The Hearings Officer adopts the findings of fact and

The Hearings Officer further finds that the concern ,
expressed by the testimony of Mr. Sterling Marsh, that he wished, the
floods to continue to feed the wetlands and ponds which were created
near the back of his property in 1978,, according to his testimony:,

In February, 1981, the City approved a Zone Change from R-7 and 1'13 to
M3(PD) with corrd itions relating to the development of the property (ZCPD
13-.80/Ord, No 81-03). A revised proposal was reviewed in September,
1981 and was denied for lack of adequate information (PD 25-81./M 5.81) ; t

Bonita Road, which is designated as a major collector, lies immediate
• south and the Burlington 1r,�rthern/Southern Pacific railroad tracks
border the subject property to the east. Industrial. zones (I-P, T-L,
and I-H) lie south of Bonita Road and east of Fanno Creek, on the east

side of the tracks, and along the north property line. Multi-family
development within the R-12 (Residential., 12 units/acre) is immediately
west of Fanno Creek. The R-7 (Residenti.al, 7 r.tnnits/acre) zone abuts the '
northwesterly extension of the property. v
4. Site Information arld Descri:Lt .oin
The property is roughly "L" shaped with the Fanno Creek flood plain
located within its southern and tAle stern portions. The property is
relatively flat and covered with grass near Bonita Road and trees to the
north.
The applicant proposes an industrial subdivision with 14 lots abutting
the north and east property line and a street located between the lots
and the 100 year flood plain. The subdivision is intended -to be

developed in two phases with lots 11, 12, 13 and 14 in the first phase. 1
The proposal requires a Sensitive Lands review since fill and grading
will be necessary to raise portions of the lots and the street above the

The Engineering Division has the following corrtments

'he Building Inspection Division has no objection to the proposal but it
is noted that because of the flood plain, the Engineering Division
should be closely involved with this project.
.. }, NPO #5 is opposed to the application because the information presented
does not describe the impact of the proposal upon upstream and
downstream flood levels. Also, the group feels that this type of
filling within the Fanno Creek flood, plain is inappropriate.
B. ANALYs:Es AND CONCLUSION
The relevant review criteria for this case are contained in Pol.i.ci.es
3 ,2.1, 3.2.2, 3.2.3, and 3.4,2 of the Tigard Comprehensive Plan and
Chapter 18.84 of the Community Development Code. The policies listed'
: •• above will be met through the requirements of Chapter 18.84 which are
discussed in more detail. below.
Section 1884.040(a) of the Code contains the fol.'1.owing criteria for
reviewing a Sensitive Lands proposal within the 100 year flood plain:
1. Land form alterations shall preserve or enhance thte flood plain
storage function and mai.ntenarlre of zero-foot rise floodwaay:
shall not result in any narrowing of the f loodwaay boundary,
2. The land form alteration or development within the 100 year flood
plain shall be allowed only in an area designated as c ,mmercial. or
industrial on the Comprehensive Plan Land Use Map;

We are in receipt of the notices of-public hearings y:
to be held on June 4th and June 6th dealing with the preliminary
plat approval to allow dividing the 28.35 acre parcel into 14 •
lots, and sensitive lands approval to allow selected filling
s. and grading work within the 100 year flood plain of Fanno Creek.
We understand that this property is owned by Mr. Milton 0. Brown
', of Portland, Oregon.
In principle we have no objections to a land fill
provided, however, that the drainage of Fanno Creek is not
disrupted. This area has a very high water table and all
adjacent properties do, in fact, use Fanno Creek for drainage
due to rainfall, etc.

In the event that there should be any interference
with that drainage appropriate steps by the owner or the City
of Tigard would have to be taken to assure free flow of water

industries The plan has been under consideraion for some time and

requirements. Results of consultations with the City Of Tigard Public

Portions of the street improvements and lots lie within the 100 year
flood plane area. Improvement of the chantieiv.ray would be made i ncreasi n
the flow through this area. Storm flood studies y erformed by the City y
` of Tigard on Fanno Creek indicate increased flow through this area is :

The project is designed to fit street patterns to the North and East. 6` `
The Easterly connection involves a railroad crossing construction and
connects to the Tech Center Business Park street pattern. The rail- i
