APPLICATION; Request by, Cameo Homes for a variance to allow a 4.5 foot side
yard setback where 5 feet is required on property zoned R-7 (PD) (Residential
f.• 7 units/acre, planned development) and located at 15370 S.W. 100th Court
(Wash. Co. Tax N .p 2S1 11CA, Tax Lot 9200).
DECISION: Notice is hereby given that the Planning Director for the City of ..:
Tigard has APPROVED the above described application subject to certain t;
conditions. The findings and conclusions on which the Director based his ':
• decision are as noted below. F:
A. FINDING OF FACT
1 Background
• The property is one of tie lots created, by Gulf Side Estates
subdivision (S 6-83) which was approved by the City in 1983.
2 e Vicinity Information
The land to the north, east, and south is also zoned R-7 (PD) and
the area to the northwest is zoned R-3.5 (Residential, 3.5
units/acre). Gulf Side Estates is just beginning to be developed
and except for one house to the north which is under construction, '`...`•
the adjacent parcels are vacant
3. Site Information and Proposal Description
•
The lot contains a home that is under construction. When the
footings where inspected by the City, ��y, it appeared that. the house
• had 5 foot setbacks in each side Yard. When a survey check was _"
•
done later, it was discovered that the east side of the ?souse only j
has a 4.5 foot setback. ` ...
Since the approval of the subdivision, the. Community Development
Code was amended to include a 10 foot side ya rd setback
requirement for flag lots. However, this standard only applies to
.
subdivision lots that have been created since it was enacted and
not to pre-existing subdivision lots.
4. Agency and NPO Comments t
•
The Engineering Division and Building Inspection Office have no
objection to the request. ._
•
Letters indicating no objection to a 6 inch encroachment in the
existing 5 foot utility easement have been received from Storer
Negro Communications, P.G.F., Northwest Natural Gas, and the
Titard Water District.

B. ANALYSIS AND CONCLUSION
The following criteria in the Community Development Code apply to
variance requests
1. The proposed variance will not be materially detrimental to the
Purposes; of this Code, be in conflict with the policies of the
Comprehensive Plan, to any other applicable policies and
standards; and to other properties in the same zoning district or
vicinity;
2. There are special circumstances that exist which are peculiar to
the lot size or shape, topography or other circumstances over
which the applicant has no control, and which are not applicable
to other properties in the same zoning district; }
3. The use proposed will. be the same as permitted under this Code and
City standards will be maintained to the greatest extent that is
reasonably possible, while permitting some economic use of the
land;
A. 4. Existing physical and natural systems, ,..such.. as but. not limited.... to '.
traffic, drainage, dramatic land forms or parks will not be
adversely affected any more than would occur if the development
were located as specified in the Code; and
5. The hardship is not self -imposed and the variance requested is the
minimum variance which would alleviate the hardship.
The primary purpose of the setback standards for the R-7 zone is to
allow for adequate spacing, air, light, and privacy for residential
structures. The variance will not have an appreciable effect upon the
existing or pfoposed residences in the area.

The lot is relatively small and if all setback require- ents from the _ ,
property lines and the house were enforced, the applicant would have to
move the building or adjust the property line. The City has no
objection to the 4.5 foot setback, however, permission must be granted ..:
by the utility companies which are eligible to use the 5 foot easement
before a building may encroach upon the easement. 4..;
C. DECISION
The Planning Director approves V 17-84 subject to the following
condition:
I. Prior to issuance of an occupancy permit, written permission to
encroach upon the 5 foot utility easement must be obtained from "

APPLICATION: Request- by Cameo Homes for a variance to allow a 4.5 foot side
yard setback where 5 feet is required on property zoned R-7 .BD� (Qetti• tia_1
7 units/acre, planned development) and located at 15370 S.W. 100th Court
(Wash. Co. Tax Map 2S1 11CA, Tax Lot 9200).
DECISION: Notice is hereby given that the Plannin- D:_rector for the City of
Tigard has APPROVED the above described application subject to certain I
conditions. The findings and conclusions on which the Director based his i
decision arc as noted below.
A. FINDING OF FACT
1 . Background
The property is one of the lots created by Gulf Sia. Estates
subdivision (S 6-83) which was approved by the City in 1983.
2. Vicinity Information
The 'Land to the north, east, and south is also zoned R-7 (PD) and
the area to the northwe,4t is zoned R-3.5 (Residential, 3.5
unite "acre). Gulf Side Estates is just beginning to be developed
and except for one house to the north which is under construction,
the adjacent parcels are vacant
3. Site Information and Proposal Descrip'.ion
The lot contains a home that is under construction. When the
footings where inspected by the City, it appeared that the house
had 5 foot setbacks in each side yard. When a survey check was
done later, it was discovered that the east side of the house only
has a 4.5 foot setback.
Since the approval of the subdivision, the Community Development
Code was amended to include a 10 foot side yard setbitck
requirement for flag lots. However, this standard only applies !_,)
subdiviElon lots that have been created since it was enacted and
not to pre-existing subdivision lots.
4. Agency and NPU Comments
The Engineering Division and Building Inspection Office have no
zbJection to the request.

B. ANALYSIS AND CONCLUSION
The following criLeria In the Community Developme_it Code app.',)- to
variance requests:
1. The proposed variance will not be materially detrimental to the
purposes of this Code, be in conflict with the policies of. the
Comprehensive Plan, to any other applicable policies and
standards; and to other properties in uie same zoning district or.
vicinity;
2. There arc special circumstances that exist which aie peculiar t_
the lot size or shape, topogrc.phy or other circumstances over
which the applicant has no cor.troi, and which are not applicable
to other properties in the same zoning district;
3. The use proposed will be the same as permitted under this Code and
City standards will be maintained to the greatest extent that is
reasonably possible, while perfritti.ng some ecanomic use of the
land;
4. Existing physical and natural systems, such as bu, not limited to
traffic, drainage, dramatic land forms or parks will not be
adversely affected any mere then would occur if the development
were located as specified in the Code; and
5. The hardship is not self-imposed and the variance requested is the
minimum variance which would alleviate the har.•.,hip.
The primary purpose of the setback standards for the R-7 zone is to
allow for adeq,!ate spacing, air, light, and privacy for residential
structures. The variance will not have an appreciable effect upon the
existing or proposed residence in the area.
The lot is relatively small and if all setback requirements from the
property lines and the house were enforced, the applicant would have to
move the building or adjust the property line. The City has no
objection to the 4.5 foot setback, ladever, permission must be granted
by the utility companies which are eligible to use the 5 foot easement
before a building may encroach upon the easement.
C. DECISION
The Planning Director approves V 17-84 subject to the following
condition:
1. Prior to issuance of an occupancy permit, written permission to
encroach upon the 5 foot utility easement must be obtained from
G.T.E.
