. The Tigard Planning Commission reviewed the above application at a public
hearing held on December 4, 1984. The Commission based its decision on the
facts, findings and conclusions noted below:

2. Background
On November 13, 1984 the Planning Commission reviewed a Sign Code
Exception application for Shilo Inn on Greenburg Road (SCE 5-84) . The
Commission decided to table the request to allow the staff and the
, -
applicant time to submit additional thformation and to evaluate other
alternatives for advertising the motel.

,--. The applicant has indicated that a 48-foot sign will be acceptable, A
crane was raised to a 48-foot height at the proposed sign location and
it was viewed by the staff and the applicant from Highway 217.
. .,i Regardless of height, the sign will come into view for northbound 44
traffic only when a vehicle reaches the Greenburg Road exit. A 48-foot
, sign will be visible to southbound motorists. The existing wall sign
''.. which is approximately 44 feet high is also clearly visible.

The State Travel Information Council administers the logo sign program
* along State Highways, A program for installing logo signs on Highway
217 has not been initiated, but the Director of the Council is confident
. that a sign can be provided for the Greenburg Road exit before the end

of 1985. Because of budgeting and accounting work that is being done, a
definite answer as to when the signs will be installed will not be
determined for approximately two months.
The applicant offered to pay for a logo sign and turn it over to the
State upon completion. However, the attorney for the Council indicated
that State law prohibited such an arrangement.
Based upon the new information noted above, staff submits revised
findings and conclusions noted below.
B. FINDINGS AND CONCLUSIONS
The relevant approval criteria in this case are Statewide Planning Goals
1 and 2, and Section 18.114.145 of the Community Development Code.
The Planning Commission concludes that the applicable Statewide Planning -
Goals have been satisfied based upon the following findings:
1. Goal 1 is met because the City has adopted a Citizens Involvement
program including review of all development applications by a
Neighborhood Planning Organization (WO) . In addition, all public
notice requirements were met.
2. Goal 2 is met because the City applied all applicable Statewide
Planning Goals, City Comprehensive Plan policies, and Development
Code requirements to the application.
The Planning Commission concludes that the retevant Community
Development Code requirements have been met based upon the findings
below:
1. In order to justify an exception to the sign code, one of the
following three criteria (CDC 18.114. 145) must be satisfied:
a. The proposed sign code exception is necessary because a
conforming building or sign on an adjacent property would
limit the view of a sign erected on the site in conformance
with the sign code standards.
b. The proposed exception to the height limits in the sign code
is necessary to make the sign visible from the street
because of the topography of the site.
c. There is an access drive which services the business or
service from a street other than the street on which the
business is located.
2. The C—G zone allows for a sign with a maximum height of 20 feet.
The maximum allowable sign area is 70 square feet per side with a
total sigh area of 140 square feet. An allowance for one
additional square foot of sign area for each additional foot of
setback over 15 feet from the street right—of—way is permitted up

to a maximum sign area of 90 square feet. The sign is proposed to
be located approximately 60 feet from Greenburg Road and would
qualify for the 90 square foot limit.
3. The proposed sign will be 28 feet taller than the twenty foot
height, limit and it will exceed the sign area allotment by 126
square feet per side.
4. Criteria b. above is intended primarily to apply to situations
where freestanding signs are oriented to abutting streets.
Although the motel property is not adjacent to Highway 217, its
orientation is definitely towards the Highway, not Greenburg
Road. The motel is located approximately 500 feet from and at a
lower elevation than Highway 217.
It has been demonstrated by the applicant that a 48 foot tall, 216
square foot freestanding sign is the minimum size necessary to
obtain visibility from Highway 217.
5. The applicant has not presented compelling evidence to justify the
retension of the existing freestanding sign on Greenburg Road.
Since the vast majority of the motel's clientele will arrive from
the direction of Highway 217, adequate signage shall be available.
C. DECISION
Based upon the findings and conclusions noted above, the Planning
Commission approves SCE 4-84 subject to the following, conditions.

1, One freestanding sign with a maximum height of 48 feet and size of
216 square feet shall be allowed.
2. The existing freestanding sign on Greenburg Road shall be removed
prior to the erection of the sign noted in condition 1.
3. This approval is valid if exercised within one year of the final
decision date noted below.

1. President Moen called the meeting to order at 7:35 P.M. The meeting was
held at the Fowler Junior High — LGI Room — 10865 S.W. Walnut.

the November 13th minutes as amended. Motion carried unanimously by

APPLICANTS PRESENTATION
o Dale Clark, Clark Sign, explained they need at least a 48' sign to be
- ' able to stay in business. They would be willing to remove the Motel
sign. Also, there was no chance of getting a Bill Board sign,

o Discussion followed regarding the size of the sign, the height, and
distance for visibility.
o Commissioners Leverett, Fyre, and Butler supported Staff's
recommendation.
o Commissioners Peterson, Bergmann, and Vanderwood supported a second
free standing sign with the removal of the Motel sign.
o Commissioners Moen and Owens felt some type of compromise could be
worked out, but were not pleased with what is being proposed.
Commissioner Owens moved and Commissioner Butler seconded to approve
a 48 foot 216 square feet per side with the conditions that the
existing free standing sign be removed and that the approved sign .
will be removed when a freeway logo sign becomes available and is in
place. Motion failed 5-3, Commissioners Moen, Fyre, Vanderwood,
Bergmann, and Leverett voting no.
Commissioner Butler moved for denial of SCE 4-84 based on Staff's
findings. Motion failed for a lack of a second.
Commissioner Vanderwood moved and Commissioner Peterson seconded to
approve SCE 4-84 for a 216 square foot per side, and 48 feet high
with the condition to remove the existing free standing sign. Based
on Section 18.114.145(b) of the Community Development Code. Motion
carried by majority vote of Commissioners present, Commissioners
Moen, Butler, and Owens voting no.
5.2 SIGN CODE EXCEPTION SCE 5-84 (PLAID PANTRY) WESTWOOD CORP. NPO #4
For approval to allow a third free standing sign. Located; 1105 S.W.
Pacific Highway (Crosswords Plaza) .
Associate Planner Liden made Staff' s recommendation for denial.

o Roger Stayer, 2450 N.E. Riverwood Way, representing Plaid Pantry,
explained why they needed their own free standing sign. He said they
would remove their small sign from the main sign.

B. FINDINGS AND CONCLUSION

The relevant approval criteria in this case are Statewide Planning Goals
1 and 2, and Section 18.114.145 of the Community Development Code.

The Planning staff concludes that the applicable Statewide Planning
Goals have been satisfied based upon the following findings:

The first two criteria are applicable to this request.
2, The C zone allows for a sign with a maximum height of 20 feet.
The maximum allowable sign area is 70 square feet per side with a
total sign area of 140 square feet. An allowance for one
:', additional square foot of sign area for each additional foot of
�.; setback over 15 feet from the street right-of-way is permitted up
to a maximum sign area of 90 square feet, The sign is proposed to
be located approximately 60 feet from Greenburg Road and would
qualify for the 90 square foot limit,
3. The proposed sign will be three times taller than the twenty foot
height limit and it will exceed the sign area allotment by 126
square feet per side.
4. Criteria a. and b. above are intended to apply to situations where
freestanding signs are oriented to abutting streets. This sign is
to be oriented toward Highway 217 which is approximately 700 feet
away. This may not be considered as. an outdoor advertizing sign
because Section, 18.114.090 A.4.a. states that such signs "shall
only be permitted to locate on and orient to Oregon State Highway
217. . .". The limitations of the site related to visibility from
Highway 217 are due to its distance from the Highway and not
because of other buildings, signs or topography.
5. The difficulties related to advertising the motel are appreciated,
however, the sign code provides other methods of advertising the
motel without requiring a sign code exception of this magnitude.
C. RECOMMENDATION
Based upon the findings and conclusions noted above, the Planning staff
recommends denial of SCE 4-84,

NPO 2 recommends a modification to this "Sign Code Exception" request
along with a condition for approval.

After questioning Mr. Dale Clark, Reviewing City of Tigard's Sign
Code Regulations, and with each member's input the following is
a synopsis of NPO 2's discussion: 1
1. Illumination of this proposed sign should. have no adverse
affect on residents in the area or on the businesses. Of
particular concern was the Ash Creek residents. This is
to be a V-shaped sign and the illumination will be directed
to the North and South Lanes of Highway 217.
2; Based on the proposed location of this sign, no rights-of-way
will be violated nor does it appear to impede visibility of
any other business sign in the vicinity.

. . 3. With each NPu member's own knowledge of Shilo Inn's existing
signs at other locations, the Shilo Inn signs are tastefully
displayed. .

4. NPO 2 members person/tally observed the non-visibility from
Highway 217 of this motel due to its location.
5. Members of NPO 2 were very concerned about the overall size
of this proposed sign and wishes that no Tigard area be known
as "Sign City USA' . The NPO members were concerned that other ,
existing businesses or any future business(es) shall request
a sign code exception, wanting large business signs displayed,
however, that will be dealt with individually, should such
requests be submitted.
6. NPO members were informed that no billboards were available

4. A large percentage of general motel business is impulsive when
people are traveling and looking for a convenient location to spend the
night. Without proper sign recognition, this motel location will lose a
great deal of potential business that it would normally experience with
adequate signage. Consequently, an unnecessary loss of room revenue
would result with subsequent drop in transient room lodging tax that
would otherwise be paid to the City of Tigard.
