Katherine St. , • owner of the property next to the entrance of the school was • ' concerned with the traffic pattern to be created on Katherine Street but was not specifically opposed to the new alignment. He stated the curves at the end of the street were better for traffic and the safety of the school; he wanted to know the width of the entrance street to the school. • k Altman stated the street was to the width required by the TMC, Risner stated the Design Review Report .stated the street to be 25 ' with one side sidewalks. • M . Greenwood asked how the school district could carry out Condition 43 to remove the garage structure which was not on their property? Was this a cOndition which could be imposed on the developer: Staff answered the school district would have to make arrangements with the property owners. • Herb ,Booke, 1/09 Blankenship Road, West Linn, for Century 21, stated they would rmove the garage if it was a4condition plaoed and further stated it would have to be removed anyway. Tepedino asked for a definition of other access routes to the 0 School. After being shown by Mr. Altman, M . Tepedino stated the 25 ' proposed entrance road to the school from Katherine would require much fill which would be in violation of the l'igard Municipal Code 's statement on flood plain fill; he felt this current request for a realignment of Katherine St. was an attempt to Mask the actual effects of the street construe,' tion through the flood plain; the property is a marsh and a hydrographic analysis wa5 neces8ary to preserve the health, Safety, and welfare of the kids at the school qood stated the heW alignment crosse5 the flood plain at the 1 8ame point as the old alignment. Wood stated he agreed with Tepedino; they should give direction to the school and the proposed new route was a good one; they needed to determine whether to fill the flood plain or not. Tepedino stated the issue of flood plain fill should be dealt with first., Wood stated as they needed a flood plain fill permit from the P.C. they might as well okay one of the routes now. Tepedino stated the need for hydrological studies first. Popp stated the right-of-way exists for the current desig- nation either the new or old alignment', and if fill would C be needed they would definitely need a permit, but would they need a permit if they were merely crossing the flood plain? He continued to say it would be a' separate item to be heard. He also asked if 25° would be adequate access to the school property. Brian inquired as to the exact steps needed if they were to approve this request and would they be able to review the access? Also what constituted fill? Altman read from the T.M.C. book defining flood plain fill. Quimby asked for the right to appeal the Design Review decision concerning the 25 ' access road. Greenwood asked where the limits of the flood plain are? Wood felt they should agree or disagree with the current proposal for a new alignment of Katherine Street. Tepedino disagreed with staff stating it was relevant and essential and critical now where the road goes and an engineering design was ne6essary. Wood made a motion for approval based on staff recommendations 41 and 42 with an additional item for the approval based only on Planning commission findings that the proposed route is superior to the existing route and that the P.C, has not addressed the iSsue of whether the old or the new route will be appropriate in its crossing of and possible fill of the flood plain and the approval of realignment does not involve any consideration of the entrance to the site. The zoning designation remains as Washington County B-4 General Commercial . It is appropriate that the land vie be designated under the zoning code of the City of Tigard. The request would transfer the General Commercial designation of Washington County to the General Commercial designation of the City of Tigard. COMPREHENSIVE PLAN ' The requested Zone Map Amendment conforms to the Tigard General Plan. PUBLIC BENEFIT The uses allowed under General Commercial will allow the property to service r the retail and office needs in the area of the community that are generated by the subject location adjacent to the Greenburg Road interchange, its interaction Washington Square Shopping Center and the other commercial activity along Shady Lane which will be developed in conformance with the General Plan. AREA DEVELOPMENT The subject property is surrounded by Cascade Industrial Park, a service ., station and the Highway 217 interchange. All services are available to the site. A curb-cut on Greenburg Road is already in existance mutually servicing the Mobil service station. Therefore, it iS compatible to the land Uses already in existance: The property is currently zoned in Washington County. The change in the jurisdiction to the City of Tigard justifies the zone change. SUITABILITY i s the only area of j the City of Ti gard that i s adjacent to Washington This . q e and the zoning is justified in its compatability to that major shopping • Square and also the main freeway interchange servicing the Center. IMPACT The surrounding land use are of a higher use than the request, ti The traffic would enteo the subject through an existing curb-cut on Greenburg Road, . . ,. . _ -. . • . _ .-. • .- - . . . . - . ..........,.., - _, . . .. _ . --1,---7-......---4,•••-- --,..o.,"......--*--=-4,,,_-f-i I. -----,...;,....-,-.=-.n...--- ...tsz4«...,..7-.:V.-r,f-VrFr. r.'-...-t'.?P .-..-s-,.----..„ ,.---...m.A4-,,,:,,,,,,,,,....., ..... cs 73o9- it :40,1'i, „b... , -v .; ,...r. -... i -e q Er ittAP- 1 c li 35RA. 0 \ - Cat tn. / i :i,kfr ---°- ---5,-- C Fl 823 -H Az-'a t -- -- I--,..„ 0 Ak P? 41., k ‘4!1--- ---- -- --- --... - ■ I . 1 1., C . - , _ , - i .1 4../ 5.48c,.It--s --- r- - ' .A.73.), \ 1 oo - ; It! w I N IT IFR_"-3 ..:-.r"OCI4T ''-..;^ /11171-- 2 31:254C. - et', s 1 I. c-C)x0: q;', i/ _fa'; -f , \ I _ i", ..,:.CI ...„. \ N.. !' ri...). 0 u i I r",... \ to --- 7 ilt7 3_ • _,____ "_ IN- ;-'410r- tiogra-66 .. :._-_41.r_.,- .. -4- ti,\ riiiit.i.i Lir'd i ,,, \ :%; ..,, , . . / ‘.: ,-, 1 - q . . i g., _ / As, ..........j... r--71 -. ,....c -„, ,_, __..,..:- -,-.4.:-.--..,, , - - \ -it ! . , ___ . ,. .. ., As_ . t-r-'VT' ,s. 1 * iU'll TY / • ----r 4- -I -. i Ei\rA - 1 0 0.ir , 5564c: .. .:• - ---_-;.,.:-- __ ... • - - - .. ) 4_ _ _ _N.
