PREVIOUS ACTION:
1. On May 6, 1980 an application was made for a Zone Change from R-=7 to M-3
and a Planned Unit Development designation was attached because of the
floodplain. A Sensitive Lands Permit was also applied for. Reference
ZCPD 13-80 and M-30 Staff Report of May 20, 1980. Note that this Staff
Report indicates that a Preliminary Review of the Planned Development was
requested with the Zone Change. The Preliminary Review was denied by the
Planning Director. When the applicant reviewed this Staff Report he
removed the item from the May 20, 1980 Planning Commission Agenda (Reference
letter from E.E. Edwards of June 13, 1980) .and requested that the Planning
Commission review the application on July 8, 1980. On July 8) 1980 the
Applicant met with the Planning Commission for an 'iinformal concept review°.
The decision of the Planning Director for denial was upheld and Staff was
directed to work with the applicant to resolve the issue of floodplain
access, phasing etc. (Reference letter of July 16, 1980)
August 14, 1980 Staff received s. letter from Harris-McMontgle Associates
Inc. stating that no development would take place in the floodplain. A
Staff memo was prepared on August 22, 1980 for the Planning Commission
meeting of Scptembei; 2, 1980. On September, 2, 1580 the Planning Commission
called a halt to the meeting at mid-night,. A study session was held on
September 16, 1980. ZCPO 13-80 was finally heard by the Planning Commission
on October 28, 1980 as a General Plan Review of the Planned Development
required because

addition to the conditions of development was made a part Of the Planning

City Council considered this request on November 24, 1980 and talked the
issue. On Deceimber 1, 1980 the Council agreed to hear =Pp 13--80 on
December 8, 1980. On December 8, 1:980 the Ordinance 8092 was not passed

on its first reading and was held over until the "legal council arrived".
On January 19, 1981 this item was left on the table. On January 26, 1981
the Ordinance number w changed to 81-02 and did not pass. On February
9, 1981, Ordinance 81 passed.
The applicant was notified of Councils action on February 11, 1980 but the
acknowledgement was never returned to staff.

4 REQUEST: For approval of an application for a preliminary review of an M-3
Planned Development and approval of a Sensitive. Lands Permit to allow
construction of a public load and parking area in the floodplain.
STAFF COMMENT: The applicant has hired a new Engineer, Thomas H. Burton,
Engineering and Surveying. The plan accompany this application does not
show the proposed street alignment or the proposed parking configuration. It
Staff's opinion that this proposal was approved initially only after the applicant
agreed not to develop within the 100 year floodplain. This was the primary
concern of the Planning Commission, City Council and Park Board. The attitudes

of these people has not changed.
FINDINGS OF FACT:
1. Applicant is proposing development of Phase I only. No mention of
additional phases is ;made. P:evious Planning Commission and City
w t Council deliveration on this parcel specifically addressed "phasingt'
.,f the Variance to the Cul-de-sac on an iterim basis. The railroad crossing
to the North, site visibility etc. The applicant has made no attempt
".' this time to address these concerns.
2. The proposed road and parking within the 100 year floodplain violates
the intent of the Environmental Design and Open Space Plan which is the
supporting document for the Park Board. The Park Board has reviewed
this proposal in the past and opposed use of the floodplain.
S. The applicable policies from the Environmental Design and Open Space Plan
related to this application are as follows:
Policy 1. Designate areas of physical limitation (poorly drained,
seasonally flooded, ground instability) and incorporate these
designations in city zoning, nce and map, and develop

graduated development restrictions according to the distinct
characterisitics of the constraints and anticipated limitations.

Fanno Creek Basin shall be encouraged to do the same.

Policy 7. Retain the 100--year flood plain of Fanno Creek,, its tributaries
and the Tualatin River as an open preserve (Greenway). The
% ` Greenway shall be established as the backbone of the open
space network and when a direct public benefit can be derived,
iA i.e., adjacent residentail development, the. Greenway should
be developed for passive recreation and pedestrian/bike travel.
NPO #5 Policy 5. Insure that residentail development is protected from the
incompatible features of industrial land use by means off'
employing the following land planning techniques:
a. As industrial development approaches residentail areas
provide for a stepping down of the intensity of
indgstrial use.
:.1:6 b. Provide protective buffers for residential areas
by use of such natural features such as the Fanno
Creek Greenway.
4 c. Where disparate land use types are closely grouped
together, employ strict site development standards
that insure compatibility.
NPO / 5 Policy 6. In order to enhance the environment of the residentail areas,
. "' natural amenties such as Fanno Creek and its tributaries as
well as existing stands of evergreens, thickets of deciduous
bushes, shrubs and trees, particularly where they form a
buffer between land use types, should be retained.
4. Applicant has not addressed the site visibility problems on S.W. Bonita (�
in relation to the railroad Right-of-way and 74th Avenue.
5. Adequate 'fire flow' has not been addressed
6. Application for a railroad Right-of-way crossing in conjunction with
development of the Tigard Business Park and Belknap Industries has not
been made.
7. Evidence has not been submitted which indicates that sewer easements
have been granted to adjoining property to the North.
CONCLUSION:
1. This application is less than complete, The applicant apparently did not
communicate the concern of this p

the above named project, but were delayed in following through for
various reasons.
The owner, (Kittleson and Brown) , is interested in completing the pre-
liminary approval of this subdivision. We would therefore request a
summary of the status of this project and the requirements necessary
for submission and approval of the preliminary plat.
The policy for treatment of flood plain areas is of particular interest
to us on this project as much of the property falls within this designation.

Bonita Park is an industrial subdivision designed to
accomodate smaller industries. The area is planned for this
type development with rail services.
A P.U.D. was previously approved for this type development
• on this property.
•
• The plan submitted is the same as previously approved
except for certain exceptions in Phase I as follows:
, .
• 1. Three lots are shown on the East side of the proposed
new street with a forth parcel in the flood plane area on
the West side to be deeded to the City.
2. Part of the lots and streets are located in the 100
year flood plane area but nothing is located in the flood
plane channel area. All federal regulations will be followed
in locating within this area. It is requested consideration
be given as to the severity of impact on property comsumption
these arbitrary federal flood plane lines create, keeping in
mind by definition flooding will only be likely to occur
once every 100 years. Then only the streets and yard areas
will be flooded. From the map it can be seen that a very
substantial parcel remains for greenway to be dedicated to
the City. Further reduction of useable area from this plan
. probably makes the development unfeasibie.
Impact on adjoining areas will be minimal as we are bounded
7. ' by the railroad, Fenno Creek and Bonita Road.
Public services required are those common to industrial
businesses as follows:
Vire, police, water and sewer services and roads to the
project. However, complete development of this area will
contribute to the road network in this area.
Also larger property tax dblibats will be made available
from this type development.
