Roll Call: Present: Bledsoe, Remsdell, Smith, Mortensen and • Porter. Absent excused were Fyre and Moonier. 3. Minutes of April 4, 1983 were approved as submitted. The meeting of May was postponed awaiting publication of the Community Development Code. • 0,onsideration of Conditional Use fulfillments on in Bishop project (Pietro's) : We had received three documents: ( I) o report by Planner Liz Newton on fulfillment of the conditions, prompted by inquiries made by Ralph Furrer, (a) a response by JB Bishop to N. Newton's report, and (3) a summary report by Planning Director Bill Monahan in response to JB Bishop's letter. Mr. Ralph Furrer had inquired a couple times about our meeting but he was not present, later he told NPO #3 Chairman Bob Bledsoe that he was unable to find the French Room, for which we are sorry. Mr. Monahan's letter stated that only three conditions were un- resolved, the primary being Condition #7 requiring landscaping of/ for Phase 4 of the project. Of the other two issues Mr. Bishop said he would supply a document requested in Mr. Monahan's Item ill, and Mr. Bishop said 'tam #3 is between the Building Department and the Fite District. JB Bishop said he mows the property once per year This year it was just recently, This is the same practice as other commercial un- dev ,loped properties nearby, specifically across from C.F. Tigard School, behind Standard Gas Station, behind Hancock Gas Station, along Hall and McDonald, and behind Canterbury Square. NPO #3 is conclusion is a$ follows: The responses by JB Bishop seem adequate. Instead the parties should agree to return an enclosed postcard as verification of receipt of documents mailed. c. Section II Cl The modified wording proposed by City Attorney Ed Sullivan should stop after the word ''conflicts." NPO ##3 believe13 it is a violation of the City's comprehensive plan to promise not to preclude transportation plans in the County's plan, since their plan is in opposition to the City in regard to Durham Road and the Murray Boulevard Extension. ` 6. Other Business: NPO ##3 objects to the May 12, 1983 letter [rum Planning Director Bill Monahan to Washington County Planner- Rick Daniels, which was entered as testimony for the County transportation plan. The letter does not accurately reflect the position taken by the City in its adopted comprehensive plan. This leads to the`general issue that the City should establish and enforce policy that i its employees shall accurately reflect the position of the City as adopted in its ordinances in their communications to, other government agencies. The NPO Directed the chairman to write a letter to Council and to seek a hearing on these two items. • 7. Community Development Code The Chairman, Bob Bledsoe, explained the copies that all NPO #3 members had received of selected sections of the code. This memo is in response to your internal draft memo from Liz Newton to you regarding my 7 plus acre commercial property commPnlY known as hTigard Nest" . Please be advised that I am in the process of reviewing my project files, the planning staff's files pertaining to NPO #3 meetings along 1 . with the ninutes and tapes derived from hearings in front of the planning commission and council as a part of the approval process of ZC I-78. Additionally, I am reviewing my architectural plans, which have been stamped and approved by the building department for the "Sthn Wiley" and "Pietro's buildings. In direct comment to your memo and query on the status of the conditions that were attached to ZC 1-78, I offer the following responses: Point 4I- Examination of your records in the building department ill show City approval and acceptance for the above referenced two buildings! The state highway department approved this matter along with their high- way access permit process and an examination of this process, will confirm this statenentil Point #2- Yes, an agreement is required I did 'obtain it, as part of the highway department's policy of granting access permits. Thirdly, I am not required or directed by ZC 1-78 to file this with the City, but, if it is so requested as an extraordinary procedure, I will do sol Point 44- Concrete sidewalks , installed per code, have been installed along the frontage of both above referenced buildings, not just the Pietro's building as observed by staff. This project was approved and planned to be built in stages and obviously the remaining frontage on both sides of Pietro' s is currently vacant awaiting develop- ment. As contemplated from the start of my development plans in 1977, I will install sidewalks along gighway 99 when 1 begin development on these lands, as is common practice for other landowners in Tigard! MEMO TO Bill Monahan FROM: Liz Newton SUBJECT: Pietro's Pizza Site • As you may recall we met with Mr. Ralph Furrer on May 6, 1983 to discuss his concerns relative to the landscaping requirement placed, on the property as a condition of the zone change granted in 1978. After our field check on May • 12, 1983 and my review of the applicable files, I find the status of conditions attached to the subject property to be as follows: Conditions attached to zone change (ZC 1-78) 1. That a storm water detention plan be submitted for both Oregon State Highway Division and. Public Works Department approvals. The Public Works Department does not have a copy of a storm water dentention plan on file. 2. That an agreement be obtained from the Oregon State Highway Division • accepting the storm water outfall within their system. + ' A copy Of the above agreement is not on file with the City. 3 That an indirect source permit be issued by the Department of Environmental Quality prior to final zone change approval. There is a note in the file that an indirect source permit is not required. 4. That a standard concrete sidewalk be installed along Pacific Highway according to code. There is a concrete sidewalk in front of the Pietro's building but not along the remainder of the site. ■ 5. That a half-street improvement be glade on S.W. Park Street. This condition has not been met. 6 That the Sewer Wiil be extended at the developeris expense to serve his proposed commercial buildings and the proposed duplexes to be constructed on S.W. Park Street. The sewer is in place to serve the entire site. 7. That the area designated as Phase 4 be landscaped and maintained until such time as phase 4 is constructed. A landscape plan must be Submitted to site design review' for approval prior to installation in the area designated as Phase 4• e 1 I • This condition has not been met. 8. That the entire project be subject to site design review prior to } e.. issuance of a building permit. Site plans were submitted for the entire project, however, a site I' design review was only completed on Phase I. • 9. That types of uses for building designated on the site plan i.e. , retail, housing, commercial office, restaurant, etc. not change unless in strict conformance with NPO # 3 Plan. No changes have been proposed. 10. That plans be approved by the Tualatin Rural Fire Protection District for emergency access. There are no plans for emergency access which have been approved by the Tua1 'tin Rural Fire Protection District in the City's files. 11. That Phase 4 be limited to "commercial-professional" use as that term is defined in NPO # 3 Plan as of September 25, 1978. Dear Mr. Harris: When highwa!' construction requires City of Tigard or its contractors to enter onto private property to do work as part of a project, the property -A owner must give their consent before the City can do this. Under Title • III of Public Law 91-646, Uniform Real Property Acquisition Policy, the prOpe:rty owner is entitled to just compensation for the property to be acquired. Should you desire to receive compensation, we will have the property appraised and make you a monetary offer based on the aPpraisal. • This includes not only purchase of property, but construction permits, easements, etc. However, the Law also provides that an owner may donate the necessary property right if he wishes to do so. The subject property to be donated is described in the attached letter from Ron Kleinschmit, Department of Transportation. All construction and relocation costs to be borne by the T.S.M. AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO AN APPLICATION BY REMBOLD -BISHOP PL OP/SA.TIES FOR AN AMENDMENT TO THE 1970 ZONING MAP OF THE CITY OF TIGARD, CHANCING THE ZONE DISTRICT OF A TRACT OF LAND DEPICTED ON WASHINGTON COUNTY TAX, MAP 2S1 2CB, TAX LOT 1800; 2S1 2CC, TAX LOT 700; 2S]. 3DA, TAX LOT 4700, F1&O "C-3" RETAIL COMMERCIAL-PROFESSIONAL TO "C-3" RETAIL COMMERCIAL-PROFESSIONAL PLANNED DEVELOPMENT AND ADOPTING EXHIBITS "A", o'B", & "C", GRANTING THE APPLICATION AND FIXING AN EFFECTIVE DATE. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: Finding that the lands hereinafter described have been heretofore ~_ and are now classified as "C-3" Retail Commercial--Professional and further finding that pursuant to prescribed procedures the above-stated application for a zoning map amendment was heard in public hearing held by the Tigard Planning Commission on August 15, 1978, and all interested persons were there and then afforded an opportunity to be heard, and thereafter the Planning Commission filed its report and recommended approval with the City Recorder, a copy therefore hereto attached and by reference made a part hereof, the Council adopts the following substantive findings 1. That the application is in conformance with the land use designation and policies of the NPO #3 Plan, and 2. That the proposed zoning is compatible with the surrounding » land uses. The parcel is surrounded by single family zones to the north and west; to the south and southeast and across Pacific Highway are several large undeveloped parcels and commercial buildings. • 10. For an assessment of the traffic impact of this or alternative development schemes , see Carl Buttkels report which was commissioned by the applicants. • 11. A traffic signal is planned for the northerly access to the development. The proposed signal fits into the • TSM (Transportation Systems Management) Paln and will be paid for by the developer. II , Conclusionary Findings : • 1. The proposed development conforms to the land use designation and policies of the NPO g3 Plan. • 2 . The proposed signal is not warranted at this time and will be reviewed again at said time that Phase 4 is completed and more knowledge on the future develop- ment across Pacific Highway is available.
