Site Information and Proppsal Decripti9n L. A house and accessory buildings are situated in the northeast corner of the property, An orchard covers the remainder of the parcel except for the southwestern corner which consists of large fir trees and brush. The applicant proposes to develop a 113 lot, single family residential subdivision with lots ranging from 4,000 to 9,500 square feet with an average size of approximately 5,000 square feet, No common open space is proposed, A minor collector street is proposed to extended west from • the North Dakota-121st intersection to the northwest corner of the project. It is intended that this street will continue through the apartment development to the north and intersect with Schools Ferry Road at Sorrento Road, 5, haansynd NPO Comments The Engineering Division has the following comments: a. The area which is to be acquired from the property to the south to accommodate the North Dakota Street extension should be dedicated and improved prior to recording the final plat, b. Due to small lot frontages, partiCularly in the cul—de—sacs, joint use and maintenance of common driveways will probably be necessary, Agreements relating to any common driveways must be approved by the City and recorded. • c. A one foot wide non--access strip shall be created along the 121st Avenue and County Road 11350 Frontage for Lots 46 through 594 d. A one foot wide reserve strip shall be created at the northern terminus of the North Dakota Street extension, e. The necessary off—site storm and sanitary sewer eaailment(s) be accepted and recorded prior to recording the final plat, The Building Inspection Office, Washington County Fire District No. 1, and NPO #7 have no objection to the proposal, B. FINDINGS AND CONCLUSIONS The relevant criteria in this case are Statewide Planning Goals 1,2, and 10'6 Tigard Comprehensive Plan policies 24141, 8 .5.4, 6.3.2, 6.3.3, and 8,1,1; and Chapters 10,00 and 18,92 of the Community Development Code, • The Planning Commission concludes that the proposal is consistent With the applicable Statewide Planning Goals and Guidelines based upon the following findings: FINAL ORDER NO, 04— /.3 PC — Pb 5-84 PACE 2 0 , , A a. Statewide Planning Goal #1 is met because the City has adopted a Citizens Involvement program including review of all development applications by the Neighborhood Planning Organization (NPO) , In addition, all public notice requirements were met. b. Statewide Planning Goal #2 is met because the City applied all applicable Statewide Planning Goals, City Comprehensive Plan Policies and Development Code requirements to the application. c. Goal #10 is satisfied because the proposal will provide for housing as contemplated by the City Comprehensive Plan. The Planning Commission has determined that the proposal as submitted, or with minor modifications, is consistent with the relevant portions of the Comprehensive Plan based upon the findings noted below: a. Plan Policy 2.141 is satisfied because the Neighborhood Planning Organization and surrounding property owners were given notice of • the hearing and an opportunity to comment on the : applicant's proposal, b. Plan Policy 3,644 is not satisfied by the preliminary plat as submitted because pedestrian/bicyclist access is not shown between the development and Summer Lake Park. Some kind of linkage should be provided so that residents of the development will have easy access to the • Park, This is particularly important because no common open space is intended for this project, ' 1 c. Plan Policies 643.2 and 6,3.3 are satisfied because the density of the development Within the 100 foot wide transition area on the west side of the property is lower than the maXimUm • of 8475 Units/acre. Also, the single family residences which are proposed are in conformance with the q—7 Zone and the character of nearby development, d. Plan Policy 0,1,1 is only satisfied on a Conceptual basis with the proposed preliminary plat, The Plan indicates a need for a minor collector • street that would connect the sorrento-Scholls erry and 121st-North Dakota intersections to allow for improved circUlation4 The street alignment shown Oh the preliminary plan does hot coincide precisely with the proposed street plan for the apartment complex to the north. This PINAL oRbER NO, 04,-12,_ PC — Pb 6-04 — PAGE 3 , • 0 4 preliminary plat and/or the apartment project site plan must be modified to provide one continuous street. The Planning Commission has determined that the proposal as submitted, or with minor modifications, is consistent with the relevant portions or the Community Development Code based upon the findings noted below: • a, Chapter 18,80 of the Code is satisfied because the preliminary plat is consistent with the requirements set forth in this Chapter for planned developments except For Section 18,804120A434a, (5) Which states that trees * with a 6 caliper or larger should be saved, The southwest corner of the property contains several large fir trees but the plans submitted do not indicate whether the trees will be left or removed. These trees should be indicated on the plan and saved if possible, • • b, Chapter 10,42 of the Code is satisfied because the proposal meets the maximum density allowance provided in this chapter, A maximum of 137 lots or units Would be permissible based upon the • size of the property and the R-7 zone, C, DECISION Based upon the above findings and conclusions, the Planning Commission approves PD 5-84 and S 10-84 subject to the following conditions: 1, UNLESS OTHERWISE NOTED, ALL CONDITION'S SHALL BE MET PRIOR TO RECORDING THE FINAL PLAT, 2, Standard half-street improvements including sidewalks, curbs, streetlights, driveway aprons, storm drainage and Utilities (delete inapplicable items) shall be installed along the 121st Avenue frontage, Said improvements along S.W. 121st Avenue shall be. built tl Major collector standards and conform to the aligi tent of County Survey No, 20,202 (centerline Survey). 3 , Seven (7) sets Of plan-profile public improvement construction plans and one (1) itemized construction cost • estimate, stamped by a Registered Professional Civil Engineer, detailing all proposed public improvements shall be submitted to the Engineering Section for approval, 4 Sanitary sewer plan-prof:tie details hall be provided as • part of the publit improvement plans, This shall include • heCessarY off-site sanitary and storm sewer easements, 4 t FINAL OROR NO, 84 PC - pp 5-04 - PAGt 4 . 5.
