A. FACTS
1. General Information:
CASE: Variance (V 2-83) e
REQUEST: The applicant is requesting approval of` a variance from
Section 18.20.080 of the Tigard Municipal Code to allow for
an 18 1/2 foot front yard setback in the R-7 Single Family
Zone. Section 18.20.080 reads as follows:
18.20.080 Setback -- R-7 or R-10 Zone. Except as may
otherwise be provided in Section 18.12.100., the
setbacks in an R-7 or R-10 zone shall be as follows:
(1) The front yard setback shall be a.' minimum of

2. PREVIOUS ACTION: A building permit was issued on October 12,
1981. On March 12, 1982 and extension was
granted on the permit to October 12, 1982. On
December 7, 1982 the footings were inspected and
approved. On January 26, 1983 the post and beam •
inspection was conducted and disapproved. .‘ •
Shortly after that, the Rudishauser's came into
the City's Building Division and pointed out that
after a survey had been conducted due to the
curve radius in the road, the foundation for the
house actually measures 18 1/2 feet from the 4
41 property line rather than the required 20 feet.
The Rudishauser's were told by their bank that
financing on the home would be denied if a
variance to the setbacks required was not given.
3. Vicinity Information:
The surrounding land uses are as follows:
The property to the west and south is developed as a portion of
Scheckla Park Estates.
The property to the north is a park area which has been dedicated to
the City.

The foundation is in place for the proposed single family dwelling.
There are several large fir and cedar trees around the north and east ,P
perimeter of the lot.
B. APPLICABLE PLANNING POLICIES
•
1. LCDC Goals and Guidelines:
a. Citizen Involvement - Goal # 1 - The intent of this goal is to
insure the opportunity for citizens to be involved in all phases
of the planning process. Notice will be mailed to all property
owners within 250 feet of the site giving the time and dated of
the Public Hearing. A Public Notice will be published in the
Tigard Time. Notice will be sent to NPO # 6 to allow them an
opportunity to review the is6ue.
b. Land Use Planning - Goal # 2 - All applicable LCDC goals and
policies, NPO # 6 policies and Tigard Municipal Code sections
were considered in review of this application.
2. NPO # 6 POLICIES •
POLICY 2. The maximum overall density of development will be four
dwelling units or 12 persons per gross acre. This amounts to
s4Eglardo-E-7500 square feet of land per dwelling unit allowing for
streets and other open space. Some areas will have a lower density y,
owing to topography, existing development patterns, or the desire of
individuals to own a larger lot.

POLICY 3. Residential subdivisions will be developed with paved
streets, curbs and gutters, street lights, and walkways, according to
city or county standards. All utilities will be placed underground. '

POLICY 4. Development will coincide with the provision of public
streets, water anti sewerage facilities. These facilities shall be.
(a) capable of adequately serving all intervening properties as well
as the proposed development, and (b) designed to meet city or county
standards.
3. TIGARD MUNICIPAL CODE SECTIONS:
18.76.020 Granting -- Conditions. No variance shall be granted by the
Planning Commission unless it can be shown that all of the following :, `
conditions exist:
(1) Exceptional or extraordinary conditions applying to the property
{
that do not apply generally to other properties in the same zone i.... .
or vicinity, which conditions are a result of lot size or shape, fir;:,:;-r
topography, or other circumstances over which the applicant has
no control;
(2) The variance is necessary for the preservation of a property
right of the applicant substantially the same as is possessed by
owners of other property in the same zone or vicinity;
(3) The authorization of the variance shall not be materially
detrimental to the purposes of this title, be injurious to
property in the zone or vicinity in which the property is
located, or be otherwise detrimental to the objectives of any
city development plan or policy;
(4) The variance requested is the i;ainimum variance from the
provisions and standards of this title which will alleviate the
hardship. (Ordinance 70-32 Section 240-2., 1970).
4. STAFF ANALYSIS
A. There are no exceptional or extraordinary conditions applying to the
property that do not apply to other properties in the same zone or
vicinity, which are a result of physical circumstances. The lot is
of normal size and shape, is relatively flat and is part of an
approved subdivision.
B. The variance is not necessary for the preservation of a property
right of the applicant since an accurate survey could have been

conducted taking the curvature of the street into consideration prior
to the foundation footings being poured. . .
C. The authorization of the variance would not be materially detrimental ;..
to the purpose of this title 'or be injurious to property in the same
zone or vicinity in which the property is located. The primary
function of the front yard setback is to accommodate enough driveway

length for cars to park. The remaining setback would be 18 1/2 feet •
which is adequate driveway length to park a car. There are other
residential planned development within the City such as Summerfield •
and Colony Creek in which the distance between the sidewalk and the
front of the garage is less than 20 feet.
D. The variance requested is the minimum variance from the provisions
and standards of this title which will alleviate: the applicant's
hardship. The foundation has been poured 18 1/2 feet from the
property line and the applicant is asking for 1 1/2 feet from the
required 20 feet.
SUMMARY:
Based on staff's review the applicant's request does not meet all of the
Tigard Municipal Code requirements for granting a variance. However,
there are other circumstances that go beyond the criteria that staff fees
should be considered. The applicant purchased the approved plans and
Building Permit from the original owner. The City approved the foundation
footings upon inspection. It was the applicant who pointed out the site
plan error to the City. The original site plan did not indicate the

curvature of the street ant. when the foundation measurements were taken,
it resulted in the foundation being located 1 1/2 feet closer to the
property line. The dilemma now arises because the foundation has been
poured and substantial construction has taken place. The applicant has
been informed by his financing agency that they cannot fund the remaining
construction of the house because of the set back discrepancy. In this
unique instance staff feels that the financial burden placed on the
applicant outweighs any detrimental effect that granting of this variance
may have on the surrounding properties.

Dear Mr. & Mrs. Rudishauser:
After further review of the setback discrepancy on lot 17 of Scheckla Park
Estates it was brought to the City's attention that Scheckla Park Estates
is a Planned Development (Ordinance 78-4 change the zoning from R-7 to R-7
(PD), and therefore a Planned Development modification rather than a
variance is required.
Based on the criteria for a Planned Development modification, I have determined
that the 11i foot front yard setback discrepancy for the foundation on lot
17 is a "minor" modification, and approve your "minor" modification subject
to the following conditions: •
