Scholls Ferry
Road.
7. Southwest Scholls Ferry Road is designated an 0
arterial street requiring 80-120 feet of right-
of-way. The existing right-of-way is currently
60 feet. Therefore an additional 20 feet
dedication is required.
8. Southwest 130th Avenue is a local street and is
not intended to be extended through to the
Summer Lake Planned Development to the south.
The street is currently only graveled and presently
serves the church and five single family homes.
II. Conclusionary Findings:
1. There exists a public need to apply City of Tigard
zoning to all parcels of land in the City in order
to ease the administration of land use regulations
and assume consistency throughout the City.
2. The proposed R-7 zoning district is compatible with
the surrounding zoning and the Urban Medium Density
Residential Plan designation.
3. The mobile unit, used as a classroom is a temporary
structure and requires a temporary use permit in
accordance with Chapter 18. 80 of the Tigard Municipal
Code.
III. staff Recommendations:
1. Based on the findings of fact and conclurAonary
findinds, staff recommends approval sobject to the
, following conditions :
1. That 20 feet be dedicated to the public along
the Scholls Perry Road frontage for future
highway improvements.
2, That the septic tank system be approved for the
existing use by the Washington County Board of
Health,
3. That the mobile classrooms be removed or a
temporary use permit be obtained from the City
Planning CoMmission or City Council.
