AN ORDINANCE GRANTING A ZONE CHANGE WITH RESPECT TO THE LANDS OF
H. RUSSELL GOULD and VIRGINIA LEE GOULD, RAYMOND B, EMS and PHYLLIS
• G. EMS, Roiling Hills Plat 2, TIGARD, WASHINGTON COUNTY, OREGON
WHEREAS, the hereinafter described lands, by action of the
City Council of the City of Tigard, Oregon, pursuant to the Zoning
Code of said City, have heretofore been limited in use to those uses
permitted by said Code, under, and have been classified and zoned
for, part M-3 (Light Industrial) and Part R-7 (Residential) and
WHEREAS, pursuant to prescribed procedures, the owners of
said lands have applied to the City of Tigard for reclassification of
said property and change of zone thereof to permit the use thereof
for M--4 (Industrial Park) purposes, and said application has
been duly publicized and public hearing held by the City Planning
Commission on September 19, 1967 after due and legal notice; and
WHEREAS, the Planning Commission has recommended cis approval
of said zone chance to the City Council, and due and legal notice of
City Council hearing having been given by publication in the Tigard
Times and the City Council having heard same at its regular meeting
of October 23, 1967
and the Council finding that no public '
detriment will result from granting of said petition, and that it is
in the public interest that said zone change be approved, and the lands , 1
re- zoned from part .M--3 and part R--7• to My-4 ( Industrial Park)
NOW, THEREFORE, '.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the following described lands be, and the same are
hereby, zoned as M--4 for use in accordance with the
M-4. (Industrial. Park) classification of the Zoning Code of I'
the City of Tigard, which Zoning Code with respect to the MJl
classification is by reference herein made a part hereof:
Beginning at the initial point of ROLLING HILLS PLAT 2, a subdivision
of record, Washington County, Oregon, thence North 88°51110" West a
distance of 780.42 feet to the Southwest corner of Lot 37 in said
subdivision; thence Southeasterly 670 feet more or less to the South-
, east corner of that tract of land conveyed to Raymond B, Ems by deed
recorded on Page 3211, Book 339 of said County Deed Records; thence
North 88°42130" East 1642 feet along the south line of the W,W,Graham 1:
D.L.C,//39; thence North 0°59'50x' East a distance of 24,02 feet to an
iron pipe; thence North 89°37" East a distance of 293,77 feet to a
point; thence North 0°3l' East a distance of 348 feet, more or less
to the point of beginning.
Section 2: This ordinance shall be effective on the 31st day after
its enactment by the City Council of Ti `,ar d, Oregon.

Gentlemen:
I regret that due to a prior evening commitment
in Rainier, I am unable to appear before the Tigard Planning
and Zonning Commission regarding this matter.
My wife and I reside at 7570 S. W. Cherry St. , Tigard)
Oregon, otherwise known as Tax Lot 2100, Lot 35, Rolling Hills
No. 2 , Washington County. This property is directly adjacent
to the property on which the zone change is sought.
I am concerned that the re-zoning may have adverse
effects upon our living conditions in this area and upon
property value. A number of adjacent property owners have
indicated a similar concern to me. While the City of Tigard
may not, at present, feel a complete responsibility to the
residence of Roiling Hills addition No. 2 , regarding zoning
in that area, it is only a matter of time until it will be
the City' s responsibility. This area I feel, is a logical
extension. of the City of Tigard. The homes in this area are
in the $20,000 to $30,000 price range.
If caution is not exercised now concerning the
type of industry which is allowed to locate next to this fine
residential area, a continuous problem to residents, industry
and City will be the result.
• feel , the proper course would be for the Commi-
ssion to withhold action on the proposed zone change until
a complete set of plans and specifications for a suitable
and compatable development next to this residential area is
submitted.

Planning & Zoning Action: Denied
1. There would be an increased traffic load on S.W. 72nd.
2. There would be a possibility of noise from night work.
3. The zone is generally incompatible with the present R-7 (Residential)
which is immediately adjacent to the zone change request.
4. The zone may be desirable in the future, but is felt that at
present, it would be poor timing.
ITEM 2 - RAYMOND B. & PHYLLIS EMS - SW 74th and Cherry

The parcels which have been referred for zoning
southern part of tax lot 3600, 3300 and 1200 are
east of the Portland Seattle Railway about 250 feet,
• west of Interstate 5 approximately one third of a mile,
and bordered on two sides by light industrial zoned
land. Long range plans of both Washington County and
the City of Tigard foresee this area as extremely
desirable for light industrial development.
Access would be provided by 72nd Street, and sewage
facilities are completed within approximately 1000 '
of parcels.
RECOMMENDATION:
City staff, therefore, recommends approval of the
requested zone change. In addition, suggest Planning
and Zoning Commission request property owner to
. dedicate sixty feet of right-of-way to 72nd street.
