FINDINGS OF FACT:
1. Tigard Municipal Code Section 18.76.020 states that:
No variance shall be granted by the Planning Commission unless it can
be shown that all of the following conditions exist:
_ ,. (1) Exceptional or extraordinary conditions applying
to the property that do not apply generally
to other properties.. in the same zone or vicinity,
which conditions are a result of lot size or
shape, topography, or other circumstances over
which the applicant has no control;
(2) The variance is necessary for the preservation
of a property right of the applicant substantially
the same as possessed by owners of other property
in the same zone or vicinity;
(3) The authorization of the variance shall not be
materially detrimental to the purposes of this
title, be injurious to property in the zone or
. :, vicinity in which the property is located, or
be otherwise detrimental to the objectives of any
City development plan or policy;

(4) The variance requested is the minimum from the
provisions and standards of this title which
will alleviate the hardship."

Granting—Conditions
Per filing request, the following information is submitted for
your consideration and approval:
(1) Due to the existence of the present 10—foot State
drainage easement and its resulting reduction of
buildable area, it is felt that it would be help-
ful to permit the requested variance to build to
the property line abutting the present 15—foot
County sewer easement, thereby increasing buildable
area and placement of improvement on the site
(2) We do not feel that this requested variance would
create an undue hardship on neighboring property
owners and would allow the improvement of our
property.
(3) As stated above, we do not feel that the nature of
this improvement would be detrimental or create undue
hardship on neighboring property owners and would
maintain the objectives and integrity of any present
or future city development plan or policy.
(4) It is felt because of the type of this improvement
and, its limited tenancy with consequent limited
traffic, it would be compatible to the area and
would not create excess hardship to the existing
businesses or other property ovners.
