Please be advised that the Tigard City Council, at their regular meeting
of April 12, 1976, ratified Ordinance No. 76-15, a copy of which is

enclosed. The City Council has approved your zone change request with 1 :
the following conditions as stated in Section 2 of the enclosed ordinance.
1. That a 10 foot right-of-way be dedicated to the City of
Tigard for future street widening.
2. That the applicant waive his right,, for the next 10 years;
to remonstrate against the formation of a local improvement
district to provide public improvements in the right-of-way
of 98th Street.
3. The applicant shall submit a detailed plotting of the stand
of trees for use by the Design Review Board when reviewing
the site development plan.

AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO AN APPLICATION BY GORDON
CARPENTER IN BEHALF OF MARGARET HANNA, FOR AN AMENDMENT OF THE 1970
ZONING MAP OF THE CITY OF TIGARD, CHANGING THE ZONE DISTRICT OF A TRACT
OF LAND FROM SINGLE FAMILY RESIDENTIAL, (R-7) TO MULTI-FAMILY RESIDENTIAL
(A-2); THAT TRACT BEING TAX LOT 900 ON WASHINGTON COUNTY TAX NAP 1S1 35CD;
GRANTING THE APPLICATION AND FIXING AN EFFECTIVE DATE.
THE CITY OF TIGARD ORDAINS:
Section 1: Finding that the lands hereinafter described have been
heretofore and are now classified as Single Family Residential
(R-7), pursuant to the provisions of the City of Tigard's Zoning
Ordinance and Tigard Ordinance No. 70-32, and further finding that pursuant `.
to prescribed procedures, the above-stated application for a zoning map
amendment was heard in a public hearing held by the Tigard Planning
ofruha ssion on March 2, 1976, and all interested persons were there:acid "Chen

filed its report and recommended approval with the City Recorder, a copy
thereof hereto attached and by reference made a part hereof, and, further,
finding that, after due and legal notice, a public hearing was held before
the City Council on March 29, 1976, and that at said hearing the applicant
and all other parties desiring to be heard were afforded an opportunity to
be heard and present and rebut evidence with respect to said application,
and further, finding that, based on evidence, both oral and documentary, and
on the record of said hearing before the City Council, the Council has
made the following substantive findings:

Section_ 2: THEREFORE, pursuant to the requirements of Chapter 18.88
of the 'riard Municipal Coded the applicant's request for
an amendment of the Tigard Zoning Map of 1970 to zone those lands
described as:
Being a part of the John L Hicklin Donation Land Claim E.
No, 54, Township 1 South, Range 1 West, Willamette Meridian,
Washington County, Oregon, and more particularly described as
follows, to-wit; Beginning at an iron pipe on the. East line
of that certain tract devised by Mary M. Greenburg to Henriette
W. Rue, et al, by deed recorded at Page 4, in Book 131 of the
Records of Deeds, for Washington County, Oregon; said beginning
point being South 0° 03' East 739.4 feet from the Northeast corner
of said Greenburg Tract; being also the Southeast corner of the
Hadley Tract as described in Book 341, Page 309, said Deed Records,
running thence along the East line of the said Greenburg Tract, South
0° 03' East 215.6 feet to an iron pipe; thence North 89° 58' West
536.7 feet to an iron pipe on the Easterly boundary of the Southern
Pacific Railway right-of-way; thence along the said right-of-way boundary
North 19° 00' West 228.0 feet to an iron pipe at the Southwest corner
of said Hadley Tract; thence South 89° 58' East 610.9 feet to the
place of beginning.

provisions of Chapter 18.29 (Multi-Family Residential zone) of the Tigard
Municipal Code and further subject to the following conditions:

A request by Gordon Carpenter for an amendment of the Tigard
Zone Map from R-7, single family residential to A-2, multi-
family residential located in the vicinity of 11535 S.W. 98th,
(Wash. Co. tax map 151, 35C, tax lot 900)
STAFF FINDINGS
•
1. Proposed development is for 32 dwelling units on a single
2. 83 acre parcel. The net density is approximately 11
units per acre.
. 2. The site is designated a medium density residential on
the NPO #2 land use plan, which pertains.
3. The site is adjacent an A-2 Planned Development zone
(Scott Court development) which is developed at a density
of 7 units per acre.

4. Right-of-way dedication on S.W. 98th Avenue is necessary to .
provide the additional 10 feet necessary for street widening.

on the site)
• 5. Setbacks of the buildings from the Railroad right-of-way
to the rear of the site should be adequate to provide for
sound and sight screening, as well as to minimize
interference of vibrations generated on the railroad

We enclose a map of Tax Lot 900 and a proposed plan for devel-
, oping it as a Multifamily Residential area which conforms with the
Tigard Comprehensive Zoning Map. Our purpose i8 to formally reqUest
this zone change or Conditional Use Permit for this parcel of land.
Irre have studied the greater Porbland area, and the Tigard area
in particular and have concluded from available statistics that there
is a need for more housing in this area, and particularly for duplex
=i• s . A survey prepared by Apartment Data Center showed that there
was a 0 vacancy in duplex units .
Ubilit.%es needed to serve this proposed project are available
on S .W. 98th Street; specifically, electricity, sewerage, water, ancli.
telephone. The access street is already paved and of sufficient
width to serve the neiehborhood.

residential area and when finished and landscaped would be a distincb
asset to the adjacent nei3hborhoods . The one storey duplexes would
conform ‘..abh existing architecture of the area. Vtilities and services
needed are already set up and available for the city. The addition
of this project would increase the tax base considerably and provide
more income for the city to pay for these utilities and services .

R-7 to A-2, accompanied by the Tax Map, site plan with proposed
development, application form sloped by the owner and myself, title
insurance policy os proof of ownership, and our check for the
