The site is designated "Suburban Density Residential" on the Neighborhood Plan III and zoned "R-10, Single Family Residen tial" 2. Section 17. 16 .100 of the Tigard Municipal Code states No tentative plan for a proposed subdivision and no tentative plan for a major partition shall be approved unless: (1) Streets and roads are laid out so as to conform to the plats of subdivision or maps of major partitions already approved for adjoining property as to width, general direc- tion and in all other respects, unless the city determines it to be in the public interest to modify the street or road pattern; (2) Streets and roads held for private use are clearly indicated on the tentative plan and all reservations or restrictions relating to such private roads and streets are set forth thereon; (3) The tentative= plan complies with the comprehensive plan and applicable zoning regulations of the city then in • effect; (4) No tentative plat of a subdivision or map of a major partition shall be approved unless there will exist adequate quantity .and quality of water and an adequate sewage disposal system to support the proposed use of the land de- scribed in, the proposed plat. 3. Section 17.48.020 of the Tigard Municipal Code states "A variance from the standards of this title shall not be granted by the Planning Commission unless the Commission finds from the facts presented at the hearing all of the following (1) That _the-.'e are special circumstances or conditions affecting the property which are unusual and peculiar to the H. lands or development of the- project involved as compared to • other lands similarly situated; , STAFF REPORT ..< AGENDA 5 .7 i e TIGARD PLANNING COMMISSION March 15 1977 Page (2) That tie variance sought is necessary and the minimum required for the preservation and protection of a substantial property interest of the petitioner to the degree that extraordinary hardship would result from strict compliance with the regulations of this chapter applicable p g to the particular subdivision, major or minor partitioning , involved, ; (3) That the granting of the variance will aot be detrimental to the public health, safety or welfare, but will be consistent therewith and shall not be injurious to the rights of other property owners in the near vicinity nor constitute a departure from or be in violation of the compre ensive plan of the City of Tigard; (4) That the applicant ' s proposal for variance in a subdivision or major or minor land partitioning conforms to ? t and is consistent with all other regulatory requirements of this title and Title 18 of this code, that adequate provision is made for traffic circulation recreation, open spaces and similar factors, and that variance sought has been considered • by other public agencies concerned with fire protection, sewer, Y water and other utilities, as well as environmental factors, and the written comments of such regal at pry bodies as a.j plicable is submitted as part of the record II . FINDINGS . 1 . The applicant is requesting preliminary plat approval of an eight lot subdivision with a minimum lot size of 10, 000 sq . ft . i ". • and variances red1zcing the right-of-way and pavement width . 2 . The site is 3. 09 acr.es with somewhat steep slopes (44 ' change in elevation in 200 ' ) and bisected by a creek. There is little vegetation n other than 4 gasses on the site except in the march t area along the creek . 3. The surrounding land uses are residential on all sides e.x.ept for the vacant land to the north which is the site of the Genesis Planned Development . 4 . Applicable policies and objectives from the Neighborhood Plan III are as follows A. To retain in portions of Ti.gard the suburban quality that 1; has characterized the Tigard area in the past and that has ` = made Tigard an attractive place to live for families seek- • i_ng an alternative to higher density urban living. t B. To permit densities that will economically support the cost of necessary public services and facilities such as paved streets,` pedestrian Ways and utilities . D. To permit a variety of housing types to be compatibly situated in the neighborhood in order to meet the needs of different family sizes and incomes . Policy 25 . When land is developed and includes a designated bicycle path route, easements should be granted to the City. In cases where development incre a:es the neea for the path, construction should also be required. j Policy 26 . The consturction of pedestrian/bicylce paths is of the highest priority among needed public .. improvements in the neighborhood and should be accomplished prior to, or in conjunction with, improvements to the street system. Policy 27. An S development alon g stream channels f or recreational purposes should not disturb existing trees . In places where trees are q A absent, some should be planted. The greeziway s are not suited for i.ntensive recreational develop ment and should be restricted to an all-weather path and passive areas for resting, picn.icing and related activities. This proposal conforms to these policies and objectives in that it is a large lot single family subdivision with a bike path. Con- cern does arise though as to the proposed bike path location which is proposed for the most environmentally sensitive area. An alter- native would be to utilize a portion of ES .W Fairhaven Place as the pathway. - No mention has been made as to the retention of vegetation along the creek way. A minimum greenway easemont of 25 ' from center line _- of the creek would assure its retention as a natural area. 5 . Section 17. 25 .130 of the Tigard Municipal Code requires a maximum local street grade of 12%. In order to meet this requirement, this filling will be necessary in the area where S .W. Fa i rhaven Street crosses the creek yet no fill profiles have been submitted . 6. Due to the unusual site conditions and the length of the cul ' '4', de--sac (255 ' serving only 5 lots) a reduction in the right-of- . way and pat ement widths appear justified if f parking is prohibited and sidewalks and utility easements are provided on the private property. Although the same conditions exist for the remainder of S . 4'. This proposal. also involves the construction of ": • • 340t of S .W. Fairhaven Street from S .W. 110th Avenue which should be to local street due to it carrying more through traffic ' standards . r: M: 7. There currently exists an informal pedestrian walkway 'between " the ends of Fairhaven Street . In order to facilitate this demonstrated need, a 1.0 ' wide pedestrian easement and path should be provided between lots` 3 and 4 . III . CONCLUSIONARY FINDING : Plan III The proposed preliminary plan conforms to the Neighborhood P l -. and the Tigard Municipal Code with the attachment of appropriate conditions and the variances to the street widths as noted in find- . necessary due to unusual site conditions of slope and '`4 Q lug �;'6 are nec y topography, are the minimum necessary, are not detrimental to the public health safety or welfare an,d is not inconsistent with other regulatory requirements of the zoning and subdivision codes . IV. STAFF RECOMMENDATION: Preliminary Plan h Staff recommends approval with the following conditions : t 1. A street tree program be submitted for staff approval . } V• 2. A grading and drainage plan for the entire subdivision , „. minimizing adverse environmental impacts be submitted .' : with the final plat . The drainage plan should identify existing springs on the site and how they will drain F , • into the creek. r, k . 3. A 10 ' standard city bike path be provided from the south edge of lot 7 to the cul-de-sac and on the east side of Fairhaven Place . 4 A 10 ' pedestrian easement and path be provided between lots 3 and. 4 to provide a connection ti.on between Fairhaven .. • Street. 5 . Applicant ' s Presentation: ' Bill McMonagle, McMonagle-Harris and Assoc. , stated that 4 previous surrounding developments have created problems for the land and that developing the land would be in- filling which should be encouraged. He also stated that fill and trees would be added to the greenway. o Roy Barnum, developer, stated that the property was difficult and therefore custom homes would be utilized but objected to recommendation #4 for safety reasons. C. Public Testimony : i, In favor : Mrs . J. Webb, owner, recommended #4 be dropped. � ` In opposition: Jean Halverson asked that the oak tree on _ the site be preserved, stated that lot #1 had severe drainage problems, that children would be crossing the property inevitably, and that the springs would be a building problem. Dallas Knight, Marilyn Henderson, Lenora VanClefe expressed '. concern over drainage' and greenway. D. Staff Recommendation Staff recommehds approval with the following conditions: . 1 . Fairhaven Place. o McMonagle stated that when the stream bed is cleared t drainage will be improved, that any springs should be ' drained to the stream. E. Commission Discussion: .. o Moore suggested that elevated, informal stairs be i - . used to solve the grade problems for the pedestrian r . path o Tepedino expressed concern over drainage, fill, and ` potential flooding problems. Sakata moved and Moore seconded for approval pp 1 based on a staff findings with conditions 1 , 2 (add water retention system with staff approval) , 3-6 . t o Nicoli asked if a water retention system is possible. o McMonagle stated it was possible but that water reten- tion was not needed on the site . The motion failed in a 3 to 3 voice vote. Tepedino moved and Wood seconded to approve based on staff findings with staff recommendation deleting #4. The motion passed in a 4 to 2 voice vote with Sakata and Moore dissenting. Variance: A o Moore moved and Tepedino seconded for approval of the variance based on staff findings and with the staff recommendations. Main St. 0 Tigard, Oregon 97223 Re: Fairhaven Estates R Variance Request y Dear Mr. Bolen: Pursuant to the variance to Section 17.48.020 of the City of Tigard Subdivision • " Ordnance the following is submitted in support of this variance request. 1 . Special circumstances exist relative to this site because at the time Vir gi is Acres #2 was platted and improved, the relationship between the topo- graphy of the subject site and Virginia Acres #2 was ignored. Therefor the vertical alignment of S. W. Fairhaven St. left the subject site with an access problem for either a cul-de-sac or extension of S. W. Fairhaven St. . It appears a street extension was intended, but this is not prac- tical from a design or construction standpoint. ~ The development of the subdivision of Fairhaven Court provided S. W. Fair- haven St. as a dedicated way. However, the street was never improved to the plat boundary. From a street grade star,dpoi nt the most desirable access is from Fairhaven. Court. However, an improvement is required in the existing ,: right-of-way. Because of the past development adjacent to this site, these problems Were created. Due to the present land use policies of development within the urban containment boundaries, many of these type of left-over c' parcels are now being fitted into the overall development scheme. 2. The variances as requested which will allow construction of the proposed improvement are the minimum requi red for the preservation and protection of a property right to solve problems created by others and to solve the un sightly mess of a general dumping area of S. W. Fairhaven St. by construction of the proposed improvements. 3. The public health will be served by el iminatilon of standing water and places for rodents and insects to habitate. The public safety aspect will be served in that the proposed cul-de-sac paved radius wi?1 be 36 feet instead of 34 feet as called for in the Subdivision Ordnance. Since the lots of this development occur on one side of the road and the Lf.. entrance road of S. W. Fairhaven Ste hr,s no lots that access onto it and that there are two cul-de-sacs in essence provided, it appears from a prac ^,. ti cal point of view that the traffic generated in this area will be from the Y: home owners who will live in the proposed subdivision. - P Due to the fact that only 7 lots will access onto this street, which is one- half the usual situation, it can be expected that there will be half as many ” vehicles and half as many trips per day compared to a double fronted street. In reviewing the files, I find that in the Staff Report dated August 31, 1977 (File S 13-76) that Staff Observation "C” mentions sidewalk construction. However, the letter to Barnum Homes which approved the Subdivision on August 31, 1977, makes no mention of sidewalk construction. At the present time, sidewalk construction is almost impossible because the homes are built close to the cul-de-sac curb eliminating the sidewalk construction area. I recommend that no sidewalks be constructed. The proposed bike path construction proved to be extremely dangerous and T' previously notified Mr. Hagman that that condition was not appropriate. In the future, we will examine subdivision plats more closely to eliminate these difficalties following completion of the buildings, etc. • • ,/,‘;',/4 Ho'ar• • • {
