Variance
On a site located within an access easement leading to property
located at 11632 S. W. Pacific Highway. Site is located adjacent
and southerly of the existing Family Drive-In Theatre sign.

1. On May 21, 1974, the Planning Commission took action to vary
a provision of Title 16, TMC and allow an off-premise sign
at the subject location. Please note the attached minutes
of the May 21, 1974, Planning Commission meeting.
2. Section 18.08. 560, TMC, states " 'Vision clearance area' means
a triangular area on a lot at the intersection of two streets
or a street and a railroad, two sides of which are lot lines
measured from the corner intersection of the lot lines for a
distance specified in these regulations. The third side of the
triangle is a line across the corner of the lot joining the
ends of the other two sides. Where the lot lines at inter-
sections have rounded corners, the lot lines will be extended
• in a straight line to a point of intersection. The vision
clearance area contains no planting, walls, structures or
temporary or permanent obstructions exceeding three feet in
height, except occasional tree trunks or poles. The vision
clearance area shall be measured from the top of the curb or,
if there is no curb, from the centerline street grade and ex-
. tend upward ten feet. "
3. Section 18.76.010 (Tigard Municipal Code) states " . . .the
planning commission may authorize variances from the require-
ments of this title where it can be shown that, owing to
special and unusual circumstances related to a specific piece
of property, the literal interpretation of this title would
cause an undue to unnecessary hardship. In granting a variance
the planning commission may attach conditions which it finds
necessary to protect the best interests of the surrounding

property or neighborhood and to otherwise achieve the

purposes of this title".

In addition Section 18.76.020 (Tigard Municipal Code) states
that "no variance shall be granted by the planning commission
unless it can be shown that all the following conditions
exist:
■
(a) Exceptional or extraordinary conditions applying to the
property that do nct apply generally to other properties
in the same zone or vicinity, which conditions are a
result of lot size or shape, topography, or other cir-
cumstances over which the applicant has no control;
(b) The variance is necessary to the preservation of a
property right of the applicant substantially the same
as is possessed by owners of other property in the same
zone or vicinity;
(c) The authorization of the variance shall not be materially
detrimental to the purposes of this title, be injurious
to property in the zone or vicinity in which the property
is located, or be otherwise detrimental to the objectives'
of any city development plan or policy;
(d) The variance requested is the minimum variance from the
provisions and standards of this title which will allevi-
ate the hardship."
1- 4. Section 16.36.040, TMC, states "The minimum clearance below
the lowest portion of a free-standing sign and the ground be-
low shall be fourteen feet in any driveway or parking area. "
5. Upon reviewing the Planning Commission's previous approval of
the subject sign's location, it appears the sign is located
within a driveway area. See attached documents.
Steo"f Recommendation
Withhold pending testimony by the applicant relative to the in-
tended location and design of the sign. Staff feels sign should
• be located out of any driveway area and a minimum of 1 feet be-
hind a curb.

5. PUBLIC HEARINGS - Variance
5.1 V 2-74 (Portland Gymnastic Center)
A request to vary vision clearance standards of Title
18 (Tigard Municipal Code) from a required 10 feet
above the ground to 7 feet. Site is located adjacent
S. W. Pacific Highway and immediately south of the .
existing Family Drive-In sign, 11632 S. W. Pacific
Highway. .
Staff Findings .
A. Brooks presented the staff findings relevant to
this case which included a history of past Planning
Commission action concerning the applicant' s requested
sign location. ,

Testimony and Cross Examination t:
A. Gary Reddaway, the project architect, stated the reason
�r for the variance from 10 to 7 feet was to allow
r: visibility of existing signs in the area, especially
F. ,.• the Family Drive-in sign. In addition, he stated
. that the public safety would not be jeopardized by
lowering the sign from ten to 7 feet because the
10 foot requirement is to allow visibility for trucks
g and this driveway would be used exclusively by auto-
mobiles. The seven foot clearance from the street
i would be more than adequate to provide the necessary '
visibility.
I.
B. Mickelson asked Dr. Webber, the owner of the gymnastic.t
center, if the drive-in theatre was in agreement with
their proposal to place the sign at a height of seven
h feet above ground.
C. Dr. Webber said yes the owner would very adamantly
like to see the sign where it does not obscure his
sign. In addition, the drive-in theatre would block
the gymnastic center sign if the sign was placed at
10 feet rather than 7 feet. •
D. No one appeared in opposition to this proposal.
Staff Recommendation
A. Brooks said it was his judgment that the public safe-

whether or not the variance should be granted, Brooks
stated this depended on the judgment of the Planning
. Commission as to whether the applicant has met. the .
four variance requirements listed in the Tigard
Municipal Code..
Commission Discussion and Action
A. Mickelson moved to approve the request based upon
the finding that the four requirements listed in
the Tigard Municipal Code have been met and that
the public safety would not be impaired.
-- B. Barkhurst asked if the drive-in sign is legal or non-
conforming and, if non-conforming, would therefore d,
be removed by 1980,
C. Bolen stated that the drive-in sign is a legal sign
based upon extensive footage on S. W. 72nd Avenue,
D. Barkhurst seconded the motion and it passed by
unanimous vote of the commission present.
6. PUBLIC HEARING - Zoning Ordinance Amendment !_.
(continued from the June 4, 1974, regular meeting)
6.1 Ordinance Revision: Proposed ordinance amending Title 18,
t Tigard Municipal Code, creating a flood plain district
- and declaring an emergency.
Staff Comments
e A. Ball disqualified himself from consideration of this
item because he had been consulted by a property
•: owner concerning the effects of this ordinance upon
that owner's property rights.
B. Brooks presented the revised ordinance and explained
that its content had been changed from the originally '
submitted document, removing the 2 year moratorium
provision and including a special review and permit
section. This special review section was .fashioned
•
after the Washington County proposed ordinance and +'
. would allow certain filling and development to to ,e
place in the flood plain- as a result of the planning
commission's determination that no adverse impacts !,`
would result. Brooks also raised the question of
property which has been assessed for street or sewer
improvements, but as a result of this ordinance, may , r.

Gentlemen:
The Planning Commission, on May 21 , 1974, approved fcr the
Webber Dance Studio an appeal for the placement of a sign within an
easement. The present ordinance allows a sign to be constructed no
lower than ten feet above the ground.
This letter shall serve as an initiative document for an appeal
to allow a variance with regard to Tigard Ordinance 18.12.100 (B)
(Vision Clearance Area) to locate the bottom of the Webber Dance Studio
sign seven feet above the ground. We feel this will allow adequate
vision for motorists exiting the premises and permit a clear view of the
•
theatre marquee as one travels east on S. W. Pacific Highway. We feel
that this sign will visually block the marquee if located ten feet above
ground because the marquee is also located at that height.
