Dear Ms. McCreight:
This letter is in response to our conversation on Tuesday, May 3, 1983. I ''
have reviewed your files for a zone change and minor land partition (ZC 1-82 &
MP 2-82) and to the best of my recollection the following sequence of events
occurred:
1. On March 2, 1982, the City of Tigard received application requests
for a zone change and minor land partition under the name of Mitchel
A. Robuck and Kevin M. Varney, with Kenton and Cayla McCreight
signing as owners.
2. The property in question is located on the north side of Bull
Mountain Road, Washington County Assessor Map # 281 10BD, tax lot
900, approximately 10.02 acres in size.
3. The zoning of the property was RU-30 (County designation) and the
request was for R-10 (City designation). The City had not previously
rezoned the property since the property was annexed in September of
1978.
4. The minor land partition would have created 2 lots; one 20,300 square
feet in size and the other lot would have been the remaining area of
the 10.02 acres.
5. The zone change to R-10 was for the 20,300 square foot lot only The
other larger lot would remain RU-30.
6. The proposed R-10 zone change request would have been in compliance
with the Comprehensive Plan designation (Suburban Low Density
Residential) which included R-3O, R-20 and R-10 City zoning
designations.

7. These proposals were placed on the April 6, 1982 Planning Commission
agenda, however, they were later removed from the agenda because of
inadequate notice by the City.

9. Prior to the Planning Commission hearing date, the city received two
letters and numerous phone calls in opposition to the proposals as
requested.

10. Due to the amount o4't opposition to the proposals as requested, the
applicants discussed the possibility of changing their proposal from
R-10 to R-20 which was agreeable by the surrounding property owners.
11. Staff discussed this option with Gayla McCreight who indicated that
an R-20 on the smaller 20,300 square foot lot may compromise her
ability to request a zone change for a zone other than R-20 on the
remaining property.
12. She was told by staff that she had the option to withdraw the �.
application if she felt that the alternative request would compromise
her interests.
13. Prior to the May 4, 1982 Planning Commission, Gayla McCreight
instructed City staff to withdraw the applications from the May 4,
1982 Planning Commission agenda; which staff did.
14. On May 6, 1982, the Planning Department received a written withdrawal
from Gayla McCreight.

In response to a request for a zone change and minor land partition
on the land, in the above mentioned parcel,the Community Planning
Organization #4, Bull Mountain, is opposed to this zone change.
The subdivision on the east is developed at 20,000 sq. ft., and the
subdivision on the west is developed at 30,000 sq. ft. The proposal
to create an additional 20,000 sq. ft. lot in the minor partition is
within the existing zoning in the community, but the need for the
request to 10,000 sq. ft. doesn't seem to be justified in light of
the request to remodel the existing dwelling on the land. The
Community Planning Organization was involved in the planning of the
existing subdivisions and we oppose any change to smaller lots in
this area as we believe the development of the neighborhood and
larger community was established with the lot size of the two existing
subdivisions already in place.
Further, there is no apparent need for any new road dedication it this
application for this minor land partition use of the existing dwelling
now c the sight. Even with the eventual develortnent of tax lot 900,
there are existing roads that can be used which are already built to the
proper standard and will not make any more large intersections into
Bull Mountain Road in such close proximity to one another needed.

AREA CHARACTERISTICS
The surrounding land uses (see attachment `1B ) are as follows:
The areas surrounding the site have been developed for single family residential.
Those areas are zoned ft-30 (Single Family Residential) to the west and R-70
(Single Family Residential to the east. The area to the south is within the
County and is not designated on the Tigard Comprehensive Plan. The area to the
north is within the County, as well as the City, and is designated Urban Low
Density Residential on the Comprehensive Pla ) and zoned R-7(Single Family
• Residential).
SITE CHARACTERISTICS_
Presently, there is a partially reconstructed dwelling and a carport on the
southerly portion of the site. Ther0 are numerous evergreen trees along the
easterly property line. The remaining portions of the site are grass covered
and the site slopes to the north.

B. APPLICABLE PLANNING CRITERIA AND STAFF ANALYSIS
1. LCDC Statewide Planning Coal 11 - Public Facilities and Services:

Sanitary Sewer and Water - Currently, there is a eight-inch sewer line in
•�.. S.W. Wildwood Street street and S.W. McFarland Boulevard, which are adequate size
to serve the site. Additionally, the is a 12-inch water maix; line which
is adequately sized to serve the site.
Drainage - According to the Engineering Division any additional development
on the site would be required to connect to the ShawdoW Hills storm sewer

2. LCDC Statewide Planning Goal 12_ '- Transportation:
The site is accessible from S.W. Hull Mountain id which is currently 40 feet

Ac cording to the NPO # 3 Land Use Plan which was adopted by the Council in
December of 1975 the site is appropriate for suburban low density which
includes the zoning designation R-10 (Single Family Residential) with a
minimum lot size of 10,000 sq. ft.

V 4. NPO # 3 Policy 6. :
Development will coincide with the provision of public streets, water and
sewage facilities. These facilities shall be (a) capable of adequately
serving development and (b) designed to meet City or County standards, and •
LCDC Statewide planning Goal 11 - Public Facilities and Services. As
stated earlier there are adequate public facilities and services to serve
the site.
5. LCDC Statewide Planning Goal 4 - Forest .
The objective of this goal within urban areas is to preserve and provide
treed areas. Currently, along the easterly property line of the site,
there is a Windrow of evergreen trees which provide an aesthetic Visual
amenity to the area which is generally devoid of evergreen trees.
The City has stated that in order to adequately serve the remaining portion
of tax lot 900 it would be necessary to provide another access point onto
Bull Mountain Road. Given the location of the existing structure this
access point would be in the same location of the existing trees. Staff
believes that the character of the site will be dramatically altered once
the trees are removed, yet staff also recognizes the need to develop the
property and
p y provide adequate vehicular circulation that would not adversely
ro
impact the surrounding residences. Wherefore, staff believes that a re
forestation or planting plan should be st omitted and approved by staff once
development occurs on tax lot 900 and the proposed partitioned lot.
6. LCDC Statewide coal 10 - Housing.
The intent and objective of this g oal is to provide adequate goal rovi uate and affordable

C. MINOR LAND PARTITION ,
The application for a Minor Land Partition meets all of the submittal requirements
of section 17.07 of the Subdivision Ordinance. In order for this Minor Land
Partition to be approved the proposed Zone Change must also be approved by the
Planning Commission.
D. SUMMARY .
In staff's review of the various policies and criteria, the proposed Zone Change
and Minor Land Partition complies with the applicable requirements.
L. CONDITIONS OF APPROVAL
1. The owner of the proposed lot shall dedicate an additional fifteen. (15) feet
of right-of-way the entire length of the proposed lot that abut S.W. Bull
Mountain Road. This dedication shall be submitted to the City for review
and recorded by the owner prior to the recording of the Minor Land Partition.
2. The applicant/owner of tax lot 900 of map 201 1OBD shall dedicate a 50 foot
right'-of-way for street purposes from the existing right-of-way on S.W. Bull
Mountain Road to the,northerly most property line of the proposed lot along
the easterly property line of lot 900. This dedication shall be submitted
to the City Planning Director: for review; and recorded by the owner, prior
• to the recording of the proposed Minor Land Partition.
3. The owner of tax lot 900 (Map 2Sl-1OBD) shall sign a non-remonstrance agree-
ment for the future improvement of O.W. Bull Mountain Road prior to the
recording of the proposed Minor Land Partition.
4. A landscape plan indicating where additional street trees maybe located on
the site shall be submitted concurrent with the required right-of-way
dedications.

ZONE MAP AMENDMENT (2S1 10BD, Parcel A, Tax Lot 900)
1. This request is to change the current zoning on a portion of
Tax Lot 900 (Parcel A) from County RU-30 to City R10. The applicants
have resided in the single family dwelling on the property for seven
years. When they indicated interest in purchasing approximately 20,006
square feet of the property and residence thereon, they were granted
a building permit by Washington County for remodeling the premises.
The county records indicated at this time that the property was
zoned RU-20. Since September 1981, the applicants have expended
$12,000 in remodeling expenses on this house. Applicants areTinancially
unable to purchase unit as presently zoned (RU-730) and therefore, this
request is to rezone the property so that the applicants will be
able to complete the remodeling and purchase the property.
2. The proposed zoning change is in conformance with the Adopted
Comprehensive Plan. Since this area was not brought into City
Zoning after annexation, this will not be inconsistent with
the Plan or with surrounding land uses. There are subdivisions
east and west of the subject site which are zoned R20 and R30.
All appropriate set backs and other code conditions are complied with.
3. There is generally need for saleable smaller single family dwelling
units as a result of present economic conditions.
4. This zone change will not result in any environmental, econonic or
social conditions or ih changes in availability of public survices.
The dwelling in presently on site and occupied by applicants, so
none of the above items will be affected. Access for future
community development (if desired) would Libe.,:z7, enhanced by the
dedication of a right-of-way easement as indicated on attached map.
5. This property is the only site that is practical for the applicants
because of the previously expended remodeling expenses (see Item 1,
above).
6. This proposed rezoning will have no impact on adjacent sites. The
usage of this part ]. Will remain the same as previously, with no iS
increase in traffic, schools, police and fire protection, etc. This
request will have no detrimental impacts on surrounding land values.
• This application is submitted concurrently with application for
a Minor Land Partition on the subject parcel.

MINOR LAND PARTITION APPLICATION (2S1 10BD, Tax Lot 900) ,
1. The purpose of this minor land partition is to separate 20,000 square
feet from the present Tax Lot 900 so that the present tenent can
purchase the property and existing single family dwelling thereon.
The applicants have resided in the single family dwelling on the property
for seven years. When they indicated interest in purchasing approximately
20,000 square feet of the property and residence thereon, they were ` :'
were granted a building permit by Washington County for remodeling +
the premises. The county records indicated at this time that the
property was zoned.RU-20. Since September 1981, the applicants � .:

have expensed $12,000 in remodeling expenses on this house. Applicants ' ,•
are financially unable to purchase unit as presently zoned (County
RU-30) and therefore, this request is to partition Parcel A, along
with a concurrent rezoning application for City of Tigard zoning ; . •
R10, so that the applicants will be able to complete the remodeling +; . .
and purchase the property.
2. The proposed partition is in conformance with the Adopted Comprehensive .
Plan. Since this area was not brought into City Zoning after annex-
: • ation, this will not be inconsistent with the Plan or with surrounding
land Use There are subdivisions east and We of the subject site
which are zoned R20 and R30. All appropriate et backs and other
code conditions are complied with in the partition request. { .:
3. There is generally need for saleable smaller single family dwelling
units as a result of present economic conditions. .
4. The proposed partition will not result in any environmental, econimic ;` :J
or social condition changes or in changes in availability or public
services. The dwelling is presently on site and occupied by applicants,
so none of the above items will be affected. Access for future
community development (if desired) would be enhanced by the
dedication of a right-of-way easement as indicated on attached map.
5. This property is the only site that is practical or economically
feasible because of the previously expended remodeling eXpehses �.
4 . (see Item 1, above).
6. This proposed partition will have no impact on adjacent sites. The
' usage of this parcel will remain the same as previously, with ho
. increase ih traffic, schools, police and fire protection requirements.
This request will have no detrimental impacts on surrounding land values.
