Main St. Tigard, Or 97223 On July 10 , 1978 an earnest money agreement was signed to purchase the property at 15895 S.W. 72nd Ave. in Tigard, Oregon. Due to the configuration of the lot a variance was asked for and rejected by the Planning Commission on } October 3, 1978. By November 13, 1978 a second set of plans were drawn adhering to the property setbacks and other reg- ulations. On December 18, 1978 a letter was written, copy attached, from Tom Spear, Public Works Planning Coordinator for Washington County, to the City of Tigard. The letter pertained to a proposed County road that would leave 1®5 and tie into Upper Boones Perry Road and cross S.W. 72nd and go through part of the afore mentioned property and connect with Highway 99. At t` at time it was indicated to us by the City of Tigard that a building permit would not be issued on the second set of plans until the road 1 issue was resolved. As soon as this information was known, a third set of plans were drawn. (These plans call for a zero lot setback on part of the south boundary and on the west r, property line. These plans also call for a 45 foot) allowance for the proposed roadway through our property. We feel while the proposed road is being discussed by the various regulatory bodies, with these new plans we can procede with our bui ldi.ng and allow for the road if and when it might be built. We are therefore asking for a variance to item 18.48.040 of the Tigard Municipal Code which requires a side and rear setback of 20 feet. We feel due to the proposed road an undue or unnecessary hardship does exist and we respectfully ask for the proposed variance.
